Journal of the National Association of Administrative Law Judiciary
This article proposes a simple theme. While many issues plague the Social Security Disability Insurance and Supplemental Security Income programs, only reform of the hearings and appeals process can solve the decades-long (and growing) hearings backlog. Only then, can the remaining questions regarding the solvency of the DI trust fund be meaningfully addressed. As it now stands, the ongoing backlog of pending hearings and appeals feeds the twin plagues of rising costs and increasing delay. These are the very issues that drove the federal courts in the passage of the Civil Justice Reform Act of 1990 (CJRA). This article provides …
Domestic Violence Victims A Nuisance To Cities, Filomena Gehart
Domestic Violence Victims A Nuisance To Cities, Filomena Gehart
Pepperdine Law Review
Unless municipal nuisance ordinances change, domestic violence victims can face eviction just for calling the police. Nuisance ordinances generally impose fines on a property owner or landlord when the police are called to respond to incidents of crime a certain number of times at the same residence. Many nuisance ordinances also revoke a landlord’s rental license if a property is deemed a nuisance. However, many of these nuisance ordinances do not have an exception for incidents of domestic violence and, consequently, victims are scared to call 911 or request police assistance. This comment surveys the development of nuisance laws and …
Turkish Smes’ Use Of Financial Statements For Decision Making, Howard E. Vanauken, Semra Ascigil, Shawn Carraher
Turkish Smes’ Use Of Financial Statements For Decision Making, Howard E. Vanauken, Semra Ascigil, Shawn Carraher
The Journal of Entrepreneurial Finance
With a sample of 91 small Turkish firms, this study examines the factors that affect the use of financial statements, and the important information they contain, to make decisions. A principal components analysis identifies three key variables that determine the use of financial statements: experience, confidence, and knowledge. Logit analysis reveals that these three variables are significantly associated with whether Turkish business owners use financial statements to make decisions. These results can help business owners and service providers for these businesses understand what affects their use of financial statements and the process by which financial statements get incorporated into decisions.

Faux Feminism: Beyoncé Knowles-Carter And The Objectification Of The Modern Woman, Kristi D. Vazquez
Faux Feminism: Beyoncé Knowles-Carter And The Objectification Of The Modern Woman, Kristi D. Vazquez
Seaver College Research And Scholarly Achievement Symposium
This paper examines the feminist ideologies of Beyoncé Knowles-Carter evidenced in her album, Beyoncé, and their negative impact upon women’s achievement of gender equality. Widely acknowledged as a symbol of the modern, independent woman, Beyoncé flaunts her sexuality thereby encouraging women to engage in sexually aggressive behavior as a means of asserting equality within a patriarchal society. Through unapologetic and overt sexuality expressed in the album, she appears to be advocating “fierce feminism,” a new form of sexual equality achieved through the proud assertion of sexuality, coupled with traditional feminist ideologies of autonomy and independence. However, “fierce feminist” anthems within …
Life, Liberty, And The Lack Of Paid Parental Leave: An Analysis Of Media Framing Of Parental Leave In The United States, Marissa A. Baly
Life, Liberty, And The Lack Of Paid Parental Leave: An Analysis Of Media Framing Of Parental Leave In The United States, Marissa A. Baly
Seaver College Research And Scholarly Achievement Symposium
Because the United States is the only developed country without mandatory paid maternity leave, I felt called to study unpaid maternity leave in the U.S. for my research in the Political Science Honors Program. The study, “Life, Liberty, and the Lack of Paid Parental Leave,” is an analysis of media framing of parental leave in the United States. In the study, I conducted a content analysis of over 200 news articles of the New York Times, and also created an Institutional Review Board-approved survey distributed to introductory political science classes. In the content analysis, I found that maternity leave is …

Positive Attitudes As A Mediator Between Moral Disengagement And Cyberbullying Behaviors, Kailee Kodama, Jennifer Harriger, Elizabeth Mancuso Dr., Cindy Miller-Perrin
Seaver College Research And Scholarly Achievement Symposium
Objective. The current study examined whether (1) higher moral disengagement scores would be positively correlated with higher frequencies of engaging in cyberbullying, (2) positive attitude scores would be positively correlated with higher frequencies of engaging in cyberbullying, and (3) positive attitudes towards cyberbullying would mediate links between moral disengagement and frequency of engaging in cyberbullying.
Method. Three surveys, the Mechanisms of Moral Disengagement Scale (MMD), Cyberbullying Perpetration Measure (CPM), and Positive Attitudes towards Cyberbullying Questionnaire (PATC) were administered to 114 undergraduate students.
Results. Correlational analysis indicated significant positive correlations between PATC and CPM scores (r = .442, p < .01), CPM and MMD scores (r …

