Group Justice? Legal Moves That Lump Pharma Cases Together Are Bad For Justice And Bad For The Industry, William Janssen Nov 2004

Group Justice? Legal Moves That Lump Pharma Cases Together Are Bad For Justice And Bad For The Industry, William Janssen

William M. Janssen

This article critiques the judicial penchant for combining drug and device tort cases together for adjudication, and posits that the functional challenges encountered with such efficiencies compromise the essential truth-finding process of such litigation.

Social Norms And Expectancy Violation Theories: Assessing The Effectiveness Of Health Communication Campaigns, Michelle Campo, Kenzie Cameron, Dominique Brossard Nov 2004

Social Norms And Expectancy Violation Theories: Assessing The Effectiveness Of Health Communication Campaigns, Michelle Campo, Kenzie Cameron, Dominique Brossard

Michelle L. Campo

College students' processing of alcohol, smoking, and exercise social norms messages, and related effects on judgments, attitudes toward one's own behaviors, and attitudes toward undergraduates' behaviors were examined using social norms marketing and Expectancy Violation Theory (EVT) (N=393). Receiving statistical social norms messages led to an expectancy violation of the perceived social norm (i.e., a discrepancy between the expected and actual statistic conveyed with a message). Consistent with Boster et al. (2000 ), the effect of the message discrepancy on attitudes was mediated by judgments. In accordance with social norms, when participants were provided with a statistic, the majority moved …

Relational Integration, Inhibition, And Analogical Reasoning In Older Adults, Robert Morrison Nov 2004

Relational Integration, Inhibition, And Analogical Reasoning In Older Adults, Robert Morrison

Robert Morrison

The difficulty of reasoning tasks depends on their relational complexity, which increases with the number of relations that must be considered simultaneously to make an inference, and on the number of irrelevant items that must be inhibited. The authors examined the ability of younger and older adults to integrate multiple relations and inhibit irrelevant stimuli. Young adults performed well at all but the highest level of relational complexity, whereas older adults performed poorly even at a medium level of relational complexity, especially when irrelevant information was presented. Simulations based on a neurocomputational model of analogical reasoning, Learning and Inference with …

Comments On Eusopondis And Proctoporus (Squamata: Gymnophthalmidae) From Peru, With The Description Of Three New Species And A Key To The Peruvian Species, Edgar Lehr, Gunther Kohler Nov 2004

Comments On Eusopondis And Proctoporus (Squamata: Gymnophthalmidae) From Peru, With The Description Of Three New Species And A Key To The Peruvian Species, Edgar Lehr, Gunther Kohler

Edgar Lehr

We describe two new species of Proctoporus and a new species of Euspondylus (all from central Peru, Departamento de Huanuco, 2545 to 3010 m elevation). The new species are distinguished from all species presently assigned to Proctoporus and Euspondylus by unique characteristics of pholidosis, morphometrics, and color pattern. A key to the Peruvian species of Proctoporus and Euspondylus is provided. The current allocation of species to Proctoporus and Euspondylus may not reflect the phylogenetic relationships of the species under consideration. Based on the available data there appears to be no evidence to justify the separation of these genera. However, because …

A Comparative Study Of The Effects Of Training On Emotional Intelligence, J Murray, P Jordan, N Ashkanasy

Jane Murray

The training of emotional intelligence in organisations is the subject of much discussion. Ever since the construct first began to gain attention in the early 1990’s academics and practitioners alike have shown great interest, and have debated whether the skills and abilities of emotional intelligence can be learned. As this debate continues, organisations continue to invest millions of dollars in emotional intelligence training programs that propose to increase the emotional intelligence and overall workplace performance of individuals.

