Since the late 20th century, the federal government has regulated colleges’ and universities’ handling of campus sexual and gender-based violence (CSGBV). Although the arc of history has bent toward establishing greater protections for victims of such violence, new proposed regulation by the U.S. Department of Education under the Trump administration focuses more heavily on ensuring due process rights for students accused of CSGBV. Most recently, in November 2018, U.S. Secretary of Education, Betsy DeVos submitted a proposed rule change to the regulation of Title IX of the Education Amendments of 1972. This thesis examines the impacts of Title IX compliance on salary gap of Division I Football Bowl Series and Football Championship Series universities male and female associate professors. Title IX athletic proportionality requirements have been established since the 1980’s and require that each university have an equal percentage of female student athletes as they do female undergraduates. This study uses the National Center for Education Statistics database, Integrated Postsecondary Education Data System to calculate salary gap between male and female associate professors and uses the Office of Civil Rights Equity in Athletics Database to calculate Title IX compliance. Typically, when we hear about Title IX, we think of scholarship dollars, ratio of men’s and women’s sports, and equal funding, but in the past several years we have seen a shift in focus to sexual misconduct. The purpose of this project is to provide historical awareness for how Title IX, the anti-gender discrimination law in education, evolved to where it is today and the impact it has on universities in the United States. Strong-willed individuals sought change in the late 1960s and 1970s to prevent gender discrimination in education, thus beginning the creation of the law and making it a powerful tool for women’s rights. The following paper investigates sexual violence on university campuses. It discusses the role of the Title IX of the Education Amendments of 1972 along with a Dear Colleague Letter enacted by the United States’ federal government to all public institutions regarding how to respond when complaints and allegations of sexual violence are made. The paper addresses the statistics and common misconceptions surrounding sexual violence on college campuses before focusing specifically on student-athletes’ involvement in sexually violent crimes. Sexual Assault Campus Climate Surveys: Insights From The First Wave, Kristen M. Budd, Alana Van Gundy, Rose Marie Ward, Glenn W. Muschert

Dignity: A Journal of Analysis of Exploitation and Violence

One tool to help institutions of higher education (IHEs) to address campus sexual assault is the campus climate survey (CCS); yet little is known about the CCS implementation process. This study used a mixed methods approach to examine the implementation process of CCSs deployed during the 2015/16 academic year at 244 IHEs throughout the United States. Quantitative results indicate CCSs were designed primarily by the Title IX officer and campus administration; assessed victimization rates and knowledge about campus resources; and were voluntary. Qualitative findings generate concerns surrounding generalizability, participation rates, validity of data, and suggestions for improvement for future CCSs.

No Evidence Of “Weaponized Title Ix” Here: An Empirical Assessment Of Sexual Misconduct Reporting, Case Processing, And Outcomes, Tara N. Richards

Little is known about actual incidents of gender-based violence reported by college students or the campus adjudication process or outcomes of reported cases. Data from Annual Security Reports (ASRs) and Title IX Coordinators was used to examine the context, processes, and outcomes of reported incidents of sexual misconduct (n=1,054) at Institutions of Higher Education (IHEs) in a Mid-Atlantic state. Results showed that ASRs undercounted incidents of sexual misconduct. Few incidents reported to Title IX Coordinators resulted in a formal Title IX complaint, and fewer still resulted in a finding of responsibility or suspension/expulsion of the responsible student. Sexual assault policy on college campuses in the United States is a complex system guided by federal policy, state policy, and local mandates. When students violate sexual misconduct policies, campuses primarily rely on suspensions and expulsions, paralleling the criminal justice system’s reliance on incarceration as a solution based on stigmatization and separation. Since the 1990s, restorative justice has made inroads as an alternative response to student misconduct, but application to sexual misconduct is rare. The Campus PRISM Project (Promoting Restorative Initiatives on Sexual Misconduct) is a network of academics and practitioners exploring a restorative approach within a responsive regulatory framework. …

The purpose of this study is to identify students’ awareness, knowledge, and perceptions of the mandatory reporting policy related to Title IX of the Education Amendments of 1972 (Title IX). Mandatory reporting requirements are being implemented in higher educational institutions; however, existing literature does not examine students’ perceptions or their knowledge of the specific requirements that apply exclusively to them. This exploratory study examines the perceptions of college students at Virginia Commonwealth University (VCU) in Richmond, Virginia.
