Initial Teacher Education (ITE) is a critical arena for advancing inclusion in Health and Physical Education (HPE). This paper reports research that is engaging with the diversity of the HPE profession and practitioners. It centres on a unique case study that critically explored the school-based professional experience of an Australian secondary HPE Pre-service Teacher (PsT) who has a hearing impairment. Specifically, to enable PST success in HPE professional experiences as defined by the professional standards for teachers in Australia and to which, PSTs’ must evidence to graduate and attain teacher registration. Drawing on documentary and interview data the paper focuses …

Legislative Bill 519: Creating And Lobbying For Original Legislation, Brooklyn Terrill
Honors Theses
This project reflects the process of writing and attempting to pass state legislation, Legislative Bill 519, as a college student. LB 519 is an immunity policy for certain drug and alcohol charges that would be potentially prohibitive to a survivor or witness of sexual assault reporting the crime. The first several sections cover the process of developing and introducing legislation. These sections cover the process of developing the idea for LB 519 and the thought process behind the language and structure of the bill. It then covers the advocacy portion of passing a bill which includes testifying and lobbying for …

Transforming Pete’S Initial Standards: Ensuring Social Justice For Black Students In Physical Education., Brian Culp
Faculty and Research Publications
Calls to transform the initial Physical Education Teacher Education (PETE) standards to reflect social justice have garnered little attention. Recent events have magnified the racial injustices inflicted upon Black people in America and their ability to participate as full equals in a society influenced and characterized by white supremacy. Using critical race theory (CRT) as a framework, the authors examine the racial formulation of the historical and current installations of SHAPE America’s initial PETE Standards to illustrate the influence of white supremacy in PETE programs, the relationship to physical literacy, and the impact on Black students. After analysis, the authors …
The Impact Of Edwards V. Aguillard On Science Education In Louisiana Public Schools, Abigail Mcdonough
The Impact Of Edwards V. Aguillard On Science Education In Louisiana Public Schools, Abigail Mcdonough
Senior Honors Theses
The landmark Louisiana case Edwards v. Aguillard ushered in a new era of legislation in which certain ideas are discriminated against because of their religious basis. Due to the Court’s misinterpretation of evidence and employment of a faulty test for a secular purpose, the Court is responsible for disastrous and far-reaching implications. This thesis will examine how the 1987 Supreme Court case Aguillard shifted American science education away from the exploration of multiple competing theories of man’s origins in the classroom. Although America was founded on principles such as freedom of religion and thought which should be protected, the Aguillard …
Efficacy Of Clery Act Timely Warning And Emergency Notification Messages, Travis W. Douglas
Efficacy Of Clery Act Timely Warning And Emergency Notification Messages, Travis W. Douglas
Arlen Specter Center Research Fellowship
The Clery Act (20 U.S.C. § 1092(f)) was passed following the rape and murder of Jeanne Clery in 1986 at Lehigh University. The intent of the law was to improve campus safety by making information about crime as well as safety and security policies more accessible to students, parents, employees, and others. This study explored the efficacy of the emergency notification and timely warnings provisions of the law. The study found these messages to be useful in promoting campus safety, particularly by informing people about safety issues and impacting people’s behavior related to self-protection. However, safety related behavior changes are …

We’Ve Come A Long Way (Baby)! Or Have We? Evolving Intellectual Freedom Issues In The Us And Florida, L. Bryan Cooper, A.D. Beman-Cavallaro
Works of the FIU Libraries
This paper analyzes a shifting landscape of intellectual freedom (IF) in and outside Florida for children, adolescents, teens and adults. National ideals stand in tension with local and state developments, as new threats are visible in historical, legal, and technological context. Examples include doctrinal shifts, legislative bills, electronic surveillance and recent attempts to censor books, classroom texts, and reading lists.
Privacy rights for minors in Florida are increasingly unstable. New assertions of parental rights are part of a larger conservative animus. Proponents of IF can identify a lessening of ideals and standards that began after doctrinal fruition in the 1960s …
An Investigation Of Teachers’ Knowledge, Experiences, Interpretations, And Perceptions Of Education Law And Their Decision-Making Processes During The Legal Navigation Of The Education Profession: A Collective Case Study, Mary Jones
Doctoral Dissertations and Projects
The purpose of this collective case study was to discover, describe, and understand 11 public, general, K–12 in-service teachers’ knowledge, experiences, interpretations, and perceptions of education law. In addition, the study investigated teachers’ critical decision-making processes during their daily activities and responsibilities in the education profession in selected areas such as student bullying, fights, grades, students with disabilities, and teachers’ and students’ rights. Three theories that guided the study were constructivism (Young & Collin, 2004), cognitive dissonance (Chapanis & Chapanis, 1964), and self-efficacy (Bandura, 1977). Through purposeful sampling, 11 K–12 in-service teachers from the United States with at least one …

