Houve tempo em que a Constituição servia para poisar ou charuto ou tirar um argumento político, como ironicamente afirmaria o grande escritor oitocentista Eça de Queiroz. Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

Studies have examined the impact of environmental variables on academic achievement among student athletes in the revenue-generating sports of men’s basketball and football. However, while evidence concerning the positive impact of male student athlete and faculty interaction is virtually unequivocal, we are not certain whether the benefits accruing from particular types of interaction vary across different racial/ethnic groups. This study explores the relationship between male Black and White student athletes and faculty as well as the impact of specific forms of student athlete– faculty interaction on academic achievement. Accountability and evidence-based decision-making have become the mantra of government polilcymakers, and even private foundations. Yet most attempts to foster cultures of evidence have not brought about change in Practices, notably because they are treated as management tools rather than learning processes. Equity for All is an approach to accountability that is grounded on the principles of practice theory and sociocultural theories of learning. The authors provide empirical evidence to illustrate practitioner learning.

This paper will attempt to chart a normative framework for action for a social politics of reconciliation via a course for citizens’ action across the ethnic divide of Cyprus. It will attempt to consider the context and content of reconciliation in Cyprus at this time and examine the various ‘routes’ to reconciliation, in terms of locating their theoretical, philosophical and ethical points of reference. This paper aims to connect articulations of ‘racism’ and ‘populism’ within discursive uses of ‘illegal immigration’ in the context of European-wide processes, which frame migrants as the ‘other’: such view have in fact become hegemonic over the recent years. The aim is to connect discourses of ‘illegal’ immigration to social phenomena, such as racist populism in democratic process and debates regarding social citizenship. The examination of the construction processes of exclusionary citizenship, both at European and at national level, via the discourses of undocumented migrant labour is a process that tends to racialise liberal democracy across Europe. The provision of secondary school education in Victoria has changed substantially over the past 50 years. This thesis examines the consequences of these changes for the academic opportunities of government school students. In the 1950s and 1960s, unprecedented numbers of students and near-universal school participation provided a challenge to governments in relation to education provision. As a result, the comprehensive ideal for organising government secondary schooling was adopted. This system became an important vehicle for providing educational opportunities for many students who previously had limited access to the post-primary years. Community colleges in America developed out of a need to fill the gap between high school or technical education and university-level study. The two-year postsecondary experience which is typically offered at locations that are “community friendly” has attracted persons of color and those with more conservative economic means in ever-increasing numbers. Historically, these marginalized populations have experienced educational inequalities in larger numbers than other groups. As statistics show increasing enrollments from members of these groups, community colleges must provide and improve services that appropriately address both student need and societal demand. Mas o discernimento e ponderação terão que ser muito grandes.

Iatrogenesis is a term typically reserved to express the state of ill health or the adverse outcome resulting from a medical intervention, or lack thereof. Three types of iatrogenesis are described in the literature: clinical, social and cultural. This paper introduces a fourth type, technological iatrogenesis, or emerging errors stimulated by the infusion of technological innovations into complex healthcare systems. While health information technologies (HIT) have helped to make healthcare safer, this has also produced contemporary varieties of iatrogenic errors and events. The potential pitfalls of technological innovations and risk management solutions to address these concerns are discussed. Specifically, failure …