The Reliability Of Crowdsourcing: Latent Trait Modeling With Mechanical Turk, Matt Baucum, Steven Rouse Dr., Cindy Miller-Perrin, Elizabeth Mancuso Dr.
Seaver College Research And Scholarly Achievement Symposium
Mechanical Turk, an online crowdsourcing platform, has recently received increased attention in the social sciences as studies continue to suggest its viability as a source for reliable experimental data. Given the ease with which large samples can be quickly and inexpensively gathered, it is worth examining whether Mechanical Turk can provide accurate experimental data for methodologies requiring such large samples. One such methodology is Item Response Theory, a psychometric paradigm that defines test items by a mathematical relationship between a respondent’s ability and the probability of item endorsement. To test whether Mechanical Turk can serve as a reliable source of …

The purpose of this paper is to determine the relationship between the number of waves a surfer will catch, the surfer’s characteristics, and the surf conditions; and utilize this relationship to explain wave allocation strategies chosen by surfers. Design/methodology/approach – The study employed a discrete event simulation to model surfers at a well-known surf break in Southern California. Several experimental designs were implemented in the simulation to measure the effect of a surfer’s characteristics and surf conditions on waves caught; and compare different wave allocation strategies. Findings – The number of waves that a surfer will catch is largely dependent …

Economic Growth And The Optimal Level Of Entrepreneurship, James E. Prieger, Catherine Bampoky, Luisa R. Blanco, Aolong Liu

Using data from the Global Entrepreneurship Monitor (GEM), we examine data from developed and developing countries to estimate the ‘‘growth penalty” over 2003–11 when a country’s entrepreneurship deviates from its optimal level. We account for heterogeneity among countries in the optimal entrepreneurship rate, in the growth penalty from deviating from that optimum, and in other factors affecting growth. Notwithstanding that developing countries have more of their population running nascent small firms than in developed countries, a marginal increase in the entrepreneurship rate in developing countries has a positive effect on growth. On the contrary, in developed countries, there is no …

