Over the years there have been large increases in the number of drug offenders arrested, prosecuted, and sentenced to prison. These increases have lead to an overload of the criminal justice system. This overload prompted states to develop new responses to substance use and drug-related crime. One such innovation is the drug treatment court, which combines accountability and treatment. The goal of these courts is to reduce recidivism and substance use among drug-involved criminal offenders. This study uses data from Douglas County (Nebraska) to compare recidivism rates for participants in the Douglas County Drug Court and traditionally adjudicated drug offenders. …

Despite the abundance of drug prevention programs in this country, drug usage among America’s youth continues to grow. This project will examine one emerging school-based prevention program designed to develop resistance skills that have been proven to help students oppose those risky behaviors. Prior to this examination the extent of drug use by American school children is discussed, followed by an extensive literature review evaluation. The main body of the thesis is a description of the All Stars Jr. Program, with an assessment and evaluation of the program’s implementation. Capital punishment is not practiced by a majority of the world's states. Anti-capital punishment domestic policies have led to an international law of human rights that emphatically prohibits cruel and inhuman punishment. International concern for the abolition of capital punishment has prompted Islamic states that still endorse and practice the death penalty to respond with equally compelling concerns based on the tenets of Islamic law. Professor William A. Schabas suggests that Islamic states view capital punishment according to the principles embodied in the Koran. Abused women often leave their partners. In fact, many women often leave seven or eight times before they leave for good, decide to stay, or are killed in the process of leaving. There is a rich literature on abused women providing information regarding abuse awareness, identification, assessment, intervention, and cultural issues; relatively few studies, however, have explored women's experience of leaving the abusive relationship and staying out. The purpose of this study was to describe the experience of formerly abused women staying out of the abusive relationship. Property crime is the most frequent kind of criminal victimization and one with important economic and psychological consequences, although it has not received the same public attention as violent crime in recent years. Property crime victimization rates are much higher for juveniles than for adults, but very little attention has been paid to property crimes against juveniles or the particular features that characterize these crimes. This Bulletin tries to fill this gap by examining the characteristics of property crimes against juveniles. It uses crime information from the National Crime Victimization Survey (NCVS) for 1996–97 and the National Incident-Based Reporting System …

This Article covers death penalty decisions from the Georgia Supreme Court for the period from January 1, 1999 to May 31, 2000. It primarily discusses direct appeal decisions but reaches cases in a few other settings as well. This Article does not discuss holdings in capital cases that are common to all criminal appeals but is limited to death penalty law. Recent developments in Georgia death penalty law are considered in the order they would appear in a capital trial. In the period covered by this Article, the Georgia Supreme Court considered thirteen death sentences imposed in superior courts following …

Transformation is the key word to explain the Korean attitudes towards law. In the early 1950's, nation building gave impetus to economic growth and allowed Korea to quickly pass through the preliminary stages of development. Industrialization, urbanization and eventual emigration of the populace have, in many senses, displaced the traditional social value system based on Confucianism. However, a new value system has yet to take hold. The lack of such guidelines has left Koreans in a state of confusion in a world that continues to change. The Korean Constitution clearly mandates equal protection under the laws for all Koreans. However, …

The Role Of Organized Religions In Changing Death Penalty Debates, Michael L. Radelet

In his Article, Professor Michael L. Radelet describes a global decline in the use of the death penalty, the United Nation's progressively stronger stance against executions, and a growing opposition to capital punishment in the United States. This decrease is attributed to both empirical studies casting doubt on the death penalty's efficacy in promoting its stated underlying goals, and to the increasingly vocal stance of religious leaders morally opposed to capital punishment. Nevertheless, the decline in other justifications for capital punishment has been met with increasing reliance on retribution as the primary argument in its support. Professor Radelet argues that …

With the increased fervor surrounding the death penalty, many religious sects have re-examined their position on this issue. New statistics concerning possible discrimination in the application of the death penalty prompted several religious groups to call for a moratorium on the death penalty. In this Essay, Professor Thomas C. Berg examines how religious conservatives, especially Roman Catholics and evangelical Protestants, have dealt with the recent concerns over the death penalty. In her paper, Professor Kimberly J. Cook uses statistics to illustrate the role the Christian Right plays in the public discourse over two issues permeated with religious overtones: abortion and the death penalty. She shows how the Christian Right's approach to these issues is based on an ideological notion of 'Justice " that is primarily focused on vengeance and punishment, to the exclusion of forgiveness. Professor Cook's exploration of the modern roots of this ideology leads to a movement dating from the 1960s known as Christian Reconstructionism, which advocates using state action to enforce its unique interpretation of "God's Will." …

Determining the place and use of capital punishment in the American legal system is a challenging affair and one that is closely associated with and determined by religion's role in American legal decision-making. Both capital punishment and religion are controversial issues, and tend to challenge legal scholars and practitioners about whether they should function together or alone as valid parts of the legal system in the United States. Professor Levine argues that religious arguments should be employed to interpret and explain American legal thought when the need or proper situation arises. Distributive justice refers to the perceptions of fairness of outcomes received by individuals for their efforts in organizational settings. Punishment is frequently used to eliminate offensive or undesirable behavior in organizations. The present study was based on distributive justice theory and assessed the effects of severity of punishment and the application of distributive justice rules in a sports team setting. Eight scenarios were developed combining two levels of distribution of punishment (consistent or conditional), two levels of severity of misconduct (severe or moderate), and two levels of severity of punishment (severe or moderate).
