Federal Forfeiture: Law, Policy And Practice, Greg Warchol, Dennis Payne, Brian Johnson

The purpose of this research is to first describe the origins and current state of federal asset forfeiture law, then examine of how property seized under the forfeiture laws for drug law violations is proceeded against by the federal government. The methodology, which is primarily exploratory, utilizes both qualitative and quantitative data. A sample of over 6000 federal administrative and judicial drug forfeiture cases are described and analyzed to construct a profile of the federal government's use of this policy. Findings raise questions about the use of forfeiture and the government's intent. Implications and suggestions for future research are included.

Effects Of A Cognitive Restructuring Program On Inmate Institutional Behavior, Agnes L. Baro

Although research suggests that cognitive restructuring programs reduce recidivism, little is known about the effects of such programs on institutional behavior. This study compared randomly selected inmates who participated in other self-help programs and randomly selected inmates who participated in the first phase of a cognitive restructuring program with inmates who had been in the second phase for at least 6 months. The total sample size was 123. Findings suggest that participation in the first phase appears to reduce refusals to obey a direct order, whereas participation in the second phase appears to reduce assaults.

A Preliminary Investigation Of The Construct Of Psychopathic Personality (Psychopathy) In Chimpanzees (Pan Troglodytes), Scott O. Lilienfeld, Jonathan Gershon, Marshall Duke, Lori Marino, Frans B. M. De Waal

Although the construct of psychopathy has received considerable attention in humans, its relevance to other animals is largely unknown. We developed a measure of psychopathy for use in chimpanzees (Pan troglodytes), the Chimpanzee Psychopathy Measure (CPM), and asked 6 raters to complete this index on 34 chimpanzees. The CPM (a) demonstrated satisfactory interrater reliability and internal consistency; (b) exhibited marginally significant sex differences (males > females); (c) correlated positively with measures of extraversion, agreeableness, and observational ratings of agonism, sexual activity, daring behaviors, teasing, silent bluff displays, and temper tantrums, and negatively with observational ratings of generosity; and (d) demonstrated incremental …

Empowerment has been proffered as a desirable goal for many disadvantaged populations. The process of empowerment can include encouraging disadvantaged individuals to recognize the structural factors in society (e.g., discrimination, oppression, injustice) which contribute to disadvantaged status. Two studies sought to determine the impact that recognition of oppression has on a disadvantaged individual's (1) self-esteem; (2) level of depressive symptoms; (3) resilience which includes a sense of master y and optimism; (4) anger; and (5) reliance on God. The Environment And Working Conditions In Juvenile Boot Camps And Traditional Facilities, Ojmarrh Mitchell, Doris Layton Mackenzie, Angela Gover, Gaylene Armstrong

This national study of juvenile correctional facilities compared the correctional environments of 25 juvenile boot camps to those of 22 traditional juvenile facilities. Data on perceived environmental conditions for juveniles and work climate for staff, as well as demographic characteristics, were collected from 1,233 juvenile correctional facility staff. While there was some regional variation, in comparison to staff employed in traditional juvenile correctional facilities, boot camp staff perceived the environmental conditions for juveniles as having significantly more activity, control, justice, structure, caring, and therapeutic programming, and believed that their releases were better prepared for the future. A review of the rape literature and current assessment suggests that research done in this highly sensitive area is especially vulnerable to response effects. Comparisons between studies is problematic due to vast differences in the conceptualizations of rape, the wording and context of the questions used to solicit data as well as the method of data collection. I created a new rape prevalence questionnaire with the intent of decreasing response effects. Open court testimony poses difficulty for child witnesses required to face the defendant. Certain laws allow hearsay testimony to replace the alleged child victim's testimony. This study examines the relationship of the child's age to the relative believability of three hearsay testimony fonnats in a 2 (child witnesses: one 4-year-old and one 8-year-old) x 3 (hearsay conditions: interview of child, interviewer testimony in "gist" or summary form, or interviewer testimony in detailed, "verbatim" fonn) design. Life After Foster Care: Services And Policies For Former Foster Youth, Madeleine R. Stoner
The Journal of Sociology & Social Welfare
This article argues that interventions targeted to the needs of emancipated foster youth can prevent them from dependency, homelessness, and incarceration. It presents a profile of emancipated foster youth; focuses on their service needs; and, describes three program models addressing these. The data sources are a synthesis of previous research on independent living programs and findings about recently initiated programs. The data presented suggest policy changes to assure that emancipated foster youth continue to receive necessary service for self-sufficiency after they reach the legal emancipation age.

Within the last two decades technological advancement has enabled the forensic sciences to become much more highly complex and has provided the legal system with a specialized means of interpreting scientific evidence. In this regard, the forensic anthropologist has seen an increasing amount of time spent as an expert witness in judicial proceedings. However, expert courtroom testimony requires that a scientific witness be knowledgeable, accredited, and ethical in his representation of the discipline. Conflict theory indicates that the field of medicine is a social structure that is based upon capitalistic ideology and serves to perpetuate inequality. The emotional impact of a shooting incident on the individual police officer has been recognized and detailed by both police and mental health professionals (Lippert & Ferrara, 1984). The human cost and financial costs to Police Departments as a result of "post shooting" trauma has sensitized many departments to the need for professional support for officers involved in shootings. The study focuses on the issue of establishing a citizen review board at the Las Vegas Metropolitan Police Department (LVMPD) for the purpose of reviewing allegations of misconduct. With the recent increase of police officer misconduct the LVMPD has come under a great deal of scrutiny by residents of the community. The credibility of the department has been jeopardized as a result of the current complaint investigations process which is conducted by the Internal Affairs Bureau. In 1996 the job classification of Process Server was created in the Clark County District Attorney Criminal Division in Las Vegas, Nevada. It was implemented by DA Stewart L. Bell as a cost-saving measure meant as a reclassification of the position of Investigator. Since the initial job posting, the duties appropriate to the position of Process Server have been and remain in question. No written, measurable job performance standards have been established and no consistent training or supervision provided. A review of the literature suggests wide variance in what may be considered appropriate job duties for this classification, though the …

Symbolism and substance are essential parts of any political system. In our system of government, we typically think of symbolism as serving substantive ends. Using a triangulation of _methods (Participant Observation, Archival Data, and Documentary Evidence), the paper examines two cases (Social Security and criminal justice) and concludes that the mix between substance and symbolism has changed dramatically in recent years with symbolism now assuming the central role.
The current debates over Social Security funding and criminal justice sanctions, for example, are less about the concerns of old-age security or making the public safer as much as they reflect a …

Introduction: Archaeologists have been studying African-American material culture during slavery and subsequent freedom since the 1960's (McCarthy 1995). While most historians believed that no trace of African culture remained through slavery and consequent oppression, archaeologists (McCarthy 1995) and anthropologists (Herskovits 1941) sought to prove that African-Americans persisted with their culture as a rebellion or reaction to their forced migration to the Americas (Ferguson 1992). In studying African-Americans in archaeological context, historical archaeologists have not had to change thier methodology but had to modify their interpretive approach.
