The United States is, indeed, a land of vast opportunity. A diverse group of individuals continually benefit from the prospects provided by this inherently free nation. Although some constraints in America have prevented people from realizing their ultimate potentials, this nation offers immense possibilities overall to progress socially, economically, and culturally. America allows for people of all socioeconomic, religious, racial, and ethnic backgrounds to take full advantage of the various opportunities offered by this mainly egalitarian land. Restorative Processes & Doing Justice, Paul H. Robinson

This essay argues that, while many restorative processes are quite valuable, there is the potential for their use to produce results that conflict with the community's shared intuitions of justice and to thereby undermine the criminal law's moral credibility. Because such moral credibility can have practical crime-control value, it ought not be undermined unless the crime-control benefits of doing so clearly outweigh the costs. In practice, it is entirely possible to rely upon restorative processes in ways that avoid injustice and that assure justice is done.

Mandatory Waiting Periods For Abortions And Female Mental Health, Jonathan Klick

Proponents of laws requiring a waiting period before a woman can receive an abortion argue that these cooling off periods protect against rash decisions on the part of women in the event of unplanned pregnancies. Opponents claim, at best, waiting periods have no effect on decision-making and, at worst, they subject women to additional mental anguish and stress. In this article, I examine these competing claims using adult female suicide rates at the state level as a proxy for mental health. Panel data analyses suggest that the adoption of mandatory waiting periods reduce suicide rates by about 10 percent, and …

Due to various social, international and economic encumbrances, Australian film has made a limited foray into the representation of domestic abuse. A limited number of films have been made on this topic since the early 1970's, and even then, the depiction of this social issue has been watered down and sanitised for mainstream consumption. It is the author's belief that the filmmaker has an important and highly influential opportunity to present a social commentary on issues and must not shirk that responsibility. The United Nations Development Programme and the Government of the Maldives commissioned the drafting of a penal code based upon existing Maldivian law, which meant primarily a codification of Shari'a. This is the Final Report of that codification project. A description of the process that produced this Report and the drafting principles behind it, as well as a discussion of the special challenges of codifying Islamic criminal law, are contained in an article at http://ssrn.com/abstract=941443.

Metaphor, Objects, And Commodities, George H. Taylor, Michael J. Madison

This Article is a contribution to a Symposium that focuses on the ideas of Margaret Jane Radin as a point of departure, and particularly on her analyses of propertization and commodification. While Radin focuses on the harms associated with commodification of the person, relying on Hegel's idea of alienation, we argue that objectification, and in particular objectification of various features of the digital environment, may have important system benefits. We present an extended critique of Radin's analysis, basing the critique in part on Gadamer's argument that meaning and application are interrelated and that meaning changes with application. This book survives superficial but fails deeper scrutiny. A facile, undiscerning criticism of Lectures in the History of Political Thought (LHPT) is that on Oakeshott’s own account these are lectures on a non-subject: ‘I cannot detect anything which could properly correspond to the expression “the history of political thought”’ (p. 32). This is an entirely typical Oakeshottian swipe – elegant and oblique – at the title of the lecture course he inherited from Harold Laski. If title and quotation sit awkwardly we should remember that Oakeshott never prepared the text for publication – a fortiori he did not prepare it …

Responsible government began in New South Wales after two decades of radical democratic agitation. Radical intellectuals from England, Ireland, Scotland and Europe mobilized the working men and women of the colony to resist the aristocratic form of government proposed by pastoralists and city capitalists. There was violence on the streets and goldfields, and some notable electoral victories. As 'a great fear' gripped the local elites the British government forced them to accept a more liberal form of representative government in the belief that this would placate the democrats and keep the colony safe for British imperial needs.

The thrust of this analysis is to disclose the extent to which the internet has affected politics and political conflict in particular (cyberconflict) and provide a theoretical framework for explaining this phenomenon. During the Seventh Conference of the Parties (COP-7), held in Malaysia in 2004, Indigenous Peoples made a significant impact on the negotiations between states in a number of key issue areas. Many readings have been proposed of the Politeia. We propose here a brief reflection of the intertextual type, not upon the theme or main themes of this work, but more precisely in search of aspects that also seem to have acquired a posterity (or at any rate a universality that allows for the detection of coincidences).
