Federal Forfeiture: Law, Policy And Practice, Greg Warchol, Dennis Payne, Brian Johnson

The purpose of this research is to first describe the origins and current state of federal asset forfeiture law, then examine of how property seized under the forfeiture laws for drug law violations is proceeded against by the federal government. The methodology, which is primarily exploratory, utilizes both qualitative and quantitative data. A sample of over 6000 federal administrative and judicial drug forfeiture cases are described and analyzed to construct a profile of the federal government's use of this policy. Findings raise questions about the use of forfeiture and the government's intent. Implications and suggestions for future research are included.

IDENTITY THEFT. DISCLOSURE OF PERSONAL INFORMATION ABOUT VICTIMS. INITIATIVE STATUTE. Provides that anyone who discloses personal information about victims of identity theft is guilty of a crime. Organizations that disclose personal information to felons resulting in identity theft are liable for damages. Requires organizations with financial information to develop procedures to prevent such disclosure. Organizations that disclose personal information to parties for direct marketing are required to inform victims of their legal rights and source of information. Allows identity theft victims to request nondisclosure of personal information to parties engaging in direct marketing. Requires state agency to issue model guidelines. …

ELECTIONS. USE OF INTERNET FOR VOTER REGISTRATION AND VOTING. INITIATIVE STATUTE. Authorizes use of Internet for electronic voter registration and for casting ballots in direct primary elections, statewide general elections, special elections, and other public elections. Specifies standards for Internet voting systems. Requires Secretary of State to test and certify voting systems, to accredit means of identifying and authenticating voters, to protect voter confidentiality, and to adopt rules and regulations governing Internet voting procedures. Requires counties to offer Internet option to all voters. Criminalizes efforts to interfere with Internet election system; specifies penalties. Preserves traditional voting methods. The Estate of Sam Sheppard responds to the State’s motion to exclude the bloodstained wood chips and bloodstain from Marilyn Sheppard’s wardrobe door. The Estate supports that the physical evidence can be authenticated in accordance with Ohio case law concerning evidence of this nature. It also argues that any chain of custody gap is due to the failure of the State, which cannot use its own failure to bar evidence from being used against it.

The Estate of Sam Sheppard moved to exclude the testimony of Gregg McCrary from trial. McCrary was a retired FBI investigator whom the State anticipated would provide an opinion supporting its contention that Sam Sheppard murdered Marilyn. The motion attacks the former agent’s credentials by asserting that he is not an expert in any relevant field. It also argues that the methods McCrary used to draw his opinions on the case are not reliable.