The purpose of this research is to compare two differing training programs and their effects on the emotional intelligence of participants. The first …

The Piano Works Of Joaquin Rodrigo: An Evaluation Of Social Influences And Compositional Style, Dena Jones Nov 2004

The Piano Works Of Joaquin Rodrigo: An Evaluation Of Social Influences And Compositional Style, Dena Jones

Dena Kay Jones

This lecture-recital represents the investigative research on the solo piano music of Joaquín Rodrigo, a repertoire that dates from 1923 to 1987. A biographical sketch of the composer precedes a general overview of his twenty-three solo piano works. Discussion of musical trends that influenced Rodrigo provides a context for tracing his development as a composer. Analytical descriptions from Rodrigo’s early piano work, the Suite para piano of 1923, demonstrates how Rodrigo incorporated early 20th century compositional techniques into his own style. Although Rodrigo alludes to Spanish nationalistic ideas in his music prior to 1931, his predominate musical language is more …

Micro-Bathymetric Mapping Using Acoustic Range Images, Christopher Roman, Hanumant Singh Oct 2004

Micro-Bathymetric Mapping Using Acoustic Range Images, Christopher Roman, Hanumant Singh

Christopher N. Roman

This work focuses on the creation of high resolution micro-bathymetric maps using a high frequency pencil beam sonar. These maps typically cover areas of 10's to 100's of square meters. Data is collected using a sonar mounted to an underwater vehicle that can be positioned at discrete locations on the sea floor or flown in a survey pattern above the bottom. Specifically, we are focused on improving the accuracy of these terrain maps by merging sonar pings taken from multiple vantage points over the same location. This requires the adaption of data registration techniques to handle errors related to the …

Hard And Soft Projects: A Framework For Analysis, Lynn Crawford, Julien Pollack Oct 2004

Hard And Soft Projects: A Framework For Analysis, Lynn Crawford, Julien Pollack

Lynn Crawford

This paper provides clarification on the use of the terms ‘hard' and ‘soft' in the context of project and program management, by exploring what it means for a project to be hard or soft. This paper draws on the authors' practice based research into large organisational change programs in a variety of contexts, and the literature on project management, systems thinking and evaluation. A framework for exploring the hardness and softness of project process and outcomes is provided. It acts as an aid to structured discussion and informed decision making about the application of methods for managing projects and programs …

Development And Analysis Of A Software Package To Quantify In Vivo Polyethylene Wear After Total Hip Arthroplasty, Allison Kinney, Catherine Ambrose Oct 2004

Development And Analysis Of A Software Package To Quantify In Vivo Polyethylene Wear After Total Hip Arthroplasty, Allison Kinney, Catherine Ambrose

Allison Kinney

Since the first total hip arthroplasty (THA) in 1938, THA evolved and developed into one of the major concentrations of orthopaedic research. The typical hip implant device used today incorporates a femoral and an acetabular component that serve to replicate the anatomical and mechanical functions of the natural hip joint. However, several problems exist that can effect the function of the implant device. Wear in the polyethylene liner of the acetabular component of the total hip replacement device is known as one of the major factors that affects the longevity of total hip replacement devices. Both manual and computer-aided techniques …

Where Have All The Trials Gone? Settlements, Non-Trial Adjudications And Statistical Artifacts In The Changing Disposition Of Federal Civil Cases, Gillian K. Hadfield Oct 2004

Where Have All The Trials Gone? Settlements, Non-Trial Adjudications And Statistical Artifacts In The Changing Disposition Of Federal Civil Cases, Gillian K. Hadfield

Gillian K Hadfield

If trials have been “vanishing” from the federal courts in the past few decades, it matters, from a normative perspective, whether this trend reflects an increase in private settlements (as many assume) or an increase in public non-trial adjudication. In this paper I investigate the coding of “disposition” by the Administrative Office of the United States Courts as the first step in an effort to assess changes in the use of trial, non-trial adjudication (such as summary judgment and dismissal) and settlement to resolve federal civil cases. Based on audits of the 2000 data using electronic docket information available through …

Judicial Activism: Reconsider Old Taboo, Scott Dodson Oct 2004

Judicial Activism: Reconsider Old Taboo, Scott Dodson

Scott Dodson

Particularly after the decisions of Lawrence and Goodridge, conservatives have attacked the courts for “judicial activism.” It is important to look critically at these charges. Are judges truly being activist, and, moreover, is activism even something that should be discouraged? The answers are far from clear.

Careful readings of both Lawrence and Goodridge give little indication of activism. But even supposing they are activist, is judicial activism really so bad in cases like these? There are two principal objections to judicial activism: It is undemocratic and it risks governmental tyranny. The cries of judicial activism here do not fit comfortably …
