Soft law governance relies on nongovernmental institutions that establish and implement voluntary standards. Compared with traditional hard law solutions to societal and economic problems, soft law alternatives promise to be more politically feasible to establish and then easier to adapt in the face of changing circumstances. This thesis aims to provide a sustainable irrigation alternative that could be easily adopted by farmers in the Mississippi Delta in order to improve water resource management. The Mississippi Alluvial Valley Aquifer, the groundwater system that lies under the Mississippi Delta, is being depleted at rapid rates due to industrial farming and unsustainable, outdated irrigation methods. One of the wicked problems communities face worldwide is climate change. Among potential solutions and current efforts is green public procurement (GPP), an innovative policy approach to change business as usual in the governmental sector. Local governments in the U.S. annually spend approximately $1.72 trillion on purchasing goods and services. Given substantial purchasing power of municipalities, GPP practices at the local level can incite a transition toward a more sustainable society. This study is the first to delineate the levels and variations of existing GPP practices among U.S. localities and examine the factors that facilitate or hinder GPP engagement.

In its broadest sense, presidential control encompasses all the actions, in both word and deed, whereby presidents “go it alone” to adopt policies in the absence of congressional will to do so, and sometimes directly contrary to it. This dissertation studies how President Obama used rhetorical and administrative tools of presidential control to address the “wicked problem” of climate change. Chicago’s Little Village community bears the heavy burden of environmental injustice and racism. The residents are mostly immigrants and people of color who live with low levels of income, limited access to healthcare, and disproportionate levels of dangerous air pollution. Before its retirement, Little Village’s Crawford coal-burning power plant was the lead source of air pollution, contributing to 41 deaths, 550 emergency room visits, and 2,800 asthma attacks per year. After the plant’s retirement, community members wanted a say on the future use of the lot, only to be closed out when a corporation, Hilco Redevelopment Partners, bought the lot …

Over the last fifty years, the U.S. Environmental Protection Agency (EPA) has found itself repeatedly defending its regulations before federal judges. The agency’s engagement with the federal judiciary has resulted in prominent Supreme Court decisions, such as Chevron v. NRDC and Massachusetts v. EPA, which have left a lasting imprint on federal administrative law. Such prominent litigation has also fostered, for many observers, a longstanding impression of an agency besieged by litigation. In particular, many lawyers and scholars have long believed that unhappy businesses or environmental groups challenge nearly every EPA rule in court. Although some empirical studies have …

Budgets are a prospective tool of governance, and appropriations are a planning vehicle reflecting: bureaucracies’ values, complex interactions, collective preferences, political influences, and available resources. Research spanning 30 years finds that environmental pollution is a key determinant of environmental budgets in the US, though myriad factors, actors, and subsystems are important to consider. Due to federalism and devolution of responsibilities and authorities, environmental governance falls largely to the states. While the dynamics that shape state environmental budget policy have received scholarly interest, theoretically-driven examinations of environmental appropriations remain limited within the public budgeting and environmental policy literature.

This is in large part due to a lack of resources. This thesis analyzes innovative federal policy mechanisms that will address the current gap between actions and forecasted impacts, and will make U.S. coastal communities more resilient in the face of climate change.

Sculpting the Public Land Base in Northern Minnesota Counties: Past, Present and Future. This 3-article dissertation addresses the large public land base in the Arrowhead Region of Northern Minnesota. One fourth of all lands in the state are public lands, with the overwhelming majority located in the Arrowhead Region. These counties have anywhere from 30% to 92% public lands. The region relies heavily on a natural resource economy. Methodology for research includes secondary data analysis from several preexisting research projects and studies. Over the last several decades, food policy councils (FPCs) have led the effort to place food on local government policy agendas. While FPCs continue to make progress in supporting local food systems, they also face institutional and organizational challenges. In recent years, a handful of cities and counties have endeavored to further food system reform with the establishment of full-time food policy staff positions.
