Corruption In The U.S. Pharmaceutical Industry, Anna Woelfel

Supply Chain Management Undergraduate Honors Theses

A story that has to be told too often is that of the people who cannot afford lifesaving medications, and as a result do not survive. Doctor Nicky Mehtani says that the inability of a patient to afford their medication can be a common cause of death. This is an answer not accepted by grieving family members who have lost a loved one. It is estimated that more than a fourth of people in the United States needing medical treatment struggle with payment or simply cannot afford to pay for the lifesaving medications that they need (Mehtani, 2018). Deteriorating American …

Southern University College of Business E-Journal

The economic consequences of a First Nations response to Enbridge and the voicing of concerns over the violation of human rights resulting from the proposed Northern Gateway pipeline are examined. Despite overwhelming opposition and contrary to indigenous rights, the proposed pipeline was to cross more than 50 territories claimed by First Nations. The pipeline would transverse through unique ecosystems that are home to endangered species, and tankers would travel through one of the largest undeveloped temperate rainforests in the world. Given Enbridge’s history with oil spills and environmental violations, potential future oil spills are a serious concern. Because of these …

Rethinking The Role Of Business School In Creating Corporate Managers, Khurram Parvez Raja, Muhammad Anowar Zahid

All Works

Distinguished from the traditional forms of business, namely proprietorship and partnership, a corporation emerged as a new type of business organization in the middle of the nineteenth century in American society, which accepted it only on the understanding that the corporate managers should be professionally well trained and socially beneficial (Khurana, 2010). In order to prepare these new professionals, the business schools came into being in America and elsewhere (Khurana, 2010). However, corporate scandals and financial crises of the late 20th and early 21st centuries posed a valid question about the originally expected role of corporate managers and, in turn, …

What Exactly Is Market Integrity? An Analysis Of One Of The Core Objectives Of Securities Regulation, Janet Austin Feb 2017

What Exactly Is Market Integrity? An Analysis Of One Of The Core Objectives Of Securities Regulation, Janet Austin

William & Mary Business Law Review

One of the main objectives of securities regulation around the world is to protect the integrity or fairness of the markets. This, together with protecting investors, improving the efficiency of markets, and protecting the markets from systemic risk, form the four fundamental goals of securities regulation.

However, what exactly is envisaged by this concept of market integrity or fairness? Are these simply norms of behaviour incapable of further definition? Despite their importance, relatively little attention has been given to these concepts in the literature. Do they, for example, require securities regulators to just work towards eliminating dishonest trading practices such …

After The Crash: Examining Pedagogical Approaches To Teaching Business Ethics, Colette Murphy, Dr. Noel Murray Jan 2017

After The Crash: Examining Pedagogical Approaches To Teaching Business Ethics, Colette Murphy, Dr. Noel Murray

Irish Business Journal

Research has shown that business students are less ethical than students in other disciplines (Segal et al., 2011), which is a worrying finding, considering that unethical business practices are seen as a major feature leading to the world economic recession in 2008. However, business schools across the globe have consistently taught the subject of ethics in order to instil an ethical mind-set in their graduates. The way business ethics is embedded in the curriculum has been the subject of much debate, with a range of pedagogical approaches taken. This paper examines the current teaching of ethics, by examining two business …

Why Now Is The Time To Statutorily Ban Insider Trading Under The Equality Of Access Theory, Bruce W. Klaw Mar 2016

Why Now Is The Time To Statutorily Ban Insider Trading Under The Equality Of Access Theory, Bruce W. Klaw

William & Mary Business Law Review

This Article makes the case for a new U.S. statutory provision that defines and prohibits insider trading under an “equality of access” theory. It supports this claim, and contributes to the important public dialogue concerning this prevalent practice, by highlighting the moral and legal gaps in existing U.S. law that result from understanding the harms of trading on the basis of material nonpublic information solely with reference to fiduciary breach or misappropriation, as evidenced by the recent cases of United States v. Newman and United States v. Salman. It weaves legal analysis together with current literature in business ethics, moral …

Socially Responsible And Small: A Quantitative Study Of Corporate Social Responsibility In Small And Medium Organizations In The United States, Abigail Sorenson Berk

Dissertations

Corporate social responsibility (CSR) has become a global imperative supported by governments, industry, and citizens alike. In 2000, the United Nations launched the Global Compact to encourage businesses to adopt socially responsible policies. In tandem, businesses became increasingly attentive to their social practices with the vast majority of executives declaring CSR important to their organization’s success. Despite this increase in attention – which occurred among businesses of all sizes – the academic literature on CSR has focused almost exclusively on large, public companies. Ironically, the majority of businesses in the United States are small, private businesses suggesting the existing CSR …

Research related to moral reasoning and development has been increasing over the past decade as a result of the business-related scandals of the early 2000’s. Additionally, the rise in online learning has brought a new dynamic to the cognitive moral development of future business leaders. The problem addressed in this study is how an online program impacts the moral reasoning development of undergraduate business students. This study issued the DIT survey to senior-level undergraduate students declared as business majors from a face-to-face and online format …

Expanding The Motivations For Altruism: A Philosophical Perspective, Julian Friedland Sep 2013

Expanding The Motivations For Altruism: A Philosophical Perspective, Julian Friedland

Julian Friedland

We argue that attempts to extrapolate moral motives for non-egoistic behavior in organizational behavior often interpret results empathically or deontically, while leaving other moral motivational frames, such as the utilitarian and virtue ethical, under-examined. We encourage the creation of experimental measures to distinguish various philosophical frames.

The Sarbanes Oxley Act's Contribution To Curtailing Corporate Bribery, Karen Cascini, Alan Delfavero, Mario Mililli

WCBT Faculty Publications

In the wake of corporate scandals occurring in the early 2000s, a need for stricter regulation was deemed necessary by the investors of U.S. public companies. In 2002, the Sarbanes-Oxley Act (SoX) was created. Accordingly, under the rules of SoX, U.S. corporations were faced with increased oversight and also needed to substantially improve their internal controls. As companies began to scrutinize their internal affairs more closely, some businesses detected other forms of criminal activity occurring internally, such as bribery. Those companies and individuals found to have committed bribery have violated the Foreign Corrupt Practices Act of 1977 (FCPA). Throughout this …

Christian leaders seek to be ethical people and make ethical decisions, but often the ethical dilemmas a leader must face do not have clear-cut answers. Ethical dilemmas can be even more troubling when they occur in a culturally diverse situation that is coupled with decisions involving financial transactions. Views of money and how to handle money are culturally influenced and may not be the same as the views of the leader, who may come from a different culture. This leads the Christian leader to ponder: When working in a culturally diverse environment, how can one tell the difference between a …

Julian Friedland

This case study highlights some of the latest research on setting executive compensation at ethical levels. The board of directors of Spade’s, a mid-size U.S. hardware chain, considers altering the pay package of its incoming CEO to best align his interests with those of shareholders and stakeholders. Students are invited to assess various components of the incoming CEO’s cutting-edge proposal, which seem attractive and convincing on the surface, but might present certain risks over the longer term. Five compensation components are analyzed, namely, salary capping, pay for performance, bonus scales, stock option parameters, and severance package.

Recently, numerous corporations have been in the news for potentially backdating stock options. Accordingly, the purpose of this paper is to distinguish between legal and illegal aspects of backdating stock options, and to examine the …
