On June 28, 2007, the U.S. Supreme Court decided a crucial case involving race-based, public school assignment plans in compulsory education. The quote above from Justice Thomas’s concurrence captures the spirit of the Court’s decision in Parents Involved in Community Schools v. Seattle School District No. 1, striking down public school assignment policies based on racial classifications. Quite simply, the Court determined that the policies used in both the Seattle and Louisville school districts violated the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution. The Supreme Court decision in PICS v. Seattle came as little surprise to the many who believed that the current conservative makeup of the court would triumph over legal reasoning and precedent. The decision was 5-4 against the school districts, but the difference was 4-1-4 with liberal and conservative justices splitting evenly, and moderate conservative, Justice Anthony Kennedy, concurring with the decision of the other conservatives, but not their entire reasoning. Washington has experienced a large increase in the population of students of color in recent years. According to a 2000 report from the Northwest Regional Educational Lab (NWREL) titled, The UNITY PROJECT: Creating a Circle of Awareness, the percent of students of color in 1980 was 12 percent. In 1998, the percent had jumped to 23 and, in 2004, students of color made up 28.6 percent of the student population of Washington. In 2000, 34 percent of Hispanic children and 24 percent of Asian children were living in households where English was not the primary language. A large proportion …
