When (And Where) Is A Crime A Crime? “Double Criminality” As A Principle Of Fundamental Justice, Robert J. Currie
When (And Where) Is A Crime A Crime? “Double Criminality” As A Principle Of Fundamental Justice, Robert J. Currie
Articles, Book Chapters, & Popular Press
The idea that crime crosses borders is fast becoming ordinary, even old hat, particularly in an age of online crime such as ransomware attacks, cyber-extortion and the like. As we have become more geographically mobile, however, it is increasingly common for people to have engaged in criminal conduct in one state1 but then seek to exercise legal rights, or face legal entanglements, in others. Legal questions can then arise about what effect should be given by one state—in this article, Canada—to an individual’s conduct that was, or is alleged to have been, a crime in a foreign state. The inquiry …

Women Police Chiefs: A Self-Perception Of Women Officers In Law Enforcement, Tianshi Hao, Jesse Llamas, Kayleigh Axtell, Anshu Lal, Michael Llamas, Mira Fadel, Amor Roma
The Scholarship Without Borders Journal
A large body of literature substantiates women’s difficulties integrating into all levels of law enforcement. To understand the experiences of women police officers in the force, and to understand how law enforcement leaders view the role of women in leadership positions, this study focused on the perception of six women police officers–specifically, women police chiefs towards women who already assumed leadership positions, overcame challenges entering law enforcement and advancing into leadership positions, and collected their input on organizational decisions, policy, and recruitment of women officers. This study employs a qualitative phenomenological methodology and interviews six women police chiefs in depth. …
Best Interests Of The Child In Juvenile Justice: Analysis Of Malaysia, Philippines, And Thailand, Mary Grace C. Agcaoili
Best Interests Of The Child In Juvenile Justice: Analysis Of Malaysia, Philippines, And Thailand, Mary Grace C. Agcaoili
Asia-Pacific Social Science Review
The “best interests of the child” (BIC) is the most referenced child rights principle in international law, whereas juvenile justice is the most mentioned topic. This paper examines how countries in Southeast Asia (SEA) interpret BIC in juvenile justice and if their understanding is consistent with the Convention on the Rights of the Child (CRC) and other international standards and why. It contends that BIC’s indeterminate use led to misinterpretation of child rights and that BIC interpretation is influenced by several factors found within the socio-cultural and political economy of SEA. Using Malaysia, the Philippines, and Thailand as case studies …

Reconciled To Leisure: The Relationship Between Christianity, Leisure And Restorative Justice, Hannah Janzen, Paul Heintzman
Movement and Being: The Journal of the Christian Society for Kinesiology, Leisure and Sports Studies
This paper seeks to explain the mutually reinforcing relationship between leisure and reconciliation from a Christian perspective. The paper begins by briefly defining the holistic approach to leisure from a Christian perspective, which will be the definition of leisure that is used throughout the paper. Christian teachings on reconciliation will then be outlined, both between the individual and God and between individuals. Restorative justice, the specific example of reconciliation that will be used in this paper, is defined as a process of justice that seeks to repair the harm that was caused through a crime. The paper then describes how leisure …
The Role Of International Investigation Committees In Accounting For International Crimes, Khaled Abdulsalam
The Role Of International Investigation Committees In Accounting For International Crimes, Khaled Abdulsalam
Al Jinan الجنان
International criminal justice as a legal concept cannot be reached unless international criminal responsibility for gross violations of human rights is recognized .In light of the obstacles that prevent the application of the substantive jurisdiction of the international criminal judiciary, whether represented by the International Criminal Court or the Special International Criminal Courts ,it becomes necessary to search for legal mechanisms through which international crimes can be revealed and the identification of those responsible for them to be held accountable. From this point of view ,
we discussed the legal framework under which international commissions of inquiry work to investigate …

Under Their Wing: A Case Study Of Caring Adults Who Support Homeless Youth, Christina L. Helfrick
International Journal of School Social Work
Despite many risk factors, few interventions exist to support youth who are homeless. Theories of resilience and social capital offer support for the development of a school-appointed, homeless, student advocate program. However, these theories do not offer a process or description of activities or qualities of an advocate. This case study is used as an initial step in intervention development. A one-time, focus-group was utilized as a purposeful sample of individuals experienced with supporting homeless youth will be used to create a framework for practice. This study asked the following questions: What is a programmatic framework for a school-appointed homeless …

