The Individuals with Disabilities Education Act (IDEA), our nation’s special education law, ensures special education and related services to children with disabilities. The Education for All Handicapped Children Act (PL 94-142) was created in 1975 to ensure that children with disabilities are able to access free and appropriate public education (FAPE) in the least restrictive environment (LRE). This act was reauthorized as IDEA in 1990. One in every seven students in the United States receives special education services through the IDEA, requiring a large, highly qualified special education workforce to support students’ rights to FAPE. The use of restraint and seclusion for managing children’s behaviors in schools has led to physical and psychological harm, and, in the most extreme cases, even death. For more than a decade, the level of research and concern regarding restraint and seclusion in schools has grown. The experience of being restrained and secluded in school can be traumatizing and life-altering, particularly for children with developmental, mental health, or intellectual disabilities. While adults and children in mental health and correctional facilities are protected by law from the unnecessary use of restraints and seclusion, no federal law protects our children in schools. …

Senator Harkin (D-IA), Senator Murphy (D-CT), Senator Baldwin (D-WI), and Senator Hirono (D-HI) introduced the Keeping All Students Safe Act (S.2036) in the Senate on Feb. 24, 2014. Rep. Miller (D-CA) introduced H.R. 1893 on May 9, 2013. The Act would produce limitations for the use of restraints in public and private schools. Currently, 19 states have no policies in place to address this issue. The law would require better training, monitoring and enforcement of these standards, as well as the collection of related data which would be available to the public. On May 9, 2014, Representative Smith (R-NJ) and Representative Doyle (D-PA) introduced a bill to reauthorize the Combating Autism Act (H.R. 4631) for five years. Senator Menendez (D-NJ) and Senator Enzi (R-WY) are planning to introduce a Senate bill of the Combating Autism Reauthorization Act. The Combating Autism Act of 2011, due to sunset September 30, 2014, provides federal funding for autism research, public education, and early detection and intervention in Maine. We are hoping that you will consider voting in support of the Combating Autism Reauthorization Act.
