Authorship, and hence, initial ownership of copyrighted works is oftentimes controlled by the 1976 Copyright Act’s work made for hire doctrine. This doctrine states that works created by employees within the scope of their employment result in the employer owning the copyright. One key determination in this analysis is whether the hired party is an employee or independent contractor. In 1989, the U.S. Supreme Court, in CCNV v. Reid, answered the question of how employees are distinguished from independent contractors by setting forth a list of factors courts should consider. With the dwindling of natural resources, like oil and gas, even resource-rich countries like Brunei Darussalam and Malaysia have to re-adjust their development strategies. Governing knowledge for development (K4D) is seen as a way out of the dilemma of reduced revenues from natural resources. This paper analyses the attempts to create knowledge clusters as a strategy to move Brunei and Malaysia towards knowledge-based economies. Our study shows that several knowledge clusters have already been established in Peninsular Malaysia and are starting to emerge in Brunei Darussalam. Why are most capitalist enterprises of any size organized as authoritarian bureaucracies rather than incorporating genuine employee participation that would give the workers real authority? Even firms with employee participation programs leave virtually all decision-making power in the hands of management. The standard answer is that hierarchy is more economically efficient than any sort of genuine participation, so that participatory firms would be less productive and lose out to more traditional competitors. This answer is indefensible. After surveying the history, legal status, and varieties of employee participation, I examine and reject as question-begging the argument that the rarity of genuine …

Converging Divergences: Worldwide Changes in Employment Systems, by Harry C. Katz and Owen Darbishire, examines changes since 1980 in employment practices in seven industrialized countries—the United States, the United Kingdom, Australia, Germany, Japan, Sweden, and Italy—with a focus on the automotive and telecommunications industries. A Descriptive Analysis Of Layoffs In Large U.S. Firms Using Archival Data Over Three Decades And Interviews With Senior Managers, Kevin F. Hallock

This paper uses data on over 4,600 layoff announcements in the U.S., covering each firm that ever existed in the Fortune 500 between 1970 and 2000, along with 40 interviews of senior managers in 2001 and 2002 to describe layoffs in large U.S. firms over this period. In order to motivate further work in the area, I investigate six main issues related to layoffs: timing of layoffs, reasons for layoffs, the actual execution of layoffs, international workers, labor unions, and the types of workers by occupation and compensation categories. Because there has been a nursing shortage for the past decade and because the competition between employers for experienced registered nurses is fierce, I utilized archival quantitative data from a syndicated advertising database known as The Media Audit, quantitative data I collected from 100 surveys, qualitative data that I collected from 15 interviews, and qualitative data that I collected during 20 hours of observations in hospital cafeterias and nearby restaurants to discover how RNs use media, whether or not they share these media as an occupational co-culture, & their attitudes toward recruitment advertising in these media.
