The core international human rights treaties from the United Nations have been signed and ratified by varying groups of states, and much of previous research has been dominated by a desire to explain ratification of international human rights law (IHRL) through the democratic lock-in effect and states’ economic and political ties to one another. This article argues that climate change’s destabilizing impacts require us to look at existing international governance tools at our disposal with fresh eyes. As such, Council climate action cannot and should not be dismissed out-of-hand. As conflicts rise, migration explodes, and nations are extinguished, how long can the Council remain on the climate sidelines? Hence, my call for a re-conceptualized “Council 3.0” to meet the climate security challenges this century.

The United Nations (UN) has invested increasing levels of effort in recent decades to cultivate a more effective, diverse and democratic institutional culture via the inclusion of and interaction among international civil society organizations (CSOs) and nongovernmental organizations (NGOs) to supplement the traditional role of states as the primary transnational actors. The principle vehicle for the UN-civil society dynamic is the consultative status (CS) program within the Economic and Social Council (ECOSOC), wherein a diverse range of nearly 5,000 transnational organizations ostensibly participate.

Since the mid-1990s, UN special procedures reports have increasingly addressed human rights violations related to sexual orientation. However, it was not until 2011 that the first UN resolution on human rights and sexual orientation was adopted. After considerable difficulty, a follow-up resolution was adopted in late 2014. This policy and practice note examines the challenges of adopting sexual orientation resolutions at the UN Human Rights Council. This paper analyzes existing supply gaps that are impeding rural water access in Bo District, Sierra Leone. On a national and district level, Sierra Leone has failed to meet the target of 70% access to potable water inspired by the United Nation’s Millennium Development Goals. This paper focuses on Bo District due to its near total inclusion in the Sewa River basin and split urban and rural population. Given the existing political and economic constraints, this paper identifies the most feasible way to sustainably increase access to potable water in Bo. Africa is the continent most targeted by sanctions. During the Cold War, when the United Nations Security Council (UNSC) was all but paralysed, the only sanctions regimes that the UN imposed were directed at countries located on the African continent: Southern Rhodesia and South Africa, penalized for their apartheid regimes. In the post-Cold War era, Africa has continued to register the highest frequency of sanctions, applied not only by the UN but by other organizations as well. This article examines the process of consensus formation by the international community regarding how to confront the problem of trafficking in persons. We analyze the corpus of United Nations General Assembly Third Committee resolutions to show that: (1) consensus around the issue of how to confront trafficking in persons has increased over time; and (2) the formation of this consensus depends upon how the issue is framed. We test our argument by examining the characteristics of resolutions’ sponsors and discursive framing concepts such as crime, human rights, and the strength of enforcement language. This is the codebook containing definitions of terms used in the Sanction Dataset. The dataset is composed of the entire universe of sanctions regimes imposed by the UN, US and EU in the period from 1990 to 2010, including those sanctions regimes that were in place by 1990, targeting a country, its leadership and entities associated with it. Episodes which are still on-going are also recorded.

The Libya intervention of 2011 marked the first time that the UN Security Council invoked the “responsibility to protect” principle (RtoP) to authorize use of force by UN member states. In this comment the author argues that the Security Council’s invocation of RtoP in the midst of the Libyan crisis significantly deepens the broader, ongoing transformation in the international law system’s approach to sovereignty and civilian protection. This transformation away from the traditional Westphalian notion of sovereignty has been unfolding for decades, but the Libyan case represents a further normative shift from sovereignty as a right to sovereignty as a …

In 1987, the United Nations released the Brundtland Report, which defined sustainable development as “development which meets the needs of the present without compromising the ability of future generations to meet their own needs.” While this definition provides a relatively stable theoretical base from which development economists and political scientists can begin to tackle issues surrounding sustainable development, the inherently amorphous nature of this definition has also created a fair amount of ambiguity in both the economic literature surrounding sustainable development and the subsequent attempts by economists to measure it.

This book chapter traces the legal and political origins of the Responsibility to Protect doctrine from its early origins in the International Commission on Intervention and State Sovereignty through the 2005 World Summit Outcome Document and up to January 2011. The chapter examines the legal meaning of the Responsibility to Protect, the obligations the Responsibility imposes on states and international institutions, and its implications in for the international legal and political systems. The chapter argues that while the Responsibility to Protect has developed with extraordinary speed, it is still a norm in development rather than a binding legal rule. Its …

The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), adopted by the United Nations in 1979, has now been ratified by 185 countries, consisting of more than ninety percent of all UN members. The United States, however, has never ratified the Convention. The history of the Convention provides evidence of global support for women’s rights. While there are complex reasons behind the United States’ failure to ratify CEDAW, the United States’ commitment to unilateralism, an attitude of “American exceptionalism” and the long-term inequality and discrimination against women in the U.S. all contribute to the stifling of …

Current odious debt doctrine– using the term “doctrine” loosely, since it has never formally been adopted by a court or international decision maker– dates back to a 1927 treatise by a wandering Russian academic named Alexander Sack. Sack suggested that debt obligations are odious and therefore unenforceable if 1) they were incurred without the consent of the populace; 2) they did not benefit the populace; and 3) the lender knew or should have known about the absence of consent and benefit. The tripartite Sack definition, which quickly became the foundation of odious debt analysis, contemplates a debt-by-debt approach to questionable …

As the international response to recent events in Darfur demonstrates, the restriction of authority to intervene to the United Nations poses the greater legal barrier to intervention. From a practical perspective, then, the more pressing question may be whether international law ought to be modified to permit states, or multi-state organizations, to carry out unilateral humanitarian interventions; that is, interventions that are not authorized by the United Nations. The impulse that invited the preparation of this book is one which is linked to the convergence of a number of factors bearing on my interest in human rights. First, the brutality visited on children during World War II has had an abiding negative effect on my sense of what is possible in human conduct. Section XVIII: The Western World in the Twentieth Century: The Historical Setting

The legacy of World War II was a heavy load for statesmen to bear. The collapse of Germany, Italy, Japan, and their lesser allies left a power vacuum, temporarily filled by the armies of occupation. Military losses were half again as high as in World War I. Even greater was the different in civilian losses. For every civilian who died a war death in 1914-1918, at least a score (a total of some 20,000,000) perished in 1939-1945. Material losses in housing and productive capacity were staggering. [excerpt]
