Early childhood is a crucial time in a child's development and is often the entry point for a child experiencing developmental delays in the special education process. Parents play an essential role in the special education process as the child's primary caregivers. This study examined the decision-making process of economically disadvantaged Black and Hispanic/Latinx parents as they provide input on classroom setting decisions during preschool IEP creation. Through in-depth interviews, parents shared their lived experiences as they navigated the special education process and made decisions on classroom settings as part of the IEP team. African American male students are disproportionately represented in special education. The purpose of the current study is to examine the disproportionality of African American male students who are referred to special education programs and are identified special education services, specifically in the areas of Emotional Disturbance (ED), Specific Learning Disability (SLD), and other low incidence disabilities (OTH), which includes Speech & Language Instruction, Other Health Impaired, Autism, and Traumatic Brain Injury, in Northeast Ohio’s suburban school district for the 2017-2020 school year. Despite disability advocacy, case law, and legislative attempts to regulate equity in placement, students of color with disabilities are removed from general education settings at higher rates than peers. Ongoing advocacy to extend legal protections and utilize dispute resolution procedures contributed to special education’s reputation for being litigious. This study included a recent review of literature on landmark education cases and litigation using a symbolic organization framework to analyze special education placement procedures, disputes, and decisions. This capstone seeks to examine multiple factors that affect Black youth in Chicago Public Schools (CPS) during the psychological evaluation process, and subsequently develops a coaching model for CPS school psychologists to provide more ethical and equitable psychological evaluations for Black youth. An analysis of the system of CPS finds that Black students are more likely to receive special education services and be placed within restrictive settings in special education than their white peers. Despite this, CPS school psychologists receive no training specific to evaluating or working with Black youth. A review of the literature reveals that there are multiple …

The policies adopted by the Exceptional Children’s Education Act (2016) enabled disproportionality within LEAs by overlooking undocumented classroom removal practices, underestimating the monitoring and reporting criteria, and overlooking non-dominant cultural and linguistic groups within the Colorado community. In this critical policy analysis, I used quantitative methods to analyze and explore the difference between the odds ratio calculation of culturally and linguistically diverse students (CLDS) in special education with a least restrictive environment (LRE) of 40% and greater compared to Colorado’s acceptance of the federal mandate of the minimum requirement of the student LRE of less than 40% and alternate school …

The Least Restrictive Environment (LRE) is the guiding force behind placement for special education students. It provides students with disabilities access to the general education classroom and the ability to learn. The Individuals with Disabilities Act of 2004 (IDEA) sets forth regulations that require academic institutions to prioritize inclusive learning for all students regardless of the severity of needs. However, through various studies and findings, institutions have not followed mandates wholeheartedly. Disproportionality of historically marginalized populations in special education continues to be a critical concern. The identification of students with disabilities is reliant on valid and reliable assessment that is free of bias. The extent to which this is possible given measurement constraints and an increasingly diverse student population is unclear. How teachers are trained to design, select, administer, score, and interpret assessment data related to the identification of students with disabilities is vastly under-researched considering the significant implications of assessment practices. This study explores the perspectives of four economically disadvantaged, Black students who have been labeled as learning disabled and placed in the Special Education program. The voices of the students interviewed are used to develop unique, first-hand understandings of the cause of disproportionality among poor, Black children in Special Education with a learning dis/ability. Results from the data collected through individual and group interviews suggest that students do not regard themselves as dis/abled as they find themselves capable of learning and executing non-academic tasks that relate to their lived reality. When special education eligibility is being determined under Specific Learning Disability, the exclusionary clause needs to be carefully considered. The current study was concerned with the exclusions of cultural factors, environmental or economic disadvantage, and limited English proficiency. The study used a semi-structured interview to explore when and how the exclusionary clause is considered by school psychologists in Virginia and what type of impact it has on eligibility decisions. Black students are negatively affected by disproportionality in school discipline practices, special education identification, and over-restrictive special education placement. Critical race theory is an operative framework that can be applied to increase understanding of such disproportionality (Blanchett, 2011). Through the use of qualitative retrospective chart review methods, this research investigated the under-representation of Black students with Autism in the context of educational evaluations, and from the Ordinariness and Social Construction Tenets of CRT. Research suggests that how teachers perceive the behavior of individual children in the early years of elementary school has important implications for the school success of those youth over time (Darney et al., 2013; Hibel et al., 2010; Jimerson et al., 1997; Reinke et al., 2008). This may be because children who are of concern to teachers are often identified for practices such as grade retention and/or special education placement. Male African American students with disabilities in a South Carolina school district have received a greater proportion of discipline referrals and exclusionary consequences than have other demographic groups. The purpose of this sequential mixed methods study was to explore classroom management strategies that may reduce this disproportionality. The conceptual framework was Skinner's applied behavior theory, which states that to change behavior, the environment must be changed. The qualitative guiding question investigated teacher beliefs about best classroom management practices. English Language Learner Disproportionality In Special Education: Implications For The Scholar-Practitioner, Diana Linn, Lynn Hemmer

This study examined the representational patterns of English language learners (ELLs) receiving special education services in school districts in a southeastern Texas region over a 7-year period. Results indicated that although relative risk ratios have decreased over time, the region as a whole continued to show overrepresentation of ELLs in special education. Additionally, the percentage of districts demonstrating overrepresentation decreased by almost half over the 7 years. The intent of this study was to determine if special education teachers had certain perceptions regarding the disproportionate amount of minorities in special education classes. I examined special education teachers' awareness of the disproportionality, their causal theories, and the effectiveness of Response to Intervention (RTI) to regulate disproportionality. I implemented three different data collection methods to measure the teachers' perceptions: an initial face-to-face interview session, a written survey, and additional interview questioning. Participants in the study included 11 special education teachers from three middle schools in Northern Georgia. Ten of the 11 teachers admitted awareness of the problem of disproportionality, …
