Alabama Governor George Wallace ran for the presidency four times between 1964 and 1976, bringing his candidacy north of the Mason-Dixon Line to Wisconsin. Wallace’s campaign in the Badger State fostered a debate among residents regarding constitutional principles and values. Wallace weaponized federalism and states’ rights, arguing that the federal government should stay out of school segregation, promote law and order, restrict forced busing, and reduce burdensome taxation. White working-class Wisconsinites armed themselves with Wallace’s rhetoric, pushing back on social and political changes that threatened the status quo. This paper theorizes that authors, in an act I have termed “literary exorcism,” project and expunge parts of their identities that are in conflict with the overriding political agenda of their texts, into the figure of the villain. Drawing upon theories of power put forth by Judith Butler, I argue that this sort of projection arises in reaction to dominant ideas and institutions, but that authors find ways to manipulate this process over time. By examining a broad cross-section of English-language literature over several centuries, this phenomenon and its evolution can be observed, as well as the means by which …

This study explores a series of events that occurred in the spring of 1876. The relationship between the Indianapolis city government, the Marion County Courts, the Indianapolis Police Department, and the African American community came together to usher in changes never before envisioned. The Indianapolis Police Department (IPD) was formed in 1855, then disbanded 12 months later in a political dispute. From 1857-to-1876, the IPD was all white. These changes took place as the Reconstruction era was coming to a close. The first Ku Klux Klan was at its apex, terrorizing black communities, and Jim Crow was coming into its …

This paper seeks to contextualize the 1956 election by providing a summary of the African American political alignment during the preceding half-century. Winning a greater portion of the black vote was a central tenant of the 1956 Eisenhower Campaign strategy. In the 1956 election a substantial shift occurred among the historically democratic black electorate. The vote shifted because of disillusionment with the Democrats and Eisenhower’s civil rights record. The swing however, was less pronounced for Republican congressional candidates. Despite the vast scholarship that exists discussing why Democrats sought restrictive suffrage laws, little attention has been given by historians to examine how concern over local government drove disfranchisement measures. This study examines how the authors of disfranchisement laws were influenced by what was happening in Crittenden County where African Americans, because of their numerical majority, wielded enough political power to determine election outcomes. In the years following the Civil War, African Americans established strong communities, educated themselves, secured independent institutions, and most importantly became active in politics. The dominance of Booker T. Washington and the loyalty of most African Americans to the Republican Party are often mistaken as markers of black political unanimity at the turn of the twentieth century. Even worse, they are assumed to stand for the whole of African American political life. Benjamin R. Justesen’s story of the struggles to establish and sustain the National Afro-American Council should serve as an important reminder of the tensions, diversity, and energy within black politics in this period. The conflict between liberal legal theory and critical legal studies (CLS) is often framed as a matter of whether there is a theory of justice that the law should embody which all rational people could or must accept.
