"With All The Majesty Of The Law": Systemic Racism, Punitive Sentiment, And Equal Protection, Darren L. Hutchinson

United States criminal justice policies have played a central role in the subjugation of persons of color. Under slavery, criminal law explicitly provided a means to ensure White dominion over Blacks and require Black submission to White authority. During Reconstruction, anticrime policies served to maintain White supremacy and re-enslave Blacks, both through explicit discrimination and facially neutral policies. Similar practices maintained racial hierarchy with respect to White, Latinx, and Asian-American populations in the western United States. While most state action no longer explicitly discriminates on the basis of race, anticrime policy remains a powerful instrument of racial subordination. Indeed, social …

This cross-sectional survey study examined the underlying psychosocial constructs of Black (n = 163) and White (n = 246) university students' willingness to endorse racially motivated collective action. Consistent with the defensive motivation system model, we expected the police shooting of an unarmed Black American to activate concerns about personal safety, thereby eliciting negative affect, lack of forgiveness of the perpetrator, and motivation to engage in collective action. This path model was expected for both Black and White participants, with stronger associations among Black participants. The voices of the families that have successfully raised transracially adopted children with a positive cultural identity are missing from the literature: “Further research is needed on adoption from the perspective of the adoptee” (Clark et al., 2006, p. 192). There are methodological shortcomings that inhibit our ability to definitively determine adjustment outcomes for this population. Such shortcomings, combined with a failure to address additional variables that influence outcomes, have left identified gaps in the research unaddressed. We call for psychologists to expand their thinking on fair and just public safety by engaging with the “Abolition Democracy” framework that Du Bois (1935) articulated as the need to dissolve slavery while simultaneously taking affirmative steps to rid its toxic consequences from the body politic. Because the legacies of slavery continue to produce disparities in public safety in the U.S, both harming Black people and the institutions that could keep them safe, psychologists must take seriously questions of history and structure in addition to immediate situations. This qualitative study of 6 Black single mothers utilizes a focus group format to explore their experiences in mental health treatment. The specific barriers they face to seeking treatment are reviewed, given that this particular population is substantially underrepresented in mental health therapy. The study seeks to gain a better insight of what factors contribute to attracting and retaining them in therapy for positive outcomes. Six emergent themes surfaced highlighting the fact that these women overcome numerous historical and cultural barriers to present for treatment to address serious issues of stress, grief, and loss, that they have a desire to …
