Houve tempo em que a Constituição servia para poisar ou charuto ou tirar um argumento político, como ironicamente afirmaria o grande escritor oitocentista Eça de Queiroz. Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

Fanning The Flames: Religious Media Consumption And American Politics, Brian Newman, Mark Smith

Both religion and mass media are politically important in the United States. However, little is known about the political role of religious media. Religious media might be politically influential because they help translate religion into political thinking and because their consumers are likely to internalize the political cues these media provide. We find that almost a quarter of the public claims to have relied on religious media when making voting decisions in 2000. Religious media users felt significantly closer to George W. Bush and Pat Buchanan and farther away from Al Gore and were more likely to vote for Bush …

The Unequal Representation Of Latinos And Whites, Brian Newman, John D. Griffin

We compare the ideological proximity of Latinos and whites to their Members of Congress (MCs), demonstrating the degree to which Latinos are underrepresented compared to whites. We show how this representation gap varies with group differences in electoral turnout and income, district ethnic composition, and MCs' ethnicity and party affiliation. We find that Latinos' unequal representation is not simply a function of the group's numerical minority status. Concentrating Latinos in congressional districts does not necessarily translate into more equal representation. However, several factors can enhance the equality of Latinos' representation-participation in elections and representation by both Latinos and Democrats.

Japan’s civil society is being transformed as more people volunteer for advocacy and professional nonprofit organizations. In the American context, this trend has been accompanied by a decline in participation in traditional organizations. Does the rise in new types of nonprofit groups herald a decline of traditional volunteering in Japan? This article argues that while changes in civil rights, political opportunity structure, and technology have also taken place in Japan, they have contributed to the rise of new groups without causing traditional organizations to decline, because Japanese attitudes about civic responsibility have continued to support traditional volunteering.

This article examines the relationship between intellectual property (IP) and public health, with a focus on the extension of AIDS treatment in the developing world. While most of the literature on IP and health examines the conditions affecting poor countries’ capacities to acquire essential medicines, I show the distinct – and more complicated – political economy of production and supply. IP regulations alter the structure of generic pharmaceutical sectors in the countries capable of supplying essential medicines, and changes in market structure affect actors’ economic and political interests and capacities. Economists studying commercial activity on-line argue that the most significant difference between on-line and off-line commerce is the ability of firms to ‘know who your customers are and treat them differently’ (Vulkan 2006), customizing prices and offerings. This difference comes from the huge amount of data generated by on-line transactions, in terms of historical records, usage statistics and real-time data. Yet in political life, governmental organizations and political parties have been far slower to use such data to improve their service offerings and devise innovative policy interventions, such as differential pricing and personalized information provision. Since the last several years of the life of King Hassan II, Morocco slowly moved from authoritarian rule to a managed democracy. As a result of this gradual political liberalization, religious groups as well as secular ones formed political parties. This paper examines Turkey's relations with the European Union from December 1997 to December 2004 to understand the major dynamics behind the recent democratization and human rights reforms in Turkey. For this purpose, the study focuses on three factors: (1) the impact of EU, particularly the Copenhagen conditionality (2) the government structure (coalition vs. majority government) (3) the governing party's/parties' commitment level to the EU membership goal. The comparison across three periods of Turkey-EU relations (1997-1999, 1999-2002, 2002-2004) makes it possible to identify the relative significance of each factor for the reforms. Political Control For China’S State-Owned Enterprises: Lessons From America’S Experience With Hybrid Organizations, Jonathan Koppell

China’s reform of state-owned enterprises (SOEs) is intended to liberate the companies from bureaucratic control that hinders their management. Discussions of SOE reform, however, downplay the policy consequences. Can SOEs be “free” to succeed economically while some political control is maintained? Surprisingly, American experience with hybrid organizations—government-created companies that straddle the line between public and private—offers some precedent for managing the balance between political control and enterprise independence. Three strategies are derived for China. First, welfare functions must be stripped from SOEs and replaced by policy objectives compatible with commercial purposes. ABSTRACT This paper discusses various salient issues that relate and led to the disablement of traditional political institution in Nigeria. These include the colonial subjugation, vilification by the combined forces of western influence-Christianity and western education, and finally the defilement by some of the contemporary occupants of these institutions. It highlights the vicissitudes that the institution has experienced over the years from the advent of colonialism to the present and the effect of some of the status and operation in the institution. These, among others, are what the paper seeks to bring to the fore.