Life, Liberty, And The Lack Of Paid Parental Leave: Media Framing Of Parental Leave In The United States, Marissa A. Baly
Featured Research
In this study, I examine how the media frame parental leave in the United States. To do so, I conducted a content analysis of over 200 news articles from the New York Times, and also created a survey distributed to introductory political science classes. In the content analysis, I find that parental leave is both an episodic and thematic news issue, has less negative coverage than most news issues, and evolved from a merely mentioned issue to an economic issue over time. This research also shows that female and male authors do not frame parental leave differently; in fact, women …
The Development And Validation Of The Comprehensive Intellectual Humility Scale, Elizabeth J. Krumrei-Mancuso, Steven V. Rouse
The Development And Validation Of The Comprehensive Intellectual Humility Scale, Elizabeth J. Krumrei-Mancuso, Steven V. Rouse
All Faculty Open Access Publications
A series of studies was conducted to create the 22-item Comprehensive Intellectual Humility Scale on the basis of theoretical descriptions of intellectual humility, expert reviews, pilot studies, and exploratory and confirmatory factor analyses. The scale measures 4 distinct but intercorrelated aspects of intellectual humility, including independence of intellect and ego, openness to revising one's viewpoint, respect for others' viewpoints, and lack of intellectual overconfidence. Internal consistency and test-retest analyses provided reliable scale and subscale scores within numerous independent samples. Validation data were obtained from multiple, independent samples, supporting appropriate levels of convergent, discriminant, and predictive validity. The analyses suggest that …
Hearsay Evidence: Legal Discourse, Circumstantiality, And The Woman In White, Matthew Finley
Hearsay Evidence: Legal Discourse, Circumstantiality, And The Woman In White, Matthew Finley
Global Tides
In Wilkie Collins’s The Woman in White, Walter Hartright begins the narrative by stating that, because “the Law is still … the pre-engaged servant of the long purse,” he has arranged the novel to reveal the truth (5). The author, then, puts the law on trial by engaging the interplay between legal questions of witness credibility and testimonial evidence and their impact on social factors such as class and gender. The law’s emphasis on externality leads the system to privilege the snakelike Fosco over the heroic Walter, Laura, and Marian, signaling the courts' capital offence. Although the novel is …
Trafficking Smuggled Migrants: An Issue Of Vulnerability, Rachel A. Hews
Trafficking Smuggled Migrants: An Issue Of Vulnerability, Rachel A. Hews
Global Tides
This paper analyzes why the UN’s efforts against the sex trafficking of smuggled migrants, specifically regarding the Palermo and Smuggling Protocols, have been inadequate in preventing migrant smuggling. It concludes that the crime-based focus on prosecution overshadows prevention of the crime and protection of the victims, and that a human rights approach addressing the vulnerability of smuggled migrants would be more effective in reducing migrant smuggling long-term. Proposed solutions include decreasing both the “push” and “pull” factors of migration by ratifying existing legislation regarding basic human rights, implementing national policies that increase migrant rights in destination countries, and shifting further …
Economic Empowerment: An Avenue To Gender Equality In Afghanistan, Heather C. Odell
Economic Empowerment: An Avenue To Gender Equality In Afghanistan, Heather C. Odell
Global Tides
This paper examines the state of women’s rights in Afghanistan, recommending economic empowerment as the most effective and culturally sensitive tool in achieving gender equality. Women’s rights in Afghanistan came to the forefront of the international community’s attention following the entry of the United States armed forces in 2001. Media outlets highlighted the Taliban’s egregious treatment of women and government agencies and international NGOs poured into the country with aims of liberating women from oppressive circumstances. While significant strides have been made since the Taliban's fall from power, in many ways, women today remain subordinate. Over a decade later, women …
Women In Higher Education In Iran: How The Islamic Revolution Contributed To An Increase In Female Enrollment, Meredith Katherine Winn
Women In Higher Education In Iran: How The Islamic Revolution Contributed To An Increase In Female Enrollment, Meredith Katherine Winn
Global Tides
In the three decades following the Islamic Revolution in Iran, rates of female enrollment in higher education increased despite a return to traditional and conservative gender roles. This paper will provide an in-depth analysis of the role the Islamic Revolution played in the changing roles of women in society, particularly as it pertains to education. It will argue a complex interplay of religious, cultural, and political factors emerged as a result of the Islamic Revolution that facilitated an environment where more young women could attend university. Finally, this paper will conclude that the rise in women’s participation in education has …
The Pitfalls Of The Microfinance Promise, Kelleen R. Mull
The Pitfalls Of The Microfinance Promise, Kelleen R. Mull
Global Tides
The validity of microfinance institutions as poverty alleviation instruments is drawn into question by the structure and practices of the industry, which hinder the efficiency and depth of aid. This paper aims to outline the history and popularity of microfinance, followed by the difficulties of its implementation. Then, it will explain the status of research in the field, microcredit’s role in the empowerment of women, and the perception of microfinance in the West. Finally, it will discuss the monumental shifts within the industry based on ideological opinions and the consequential negative effects on the field.
The Disparity In A Free Appropriate Public Education: Minority Parents And Access Through Advocacy, Melissa E. Moxley
The Disparity In A Free Appropriate Public Education: Minority Parents And Access Through Advocacy, Melissa E. Moxley
Theses and Dissertations
The United States has been providing federally mandated educational access to children with disabilities for more than 35 years. During this relatively short period of time, the quality of education for children with physical, mental, emotional, and genetic challenges has been enhanced exponentially. Through federal legislation and nationwide litigation, formal structures have been created to ensure that the nation's 7.1 million students with special needs receive a free and appropriate public education. Despite these remarkable achievements, special education is impacted by social, cultural, and economic disparities that continue to plague education in the United States. One inherent inequality in special …
Barriers To Career Advancement: Asian Americans In The U.S. Aerospace Industry, Rahul Dixit
Barriers To Career Advancement: Asian Americans In The U.S. Aerospace Industry, Rahul Dixit
Theses and Dissertations
This qualitative study explored the lack of Historically Underrepresented Population (HUP) inclusion in management and leadership roles. Specifically, why Asian Americans (AA) do not reach executive levels in southern California aerospace and defense companies (SCDCs). The AA members of HUP are among the highest educated and display model-behavior characteristics, yet, somehow do not thrive in management assignments. The U.S. defense industry has operated in a single-customer market, and that customer (the U.S. Government) is imposing social change agendas, to establish a leadership that is reflective of the company’s diversity. Exacerbating the underrepresentation of AAs is a shrinking domestic defense appropriations …

Norway Leads The World In Gender Equality And Work-Life Balance: A Qualitative Life Course Study Of Norwegian Women, Lene Karine Martin
Theses and Dissertations
Norway is one of the world's leading countries in gender equality and work-life balance and therefore proves to be an exceptional model for study to improve gender equality and work–life balance around the world (Strømland, 2009). Norway continues to rank top three in the Global Gender Gap Index in addition to being the happiest country, best country to live, leading country in gender equality and work-life balance, best country for motherhood, and one of the top three countries for business (Badenhausen, 2015; Berglund, 2010; Bradford, 2011; Dresser, 2010; Helman, 2011; McNeil, 2010; “Norway tops ‘best country’ list, U.S. ranks 10th,” …
The Major Supporting Mechanisms For Successful Single Working Mothers, Toia Thompson Mengesha
The Major Supporting Mechanisms For Successful Single Working Mothers, Toia Thompson Mengesha
Theses and Dissertations
Single mothers are commonly characterized as low-income welfare recipients. In 2010, close to 30% of single mother households were below the poverty line (U.S. Census Bureau, 2010a) conversely leaving 70% of single mothers above the poverty line. Being a married working mother is challenging and comes with the need of several supports. With the growing divorce rate and the introduction of women choosing to become single mothers, the numbers of single working mothers are growing rapidly. In order to be a successful single mother certain factors need to be accounted for. This study focused on single mothers who are in …