Towards Just Futures: A Feminist Approach To Speculative Design For Policy Making, Sofie-Amalie Torp Dideriksen, Himanshu Verma, Nazli Cila, Dave Murray-Rust
DRS Biennial Conference Series
There is a call for more use of future-oriented design methods like speculative de-sign in developing policies. While these methods offer potential benefits in helping future-proof policies, they also run the risk of solidifying existing structures of pow-er if not applied critically. In this paper, we describe a case study examining smart doorbells in Amsterdam, where we created a speculative design exhibition grounded in feminist theory in order to challenge the existing power structures in the public domain. We then discuss the insights from our design process and the reaction the exhibition received in light of how feminist theory can …
Through The Megascope: Reimagining Design Education, Nekita Thomas, Lisa Mercer, Teressa Moses, Angelica Sibrian
Through The Megascope: Reimagining Design Education, Nekita Thomas, Lisa Mercer, Teressa Moses, Angelica Sibrian
DRS Biennial Conference Series
Addressing global challenges like racial tension and health inequalities, this paper urges a reimagining of design education's core principles. Four educators from diverse, often marginalized backgrounds collaboratively investigate design education's future, moving beyond mere reflection. Their insights fuel a broader initiative to envision inclusive design education. Drawing inspiration from W.E.B. Du Bois’ 'Megascope', this concept resists conventional paradigms, sheds light on overlooked narratives, and challenges ingrained epistemologies. The Megascope acts as a dynamic discourse tool, pushing the boundaries of design education. The educators, influenced by the Megascope's principles and their backgrounds, emphasize their dedication to anti-racist, equity-driven education, underscoring the …

Design X Non-Profits: Towards An Understanding Of Design Integration In The Australian Non-Profit Sector, Natalia Gulbransen-Diaz, Leigh-Anne Hepburn
DRS Biennial Conference Series
Design has long demonstrated an interest in shaping society and the world for good. In Australia, there are 59,747 non-profit organisations that seek to do the same. Surprisingly, there is little research situated at the intersection of these fields. This research explores the potential remit of design in non-profit organisations and provides insight into where and how design practices may be beneficial to non-profit partners. This paper first thematically analyses the responses of 140 Australian non-profit organisations as they reflect on their strategic position and core activities. Drawing on these insights, we outline five thematic notions of value as it …
Materials Designers And The Translational Approach: A Case From A Product Design Company, Sofia Soledad Duarte Poblete, Laura Anselmi, Valentina Rognoli
Materials Designers And The Translational Approach: A Case From A Product Design Company, Sofia Soledad Duarte Poblete, Laura Anselmi, Valentina Rognoli
DRS Biennial Conference Series
Design professionals are inherently translators due to the multi-faceted nature of the design process that often encompasses considerations of technologies, manufacturing, materials, etc. In investigating the emerging practice of 'materials designers', it has been found that they must develop strong 'translational design skills' to address a material-driven design process when collaborations with diverse stakeholders exist. Especially to create new materials and products or to obtain exclusive material features and experiences. Through a real-life case study on developing a circularity-oriented material from waste, this paper articulates translational design practice in materials design, highlighting its relevance in the design process. The study …
Genocide Memorialization Through Law In Bosnia And Herzegovina: Reconciling The Irreconcilable?, Carna Pistan
Genocide Memorialization Through Law In Bosnia And Herzegovina: Reconciling The Irreconcilable?, Carna Pistan
Genocide Studies and Prevention: An International Journal
This article focuses on the law banning genocide denial and other war crimes and the glorification of convicted war criminals imposed in Bosnia and Herzegovina by the former High Representative Valentin Inzko in mid-2021 to facilitate the country’s reconciliation process. It first positions the genocide denial ban into the vast category of memory laws by examining its content and scope, as well as the reactions and consequences it has provoked up to now. The article maintains that an internationally imposed memory law cannot create reconciliation in a deeply divided society. It shows, on the contrary, that the imposed legislation has …

