On April 26-27, 2012, Colorado Law honored David H. Discrimination on the basis of gender identity or expression has emerged as a major focus of civil rights reform. Opponents of these reforms have structured their opposition around one dominant image: the bathroom. With striking consistency, opponents have invoked anxiety over the bathroom -- who uses bathrooms, what happens in bathrooms, and what traumas one might experience while occupying a bathroom -- as the reason to permit discrimination in the workplace, housing, and places of public accommodation. This rhetoric of the bathroom in the debate over gender-identity protections seeks to exploit an underlying anxiety that has played a role in …

We examine how different welfarist frameworks evaluate the social value of mortality risk-reduction. These frameworks include classical, distributively unweighted cost-benefit analysis—i.e., the “value per statistical life” (VSL) approach—and three benchmark social welfare functions (SWF): a utilitarian SWF, an ex ante prioritarian SWF, and an ex post prioritarian SWF. We examine the conditions on individual utility and on the SWF under which these frameworks display the following five properties: i) wealth sensitivity, ii) sensitivity to baseline risk, iii) equal value of risk reduction, iv) preference for risk equity, and v) catastrophe aversion. In this response, I will begin by identifying questions and issues about Stumped that might present themselves from law in literature and law as literature perspectives. This analysis will be followed by a discussion of the play from a particular law and narrative approach, one that ideologically is allied with feminist jurisprudence and critical race studies. Finally, I will conclude by examining the play in connection with scholarship on the cultural study of law, specifically emphasizing ways in which law and literature mutually constitute one another as opposed to being distinct categories of knowledge.

Virginia is growing. Between 1990 and 2000, Virginia’s population rose by over 14% - the largest population growth experienced by the state in a single decade (Pollard, 2007). And the state continues to grow. It has been estimated that by 2030, Virginia’s total population may exceed 9.8 million people (Pollard, 2007). Along with population growth, land development has increased which in turn affects transportation, housing and job placement across the Commonwealth. House Bill 9 was introduced by Delegate Mark L. Cole (R – House District 88 – Fredericksburg) as chief patron with support from co-patron Delegate Charles D. Poindexter (R – House District 9 – Glade Hill). The bill states that a voter who is unable to present one of the forms of ID may sign a sworn statement that he/she is the named registered voter he/she claims to be and then be allowed to vote a provisional ballot. Lawyers have had a long, but ambivalent, relationship with metaphor. Viewed by some as a mere literary device, a trick of language that "adds little of substance to an argument," metaphor is seen by others as an essential component of legal language, a rhetorical device inseparable from thought. On one thing, though, all can agree: lawyers only have words to express their thoughts, so they have an obligation to use words, whether used metaphorically or not, as exactly as possible.

This article offers a critique of the way lawyers meet this obligation when they use metaphors based in musical language. …

Surveys of emotions offer great potential to understand micro-social dynamics and wellbeing not only within small groups, but within nations as a whole. The most commonly reported emotions in surveys – happiness, satisfaction, loneliness, etc - hint at the social experiences of people from different class, ethnic, marital backgrounds, etc. However, such questions are usually generalised to ‘whole of life’ or domain-specific (eg work, family, etc) assessments. They are unable to capture the micro-social dynamics of interaction, power, and status, and consequently lose much of the social interplay of emotions. This paper examines the thinking machines depicted in the visual and theoretical works of Surrealism and other avant-garde movements of the early 20th century. The aim is to establish to what extent the conceptions of these machines prefigure Turing’s ideas about the mechanical brain. Whereas Surrealism and its artistic antecedents (such as the Dadaists) are generally thought to have been uninterested in or mistrustful of such technological developments, it will shown that a number of artists/theorists (Ernst, Duchamp, Picabia, Hausmann, Matta, Dalí, Caillois) envisaged the notion of the thinking machine in a manner which anticipated a number of Turing’s ideas …

The word crisis derives from the Greek , ***** “judgment.” Interestingly, DC Comics published in 1985 a twelve-part series titled Crisis on Infinite Earths whose main goal was to clean up the chaos of narrative parallel universes which DC’s writers had established over the past forty-five years, in order to start afresh with one single story continuity. While a miserable fail as an attempt at simplification, Crisis on Infinite Earths still inaugurated an era of multifaceted, elaborate and rich superhero comic books. The importance of popular culture in the study of politics–especially in the creation, development and propagation of political ideas–has scarcely been examined in any depth by students of politics. The cultural representations of political institutions and processes apparently escape the defined fields of the theoretical disciplines concerned with political phenomena. Political philosophy, particularly in the Englishspeaking world, has been largely committed in the last four decades to provide rationally compelling arguments aimed to justify the principles of political morality, detaching itself from concrete political experience and privileging instead an abstract, universal and ahistorical normative account of the ideal polity.
