"The End Of The Beginning?": A Comprehensive Look At The U.N.'S Business And Human Rights Agenda From A Bystander Perspective, Jena Martin Amerson Jan 2012

"The End Of The Beginning?": A Comprehensive Look At The U.N.'S Business And Human Rights Agenda From A Bystander Perspective, Jena Martin Amerson

Fordham Journal of Corporate & Financial Law

With the endorsement of the Guiding Principles regarding the issue of business and human rights, an important chapter has come to a close. Beginning with the then U.N. Secretary-General’s “global compact” speech in 1999, the international legal framework for business and human rights has undergone tremendous change and progress. Yet, for all these developments, there has been no exhaustive examination in the legal academy of all of these events; certainly there is no one piece that discusses or analyzes all the major instruments that have been proposed and endorsed by the U.N. on the subject of business and its relationship …

The Unjustified Subsidy: Sovereign Wealth Funds The Foreign Sovereign Tax Exemption, Jennifer Bird-Pollan Jan 2012

The Unjustified Subsidy: Sovereign Wealth Funds The Foreign Sovereign Tax Exemption, Jennifer Bird-Pollan

Fordham Journal of Corporate & Financial Law

The taxation of Sovereign Wealth Funds in the United States is outmoded and due for reconsideration. Offering a tax exemption to the billion dollar investment funds owned by foreign governments is both unfair and ineffective. Founded in the principles of sovereign immunity, the foreign sovereign tax exemption, codified in I.R.C. § 892, fails to satisfy the Congressional goals that motivated its creation. This Article explains the current taxation of foreign sovereigns and, by extension, Sovereign Wealth Funds. It then illustrates that the current exemption is simultaneously too broad, providing a tax exemption for activities that are clearly nongovernmental activities, and …

A Study Of Current Practice Of Corporate Social Responsibility (Csr) And An Examination Of The Relationship Between Csr And Financial Performance Using Structural Equation Modelling (Sem), Lorraine Sweeney

Doctoral

There has been a significant increase in interest in CSR in recent years (Gulyas, 2009; McGehee et al, 2009) and it is regarded as an important topic for research (Burton and Goldsby, 2009). Not only has this topic received academic attention but it is becoming a mainstream issue for many organisations (Renneboog et al, 2008; Nijof and Brujin, 2008). However, it has been noted that research on CSR in SMEs is quite scant (Burton and Goldsby, 2008; Cilberti et al, 2008). A second area of literature that remains unresolved is the relationship between CSR and financial performance (Park and Lee, …

Preventing The Next Enron, John Y. Cannaverde Jan 2009

Preventing The Next Enron, John Y. Cannaverde

Pell Scholars and Senior Theses

Enron an American energy corporation was involved in one of the biggest cases of corporate fraud of the 21st century. In recent times, corporate scandals have been a major issue of public policy. These scandals have brought into question current legislation and the integrity of businesses. The purpose of my thesis is to portray corporate environments that would be prevalent for fraud and how to prevent it. Establishing a strong ethical business culture is the greatest factor to preventing corporate fraud. Business culture is a mechanism that aligns values of the company with organizational processes and creates a natural selection …

Taking Your Values Shopping: Conversations About Values And Fulfilment: Dialogue And Engagement With Customer Stakeholders In The Body Shop, Western Australia, Patricia Morrigan, Megan Paull

Research outputs pre 2011

The specific contribution to this field of study is about customer 'engagement', their values and fulfilment. In this research we wanted to have a conversation with customers of The Body Shop Australia (TBS) about taking their values shopping. We found that TBS customers were remarkably clear and passionate about their own personal values and had no trouble expressing them in a conversation with us. Customer stakeholders in this research expressed values that were 'postmaterialist', concerned with the environmentally human choice and self -expression, gave importance to belonging among family and friends and showed a marked lack of trust in global …
