Americans have been putting a great deal of energy into commemorating the 50th anniversary of some of the key moments of the civil rights movement. This burst of memorialization has inspired one new museum in Atlanta and the redesign of another in Memphis. The Smithsonian and Library of Congress are launching a new oral-history initiative, and films like Selma bring the movement to life for those who rarely read a history book or visit a museum.

Jean Byers Sampson was a 1944 graduate of Smith College. Early in her post-Smith career, she conducted and wrote the 1947, “A Study of the Negro in Military Service,” which contributed to President Harry Truman’s decision to desegregate the armed forces. Sampson moved to Maine in the early 1950s with her husband, Richard Sampson, a Bates College mathematics professor, and she played a unique and critical role in the state until her death in 1996. Race, Sex, And Rulemaking: Administrative Constitutionalism And The Workplace, 1960 To The Present, Sophia Z. Lee

This Article uses the history of equal employment rulemaking at the Federal Communications Commission (FCC) and the Federal Power Commission (FPC) to document and analyze, for the first time, how administrative agencies interpret the Constitution. Although it is widely recognized that administrators must implement policy with an eye on the Constitution, neither constitutional nor administrative law scholarship has examined how administrators approach constitutional interpretation. Indeed, there is limited understanding of agencies’ core task of interpreting statutes, let alone of their constitutional practice. New York State’s regulations require health care workers who have direct contact with patients or who may expose patients to disease to be vaccinated against seasonal and H1N1 influenza. Courts must take into account Constitutional guarantees of personal autonomy, freedom of contract, and freedom of religion when reviewing the current lawsuits. These rights, however, have been constrained when they conflict with government measures that are intended to protect the community’s health and safety. Olmstead V L.C.: Federal Implementation Guidelines, And Analysis Of Recent Cases Regarding Medicaid Coverage Of Long Term Care Services For Persons With Disabilities, Sara J. Rosenbaum

Health Policy and Management Issue Briefs

This analysis reviews the key elements of the United States Supreme Court's 1999 decision in Olmstead v L.C. as well as Federal implementation guidelines issued by the United States Department and Human Services. The Olmstead decision interprets the Americans with Disabilities Act ("ADA," PL 101-336), whose requirements apply to the use of all public funds. However, Medicaid represents the single largest source of public funding for both institutional and non-institutional services for persons with disabilities. As a result, when states expend Medicaid funds on care for persons with disabilities, two independent sets of legal requirements are triggered: those contained in …

The purpose of this paper is to discuss why I think the Reagan administration's avowed commitment to helping only "actual victims" of racial discrimination retards rather than advances the cause of civil rights. I make reference in my title to "seniority" and "the shadow of Stotts" because the current administration is relying upon Supreme Court decisions having to do with seniority, particularly its 1984 opinion in Memphis Firefighters v. Stotts, to justify a wholesale attack upon race-conscious remedies, not only in employment but in education and public contracting as well.
