This paper presents some of the benefits of using learning contracts by some in the USA who have used them for many years, and others in Italy who had never used them, but were beginning to experiment with using them. Illustrations of results were provided by colleagues from both countries, comparisons were made between the two, and lessons learned from the experience were shared. There is a very different perspective between using them over a long period of time and just beginning to use them. The purpose of this research project was to examine ways in which higher education professors are trained to teach. Eight professors from a small, liberal arts college in the northeast, who were also recipients of the college’s annual Teacher of the Year award, were observed in the classroom and interviewed about their educational training and background. By following the strategies of inductive reasoning and synthesizing these professors’ experiences and reflections, The author determined that many professors do not receive formal teaching training. Strategic Discussions for Nebraska is a program in the University of Nebraska-Lincoln Institute of Agriculture and Natural Resources that produces an annual publication called Opportunities for Nebraska, focusing on a different topic each year. The publication is produced in hard copy and also is available online at www.sdn.unl.edu.

The content for each publication is produced by UNL students enrolled in a Magazine Writing course each spring semester, taught by the SDN coordinator. Understanding the cultural aspects that affect a student’s ability to appropriately use resources is important in developing outreach and instruction in multicultural settings. Differences in educational philosophies, students’ previous scholastic training and cultural differences in individual motivation are all factors that may affect a freshman’s ability to understand an American university’s idea of academic integrity and can inadvertently cause problems where independent work and critical thinking are required. This Article uses the derivative action in Asia as a lens for re-evaluating the foundational theories of Asian and comparative corporate law. It begins by demonstrating that the cultural theory of “Asian non-litigiousness” provides scant explanatory or predictive value for either the evolution or function of the derivative action in Asia’s leading economies. As such, this Article suggests that the theory of Asian non-litigiousness should be relegated to the dustbin of academic history.