Journal of Queer and Trans Studies in Education
Drawing on well-established insights, our study adds nuance to the discussion regarding school pushout practices by centering race, sexual orientation and gender beyond the binary. By way of descriptive and inferential statistics using the High School Longitudinal Study (HSLS:09), our article seeks to disrupt the cisheteronormative discussion regarding exclusionary school discipline and institutionally inflicted pushout that impacts the educational trajectories and opportunities of queer and trans Black, Indigenous, students of color (QT BIPOC). Results from our chi-square analyses revealed significant differences in rates of cutting/skipping class, in-school suspension, suspension or expulsion, and dropping out across our four groups: QT BIPOC …

Mass Incarceration: Racial Disparities Within The U.S. Criminal Justice System, Crystal Nichole Pugh
Doctoral Dissertations and Projects
The United States incarceration rate has remained steady at over two million people incarcerated within their criminal justice facilities. Among the U.S. criminal justice system incarcerated populations, African Americans are disproportionately represented contributing to its overwhelming numbers and overcrowded facilities nationwide. Studies have shown racial disparities experienced within the correctional system have been credited as a direct result of decision-making at various points throughout the criminal justice process. Previous and even current research on racial disparities within the criminal justice system have attributed much of its data to disproportionate minority contacts in the juvenile population and a heavy police presence …

Bridging The Gap To Every American: How A National Regulatory Sandbox Can Prompt Radical Collaboration To Adopt Legal Artificial Intelligence Tools, Samuel Hoy Brown Vii
Georgia State University Law Review
The United States of America is at a crossroads. The foundational promises of the American dream—life, liberty, and the pursuit of happiness—have been thrust into public pessimism as the nation’s most economically vulnerable populations find themselves outsiders in their own communities, unable to access the legal tools and services required to resolve even the most rudimentary of legal disputes. In the wake of groundbreaking studies by the Institute for the Advancement of the American Legal System and the American Bar Association’s Commission on the Future of Legal Services, the need for alternative legal service providers is more prevalent than ever. …

Innovation And Technology: The Era Of Autonomous Cars And Their Outcomes In Law Enforcement, Gabrielle Banish
Doctoral Dissertations and Projects
The purpose of this research study is to explore the cybersecurity of Autonomous Vehicles (AVs), including the technological challenges, barriers, and impacts on society. This research study provides a framework for law enforcement agencies to understand the scope of security of AVs and develop relevant policies and strategies to enhance the security of these vehicles. AVs are a relatively nascent concept in the automotive industry, and thus, there is limited knowledge about cybersecurity. In the upcoming years, there will probably be a considerable increase in the number of semi-autonomous vehicles on many US and European roads. Some experts even predict …
Effect Of Incarceration On Prisoners Diagnosed With Mental Health Conditions: Trauma, Treatment, And Transitioning, Ingria S. Haywood
Effect Of Incarceration On Prisoners Diagnosed With Mental Health Conditions: Trauma, Treatment, And Transitioning, Ingria S. Haywood
Doctoral Dissertations and Projects
A mental illness is a medical disorder that affects a person’s behavior, thoughts, and emotions. It also has an impact on social and cognitive functions. Misuse of substances, biological factors, or abuse, whether as a victim or a bystander to repeated abuse, are all variables that contribute to mental illness. The prevalence of mental illness among incarcerated prisoners is alarming, and it is nondiscriminatory in that it affects both men and women. Several variables contribute to inmates’ susceptibility to mental health problems. Anxiety disorders, depression as a mood disorder, dementia, and schizophrenia are examples of these. A diagnosis of mental …

Katrina was a community college student with two children, trying to juggle work, childcare, and school. During class in the spring of 2018, her phone buzzed incessantly. She looked down to see a message from her roommate saying a process server had shown up at the house to deliver a summons and complaint, naming Katrina in a lawsuit filed in county court by a debt collection company she had never heard of. Katrina turned to the internet for help and found herself overwhelmed with advertisements that began to pop up in her social media feeds trying to get her …
