Both antitrust and IP law are limited and imperfect instruments for regulating innovation. The problems include high information costs and lack of sufficient knowledge, special interest capture, and the jury trial system, to name a few. More fundamentally, antitrust law and intellectual property law have looked at markets in very different ways. Further, over the last three decades antitrust law has undergone a reformation process that has made it extremely self conscious about its goals. While the need for such reform is at least as apparent in patent and copyright law, very little true reform has actually occurred.

This exploratory research examined levels of innovation adoption among Juvenile Court Officers (JCOs) in a Midwestern state. The researcher applied Dr. Everett M. Rogers’ Diffusion of Innovation model as the study’s framework. According to Rogers (2003), innovation is “an idea, practice or object that is perceived as new by an individual or other unit of adoption” (p. 475). The study sought to determine the extent that demographic and work-life variables such as gender, office location, caseload, years of service, personality/temperament and employee engagement contributed to levels of innovation adoption by JCOs. This article describes a practice I began several years ago to encourage students to review their midterm exams and to learn formatively from their exam and their review of it. The practice involves encouraging midterm grade appeals coupled with a high success rate (what I term, "robust" grade appeals). The practice has a number of ancillary benefits, I believe, in addition to the central benefits—getting students to learn more about law, learn from their mistakes and write better exams by meaningfully engaging and critiquing their own work on exams. In Federal Trade Commission v. Actavis, Inc., the Supreme Court provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. The Court came down strongly in favor of an antitrust solution to the problem, concluding that “an antitrust action is likely to prove more feasible administratively than the Eleventh Circuit believed.” At the same time, Justice Breyer’s majority opinion acknowledged that the Court did not answer every relevant question. The opinion closed by “leav[ing] to the lower courts the structuring of the present rule-of-reason antitrust litigation.”

During a period of rapid social and technological change, academic Academic libraries and librarianship are experiencing a period of great change, or crisis, influenced by multiple factors including emerging technologies, declining budgets, and changing information. More than a transitory historical phase, these changes represents a fundamental transition between paradigms (Kuhn, 1962). Academic libraries and librarianship are moving from a paradigm focused on collections and books to a paradigm focused on learning. Within this context, innovations are new processes, services and products that facilitate this transition to the new paradigm.

In the United States responsibility for innovation policy and competition policy are assigned to different agencies with different authority. The principal institutional enforcers of patent policy are the United States Patent and Trademark Office (USPTO), the International Trade Commission (ITC), and the federal district courts as overseen by the United States Court of Appeals for the Federal Circuit, and ultimately the Supreme Court. While competition policy is not an explicit part of patent policy, competition issues arise frequently, even when they are not seen as such.

This paper examines how the resources of the Line of Business (LB) Program of the U.S. Federal Trade Commission (FTC) leveraged academic research to develop understanding of science and technology policy and to point to new directions for both research and policy. The paper provides an overview and discussion of the birth and death of the FTC LB Program and its unique LB data, the innovation research using the LB data, and the legacy of the program.

State Incentives For Innovation, Star Scientists, And Jobs: Evidence From Biotech, Enrico Moretti, Daniel J. Wilson

We evaluate the effects of state-provided financial incentives for biotech companies, which are part of a growing trend of placed-based policies designed to spur innovation clusters. We estimate that the adoption of subsidies for biotech employers by a state raises the number of star biotech scientists in that state by about 15 percent over a three-year period. A 10 percent decline in the user cost of capital induced by an increase in R&D tax incentives raises the number of stars by 22 percent. Most of the gains are due to the relocation of star scientists to adopting states, with limited …

Regulatory Focus Theory predicts that the motivation to self-regulate goal-directed thought and behavior depends on two distinct regulation strategies: a promotion focus based on attaining gains and a prevention focus based on avoiding losses.

This study took a social-cognitive approach predicting that regulatory focus has an impact on how family startups (several family related founders) explore “new ideas”, exploit “old certainties” and achieve the balance of both (ambidexterity), compared to lone founder startups (only one founder present).

However, when it comes to publishing their work, there are no common, well-established standards on how to make that data available to other researchers. Why, contrary to their predecessors, did the Taliban resort to use of suicide attacks in the 2000s in Afghanistan? By drawing from terrorist innovation literature and Michael Horowitz’s adoption capacity theory—a theory of diffusion of military innovation—the author argues that suicide attacks in Afghanistan is better understood as an innovation or emulation of a new technique to retaliate in asymmetric warfare when insurgents face arms embargo, military pressure, and have direct links to external terrorist groups. Creativity and Change Leadership Graduate Student Master's Projects

This project developed tools to support a consulting practice integrating the author’s interests in creative process, design and organizational strategy. The focus is on educating students and clients about creativity, creative thinking, design and innovation. Design thinking concepts of user feedback and rapid prototyping were used during the project. The resulting products are materials for a multi-day graduate level workshop for design students, a creativity website including blogging capability and a four minute educational video aimed at helping establish an Aerospace Technology Center in Northern Illinois.

Advances in medical technology have altered the need for certain types of surgery to be performed in traditional inpatient hospital settings. Less invasive surgical procedures allow a growing number of medical treatments to take place on an outpatient basis. Hospitals face growing competition from ambulatory surgery centers (ASCs). The competitive threats posed by ASCs are important, given that inpatient surgery has been the cornerstone of hospital services for over a century. Additional research is needed to understand how surgical volume shifts between and within acute care general hospitals (ACGHs) and ASCs. Purpose – This study aims to analytically develop a reference model for engineering (i.e. analysis, design, development, evaluation, delivery, maintenance, modification, and management) powerful value networks capable of creating innovative mobile data services. Design/methodology/approach – The paradigm followed is that of Design-Science Research (DSR) which incorporates two main iterative processes: build and evaluate. For building the model (i.e. the design science artifact in this research), we followed three iterations: (1) Literature Review Analysis; (2) Semi-Structured Interviews analyzed through content analysis; and (3) examination of real-life case studies. I discovered the Marshmallow Challenge when taking an online course through Stanford called, “A Crash Course in Creativity” with Dr. Tina Seelig (http://venture-lab.org/creativity).

The exercise has been used with groups of all ages from around the world by Tom Wujec, who Seelig calls an, “award-winning designer and innovator” (p. 144).

How do you use the Marshmallow Challenge? I use it in a number of different ways:

We investigate the degree to which corporate governance and ownership affects the innovation performance of firms in China with a particular focus on privately owned small and medium enterprises (SMEs). We hypothesize that (1) board-related governance measures will enhance innovation because they improve monitoring and provide access to necessary resources; (2) ownership concentration initially facilitates innovation because large shareholders are more likely to commit to the long-term nature of innovation, and have the incentive to monitor managers whose time horizon may be shorter; however we argue that these effects weaken as large shareholders becomes entrenched at higher levels of concentration; …

Drawing upon the Communities of Innovation (COI) framework, this study seeks to identify the composition (functional demographic diversity), team climate (vision, participatory safety, task orientation, support for innovation), and process (group reflection, group flow, group conflict, dynamic expertise) variables that influence team-level innovation. Using data from 15 business school teams enrolled in a class on innovation and entrepreneurship, I explore the extent to which the proposed composition, team climate, and process variables discriminate between high-ranking and low-ranking innovative teams.
