The economic and social consequences of untreated (or under-treated) substance abuse among minors are significant. This report provides a racial impact analysis of HB 1075/SB 201, legislation approved in the 2012 General Assembly session that seeks to improve access and use of substance and alcohol services by minors. In short, this policy could go a long way to ensure that families are properly educated about these life-changing (and life-saving) programs; however our analysis raises concerns related to cultural competency that may serve to undermine the legislation’s goal. Virginia is incredibly diverse and its communities vary widely with its assets and …

The adoption of House Bill 462 into law brings forth questions about the probable impact on the physical, mental, emotional and financial well-being of the women in Virginia. In particular, analysis of its effect on the minority and underserved female population is required. Understanding the origin of this new legislation and the thinking behind its proposal and subsequent adoption dictates an endeavor into the backgrounds and intended goals of its sponsors and supporters. Proponents of HB 462 were unresponsive to requests for an interview to expound on their perspective about the importance of the legislation. This precipitated the use of …

Can They Work Well On A Team? Assessing Students' Collaborative Skills, Sophie M. Sparrow
Can They Work Well On A Team? Assessing Students' Collaborative Skills, Sophie M. Sparrow
Law Faculty Scholarship
[Excerpt] "Among the many critiques of legal education are criticisms that law students do not graduate with effective emotional intelligence skills-in particular, they have not learned to work well with others. Working with others is an important legal skill; and as law practice increasingly relies on collaboration among lawyers, legal staff, clients, and other individuals, so have legal employers raised the demand for effective collaborative skills among law students and recent graduates.
This essay will focus on ways to engage students in collaborating and assessing that collaboration effectively. Students' interpersonal collaborative skills can be effectively taught and assessed in large …

Indecent Exposure: Do Warrantless Searches Of Cell Phones Violate The Fourth Amendment?, Amy Vorenberg
Law Faculty Scholarship
This article argues that searches of student’s cell phone should require a warrant in most circumstances. The amount and personal nature of information on a smart phone warrants special Fourth Amendment protection. This issue is particularly relevant in the public school setting where administrators routinely confiscate phones from students caught using them in school. With more frequency, administrators are looking at the phones, scrolling through text messages and photos, and on some occasions, responding to text messages.
The U.S. Supreme Court in Safford v. Redding, acknowledges the special considerations that school children should be afforded in part because of the …

The Politics Of Physical Education Reform, Ari Zyskind
The Politics Of Physical Education Reform, Ari Zyskind
CMC Senior Theses
The purpose of the paper is to determine why today's youth are so physically inactive by examining the role and efforts of physical education, and the state and federal governments responsibility in supporting these programs, in fighting today's obesity epidemic by creating generations of healthy and physically active children. Research led to the determination that states have failed to maintain and improve physical education resulting in a physically inactive youth. Therefore, the nation should look to federal legislation to support state-led physical education, which this paper found to be constitutional if the enactments followed the provisions established in South Dakota …

Can Students Be Disciplined For Off-Campus Cyberspeech: The Reach Of The First Amendment In The Age Of Technology, Charles J. Russo, Allan G. Osborne Jr.

The widespread use of technology in today's schools has ushered in a host of legal issues that educators and parents could not have contemplated just a few years ago. Within the past decade, students have had the unprecedented ability to send text messages and instant messages, create websites, post blogs, construct Internet profiles, and post messages on burgeoning social networking sites, most notably Facebook. Even when students engage in such speech-related activity off campus using their personal computers, their actions and posts on such social networking sites as MySpace and Facebook can have carryover effects into school and classroom environments. …
Computer-Supported Peer Review In A Law School Context, Kevin D. Ashley, Ilya Goldin
Computer-Supported Peer Review In A Law School Context, Kevin D. Ashley, Ilya Goldin
Articles
Legal instructors have been urged to incorporate peer reviewing into law school courses as a way to provide students much needed feedback. Peer review can benefit legal education, but only if law school instructors adopt peer review on a large scale, and for that, computer-supported peer review systems are crucial. These web-based systems orchestrate the mechanics of students submitting written assignments on-line and distributing them to other students for anonymous review, making it considerably easier for instructors to manage.
Beyond the problem of orchestrating mechanics, however, a deeper obstacle to widespread acceptance of peer review in legal education is the …
Regulating The Boundaries Between The Public And Private Lives Of Teachers In Changing Cultural Contexts: An American Perspective, Charles J. Russo
Regulating The Boundaries Between The Public And Private Lives Of Teachers In Changing Cultural Contexts: An American Perspective, Charles J. Russo
Educational Leadership Faculty Publications
Regardless of whether they wish to be regarded as such, there can be little doubt that most teachers and parents in Australia, New Zealand, and the United States agree that teachers are role models for students regardless of whether educators act in or out of schools. Yet, during this time of changing cultural contexts, the boundaries between the private and professional lives of teachers are blurred such that teachers may face liability for what they say or post in a more contemporary application of free speech, via the internet.
In light of ongoing changes, this paper examines how shifts ranging …

