Managing Internal Tensions In Contract Negotiations: A Perspective From The Academic Union’S Side, John Allison, Jonathan Blitz

Academic collective bargaining, like all collective bargaining, presupposes conflicts between goals of the administration and the academic union. The represented parties on both sides, as well as the general public, typically perceive conflicts in collective bargaining in that way. However, both the administration’s and union’s bargaining teams must substantially resolve internal conflicts among the teams‘ own represented parties before the teams can hope to achieve an acceptable collective-bargaining agreement (i.e., a binding contract). [Excerpt] The paper begins by elaborating on the utility of viewing organizational conflict and negotiations in social movement terms, and some of the implications of this approach for negotiations research. It then turns to a review of the traditional sociological literature on power and conflict in organizations, and of current research on social movements, discussing the points of complementarity of these two literatures. In 2002, the United Kingdom passed new legislation granting employees with young or disabled children the right to request flexible work arrangements from their employers. The law does not guarantee a right to flexible working but seeks to increase flexibility in UK workplaces by requiring a process for negotiation between employees and employers. Stated simply, that process places the initial responsibility on the employee to propose a new work arrangement and explain its potential impact on the employer. The employee and employer must then consider the request together, and the employer may refuse the request only for certain business reasons.

This paper presents a study of the relationship between the Central Kitsap Education Association and the Central Kitsap School District. The Association went to impasse with the District on May 31, 1972. This study will examine how the negotiations process broke down to cause such a situation. A close look will be given to the procedural and legal relations between the District and Association. Recommendations will be given as a result of an analysis of the District-Association relationship. The major recommendation will be joint definition of terms.
