Natural disasters carry enormous costs every year, both in terms of lives and materials. Evacuation from potentially affected areas stands out among the most critical factors that can reduce mortality and vulnerability to crisis. We know surprisingly little about the factors that drive this important and often life-saving behavior, though recent work has suggested that social capital may play a critical and previously underestimated role in disaster preparedness. Moving beyond retrospective self-reporting and vehicle count estimates, we use social media data to examine connections between levels of social capital and evacuation behavior. In this study, we carry out a review of three different perspectives on resilience - engineering, social, and organizational - in order to explore resilience management in the context of governance of infrastructure systems. We discuss the common practices to address resilience of engineering systems, the need and current trend for integration of institutions into these practices through formal as well as informal mechanisms. To illustrate our theorizing, we provide three illustrative case studies.

The March 2011 meltdowns at the Fukushima nuclear power plants in Japan resulted in an increased risk of psychological distress among affected residents. We conducted original surveys of Futaba residents, a town in Fukushima where all of the residents were forced to evacuate from their homes due to radioactive contamination,
obtaining 585 responses (a response rate of about 20%). Using this original data set, we investigate the role of social capital in maintaining mental health among the residents. The 3.11 compounded disaster in Tohoku, Japan served as catalyst for some nations, including Germany, Belgium, and Italy, to alter nuclear policies but had no impact on the approaches of a number of others such as Vietnam, China, and Russia. Our article investigates why, despite facing the same focusing event, private- and state-owned utilities in some countries altered their nuclear energy policies while others kept the status quo. We use a mixed-methods approach to understand this variation in energy policy outcomes. There are at least superficial reasons for thinking that Zhu Xi’s epistemology is significantly influenced by Chinese Buddhism. For one thing, in his youth Zhu studied with Kaishan Daoqian 開善道謙 (d. 1150?), a leading disciple of the most influential Chan teacher of the era, Dahui Zonggao大慧宗杲 (1089-1163). For another, his discussions of epistemology lean heavily on terms like “genuine knowing 真知” that also figure significantly in Buddhist discussions. As is well known, subsequent critics of the Daoxue movement with which Zhu was centrally associated regularly accused it of being strongly colored by Buddhism. Finally, modern scholars have also …

This chapter undertakes a critical analysis of Jacques Derrida’s reading of Fear and Trembling (Frygt og Bæven) in The Gift of Death (Donner la mort). In a gesture that might be called a faithful betrayal, Derrida seeks in this text to “go further” than de Silentio, pushing Abraham’s singular near-sacrifice of Isaac into “the most common” experience of decision, his absolute relation to the Absolute into every relation to any other. The United States is obligated under the Trade-Related Aspects of Intellectual Property Rights (TRIPS) treaty to make patent rights available and enjoyable without discrimination as to the “field of technology” of the invention.  No specific areas of technology may be singled out for unjustified special treatment.  Yet the United States is doing just that with respect to computer-implemented business methods.  Doctrinally, such methods are subject to an especially high bar for patentability.  Statutorily, patents on such methods may be challenged in invalidity proceedings that are exclusively available for so-called “covered business method patents.” The law seems to reflect a skepticism …

Bad actors in patent litigation can face serious consequences.  Infringers who are found to “willfully” infringe may be subject to trebled damages. Patentees who assert weak claims in bad faith can be ordered to pay the defendant’s attorneys’ fees.  These remedies are of such importance to the patent system today that the Supreme Court reinvigorated both of the respective doctrines in back-to-back landmark decisions in 2014 (Octane Fitness) and 2016 (Halo Electronics). 
Those decisions have helped district courts more effectively punish and deter misconduct. But the Supreme Court neglected to address a critical part of these …