Part I describes the difference in extrinsic and intrinsic motivation and reviews the negative effects of business and educational models assuming extrinsic motivation to be most effective rather than seeking to stimulate intrinsic motivation. Part II describes the Carnegie Foundation's Preparation for the Professions project's call for law schools to focus on law students' sense of identity and purpose as part of their professional education, as well as noting the similar goal that students learn "how to be" as articulated by the Tuning Project of the Bologna process regarding higher education in Europe. Part III provides basics on the theory …

Culture Clash: Special Education In Charter Schools, Robert A. Garda Jr.

Charter schools and special education for disabled students are based on conflicting education reforms and agency oversight principles. Charter schools operate in a culture of regulatory freedom and flexibility. They arose out of the modern era of accountability reform, in which student outcomes are the primary measure of school success and the driving engine of agency oversight. In stark contrast, special education laws were conceived in the civil rights era of education reform, which emphasized process and paid little attention to outcomes. The education of disabled students is steeped in a culture of regulatory oversight focused on rigid compliance with …

This article reports on research conducted in the Parma City Schools, Ohio by The Society for Prevention of Violence (SPV). The SPV is dedicated to reducing the prevalence of violent acts and asocial behaviors of children and adults through education. It accomplishes this mission by teaching children and adults the use of the skills necessary to build their character. Findings suggest that the SPV program improves the ability of children within class to pay attention and be organized. The greatest improved social behaviors for participants were in helping others who are having trouble; increased ability to initiate positive interactions; and, …

Malaysia has been actively providing accessibility in the built environment since the country signed the ‘Proclamation on the Full Participation and Equality of People with Disabilities in the Asia-Pacific Region' in 1994. However, Malaysia has limitations in enforcing legislation pertaining to accessibility. One of the concerns was the local authorities’ role in having their own mechanisms to create an accessible built environment. The objective is to highlight the gaps in Malaysia’s regulations and to illustrate the research development of the Accessible Design infrastructure for disabled people. The outcome will describe Malaysia’s experience in Accessible Design.

Repensar A Teoria Do Estado Entre Pluralismo Ético E Globalização, Paulo Ferreira Da Cunha

Compliance Audit Of Anti-Corruption Regulations: A Case Study From Carpatistan Customs, Bryane Michael
Bryane Michael (bryane.michael@stcatz.ox.ac.uk)
The principles and findings from internal government audits (aimed at generating recommendations to improve compliance with anti-corruption regulations) can greatly contribute to the wider anti-corruption literature. Internal audit techniques can overcome the weaknesses of the four predominant approaches to evaluating anti-corruption regulatory performance – the systems design approach, the ad-hoc controls studies approach, the descriptive legal analysis approach and the prescriptive manuals and handbooks approach. This paper discusses a compliance audit of anti-corruption regulations in an anti-corruption audit conducted in 2009. The audit findings and recommendations illustrate the ways that models and previous research in the social sciences can be …

Social media [technology] has become a growing phenomenon with many and varied definitions in public and academic use. For our purposes, the term social media technology (SMT) refers to web-based and mobile applications that allow individuals and organizations to create, engage, and share new user-generated or existing content, in digital environments through multi-way communication. Despite the widespread use of SMT, little is known about the benefits of its use in postsecondary contexts and for specific purposes (e.g., marketing, recruitment, learning, and/or student engagement). It is critical to begin to examine if and how higher education institutions are incorporating the use …

Presented in this article is a counternarrative concerning one particular message that is consistently reinforced in academic and public discourse about Black male students: they don’t care about education. Little is known about those who graduate from high school, enroll in college, and subsequently commit themselves to various career pathways in education fields (K-12 teaching and administration, the postsecondary professoriate, education policy, etc.). What compels these men to care so much about education, despite what is routinely reported in the literature regarding their gradual disinvestment in schooling? This question is explored in the article using data from 304 Black male …

Legal Consciousness And Lgbt Research: The Importance Of Law In The Everyday Lives Of Lgbt Individuals, Nancy J. Knauer
Nancy J. Knauer
The law occupies a prominent place in the everyday lives of LGBT individuals, and the continuing regulation and policing of sexuality and gender weighs heavily on many people who identify as LGBT. Despite remarkable progress in the area of LGBT civil rights, LGBT individuals in the United States still lack formal equality and are denied many of the protections that are afforded other historically disadvantaged groups. These legal disabilities represent an ongoing source of minority stress and can produce a correspondingly high degree of “legal consciousness” within the LGBT community. Given the importance of law in LGBT lives, it is …
