I want to direct attention to only one of the many important issues raised by Professor Cramton's article, namely the peculiar division between academic and religious thought in our culture. In the academic world we tend to speak as though all participants in our conversations were purely rational actors engaged in rational debate; perhaps some people out there in the world are sufficiently benighted that they turn to religious beliefs or other superstitions, but that is not true of us or, if it is true, we hide it, and it ought not be true of them. Jon Cockburn exhibited, in conjunction with works by expatriate Australian Artist Gerry Weise, at the Australian Embassy, 4 rue Jean Rey, Paris, France between the 25 September to 30 October 1987 in an exhibition entitled by Gerry Weise ‘Rituel Commun + Common Ritual’. The exhibition was listed in French art journal Art Press and gained other print media publicity (two further exhibitions of works by Cockburn and Weise using the title ‘Rituel Commun + Common Ritual’ also took place over the following months at privately run galleries in Reims and Toulouse). The Legal Ethics Of Radical Individualism, Thomas Shaffer

Most of what American lawyers and law professors call legal ethics is not ethics. Legal ethics has come to be rules that appeal to sanction, and not the lawyer’s conscience. This Article analyzes the ethical quandary arising from modern ethics, and presents an assessment of the ethics of radical individualism in terms of the religious tradition’s influence on legal ethics.

Most criminal codes, and most criminal law courses, begin with the 'familiar litany' of the purposes of criminal law sanctions - just punishment, deterrence, incapacitation of the dangerous, and rehabilitation. We train and direct our lawyers, judges, and legislators to use these purposes as guiding principles for the distribution of criminal sanctions. The purposes are thus to guide both the drafting and interpretation of criminal statutes and the imposition of criminal sentences in individual cases. The purposes frequently conflict, however, as part I will demonstrate. Conflicts arise because each purpose requires consideration of different criteria; in some cases, a particular …