Living Among Guatemalan Mayans Is Fascinating Experience, Irene Scharf
Faculty Publications
I have just lived a dream. Five years ago I learned of a school where students of all ages could study Spanish intensively while living among the Guatemalan Mayans. Peace Accords had been signed in 1996, the government was encouraging tourism, and it was, finally, safe to visit.
Why a dream? Because, 25 years ago, when I traveled through Central and South America, I promised my family I would avoid Guatemala because of the perceived was dangers. During that trip, as I met my Europeans and other who had visited, remained safe, and found it a fascinating country, I vowed …

Comparison Of Perceptions Of Inclusion Between University Instructors And Students With Disabilities In Ukraine, Sharon A. Raver, Kateryna Kolchenko
Communication Disorders & Special Education Faculty Publications
Ukraine is currently involved in a heated debate about inclusion at all levels of education. This debate has become part of the country's efforts to improve human rights. Prior to independence in 1991, students with disabilities in Ukraine who desired higher education were not permitted to attend universities. How instructors and students with disabilities perceive the process of integration is important for Ukraine's continued movement toward becoming an egalitarian society. This study examined the differences in attitude regarding inclusion and university life between university instructors and students with special needs attending Open International University of Human Development “UKRAINE,” the only …

Ec95-816 Extending The Clean Water Act: Issues And Alternatives, Roy Frederick
University of Nebraska-Lincoln Extension: Historical Materials
Author's note: This publication was written in the months immediately prior to the beginning of the 104th Congress in January 1995. While the basic issues ave not changed, the schedule for reauthorization of the Clean Water Act and the approach to issues may have been altered by the change in political-party leadership in the Congress. For example, wetlands policy and private property rights may be treated as separate pieces of legislation in 1995.
The Federal Water Pollution Control Act of 1972, frequently referred to as the Clean Water Act (CWA), was last amended and updated in 1987. This reauthorization expired …

Author's note: This publication was written in the months immediately prior to the beginning of the 104th Congress in January, 1995. While the basic issues have not changed, the schedule for reauthorization of the Safe Drinking Water Act and the approach to issues may have been altered by the change in political-party leadership in the Congress. For example, contamination standards for drinking water may become a part of general "risk-assessment" legislation in 1995.
In 1974, Congress passed the Safe Drinking Water Act (SDWA), P.L. 93-523. Its purpose was to protect the nation's drinking water from harmful biological and chemical contaminants. …

Perceived Role Responsibilities Of Physical Therapists And Adapted Physical Educators In The Public School Setting, Mindy Blumenkopf, Pamela Levangie, David L. Nelson
All PTHMS Faculty Publications
Right to Education legislation has brought physical therapists and adapted physical educators together in the public school setting to serve the child with special needs. Investigation of the role responsibilities of these professionals would facilitate not only communication between the groups, but also understanding of their functions by other school personnel and administrators. We analyzed questionnaires returned by 79 physical therapists and 30 adapted physical educators to determine areas of uniqueness or similarity in 18 identified role responsibilities performed by these two groups. Each subject rated the appropriateness of each role to physical therapists and to adapted physical educators. On …

Animals In British Schools: Legal And Practical Problems, Jennifer Remfry
Animals In British Schools: Legal And Practical Problems, Jennifer Remfry
Education Collection
Well-managed, healthy animals can be useful and beneficial aids to the emotional and intellectual development of young people at the primary and secondary levels of education. In Britain, vertebrate animals are not used in schools for experiments which might cause pain, distress or disease. The laws protecting animals are comprehensive but at present it is the Health and Safety at Work Act (1974) which is having the most impact on the keeping of animals in British schools. The practical skills most needed by teachers are in the handling, sexing and humane killing of animals. Training of teachers should include instruction …
