This paper reviews the recent work by Australian labour lawyers that has embraced the ‘new regulation’ and in particular the idea of law as regulation. This approach has recast the academic study of labour law as being concerned with regulation of the labour market. While much of this work has concentrated on expanding the field of labour law to include many areas of law affecting the labour market (beyond the employer-employee relationship), the work has also developed the view of law as a mechanism of state regulation. The move toward online course facilitation in tertiary education has the intent of providing education at any time in any place to any person. In the foundational narratives that members of the Association of Women for Action and Research (AWARE) tell about the organisation’s formation, many topics remain (to echo the state’s vernacular) ‘out-of-bounds’. In this paper I examine the ways in which AWARE members construct their own ‘OB markers’ in telling the history of AWARE. The constructedness of this history in itself is not remarkable. In telling stories about themselves and others, we expect situated actors to re-construct and re-present the past. Often Gramsci is presented in the social sciences, particularly by post-Marxists, as a precursor of and justification for abandoning the concept of class. This is incorrect. This article outlines Gramsci’s ideas of class, class composition, formation and alliance which Gramsci based on a detailed, accurate reconnaissance of the Italy of his time.
