Unlike many previous presidential elections, in 2004 foreign policy issues are at the forefront of the American policy and electoral agenda. Not since the Vietnam era has the United States entered an election year with the United States at such a heightened state of war, with ongoing military operations in Iraq and Afghanistan, as well as covert operations deployed around the world to wage the war on terrorism. The architect Daniel Libeskind has written a noted lecture, "Traces of the Unborn." We might add, "Traces of the Stillborn." There is a tendency in historical institutionalism (HI) to concentrate on the retrieval of traces of paths taken rather than (1) to consider the processes involved in the selection of paths; and (2) to reflect upon the conditions of institutional emergence and sedimentation of paths, whether taken or untaken. This decision tools manual outlines methods through which nations and organizations with limited resources can accurately prioritize humanitarian mine action projects and clearance efforts. This methods include a cost-benefit analysis of the socio-economic effect of mine clearance with field examples from Thailand and Ethiopia.

Mapping The Small Arms Trade: Insights From Social Network Analysis, David Todd Kinsella

In recent years, researchers have increasingly turned their attention to the proliferation of small arms, a transnational trade amounting to over $7 billion in value during 2002. Small arms are difficult to track and are not the stuff of military parades, but they are immensely destructive. The trade in small arms should be understood not as a market but as a network, one that shares some important properties with networked forms of organization studied by sociologists. I make this argument and then employ quantitative methods developed for the study of social networks in an effort to show the basic structure …

May I first pay compliments to the leadership of the Asian Development Bank for hosting this seminar. Asia has a huge stake in the success of the WTO generally, and the Doha Round specifically, but not everyone realizes that. So seminars of this _ nature are terribly important in providing focus to the Doha Round, encouragement to the negotiators, and in building public support for this endeavor. Let's hope we can accomplish those objectives here in Osaka.

Economic Measurements And Quality Of Life In Mexico, Constantine P. Danopoulos

Using the Genuine Progress Indicator (GPI), the article seeks to evaluate the quality of life in modern Mexico. The GPI employs the same indicators used to arrive at per capita GDP, but adds positive and negative monetary and non-monetary actors that affect people's lives. Monetary factors include income distribution, increased health care cost due to air and water pollution, and loss of wetlands. Non-monetary factors involve parenting, time spent in highways, loss of leisure time, the cost of volunteer work, and other social costs. Microfinance is emerging as an integral part of the new development paradigm, described by the phrase "participation and development. "Although the idea has become quite popular among donor agencies, development practitioners, and academicians, theoretical premises on which this idea is founded seem entirely unexamined. Accordingly, this article investigates the academic merits, as well as potential consequences, of this popular poverty alleviating model from the supply-side perspective and asks a provocative question: Do the microfinance ventures have features which suggest that the establishment of this new finance industry in the Third World countries might further complicate their pervasive poverty problems? The Domestic Origins Of International Agreements, Rachel Brewster

This paper examines how international agreements are substitutes for statutes. The statutory law-making system and international agreement negotiations are separate, but sometimes rival, processes for setting national-level policy. International agreements have several advantages over domestic statutes. Under United States law, international agreements can entrench policies that might otherwise be subject to change; they can transfer agenda-setting power from the Congress to the President; and they can delegate authority to international organizations. Each of these effects can lead domestic interest groups to seek international negotiations rather than domestic legislation. Written over fifteen years ago by Ivan Leigh Head, a highly distinguished Canadian international lawyer, foreign policy expert, and international development thinker, the words contained in the above quotation point firmly at this great man's analytic incisiveness and hint at the sheer depth of his fairness of mind. For although the net transfer of resources from the much poorer geopolitical "South" to a far richer "North" remains to this day one of the most important obstacles to international development, rarely have the dominant accounts of international development given this phenomenon the pride of place that it surely deserves.

After the collapse of the Soviet Union, the United States came to Eastern Europe spreading the gospel of democracy and the American Rule of Law. In addition to encouraging Western ideology, the United States was there to forge new economic relationships and, following the terrorist attacks of September 11, 2001, to accelerate the creation of military alliances through membership in the North Atlantic Treaty Organization (NATO) and the newly-formed "coalition of the willing." Romania and Bulgaria, among other former Soviet satellites, welcomed the invitation. Romania and Bulgaria are small countries which share similar economic pressures as they attempt to emerge …

This article reviews the work of the Special Commission of the Hague Conference on Private International Law, which meet during the first nine days of December 2003 to consider a Draft Text on Choice of Court Agreements. Negotiations originally sought a rather comprehensive convention on jurisdiction and the recognition and enforcement of judgments, with a preliminary draft convention being prepared in October 1999, and further revised at the first part of a Diplomatic Conference in June 2001. When it became clear that some countries, particularly the United States, could not agree to the convention being considered, negotiations were redirected at …

Vultures Or Vanguards?: The Role Of Litigation In Sovereign Debt Restructuring, Jill E. Fisch, Caroline M. Gentile

The market for sovereign debt differs from the market for corporate debt in several important ways including the risk of opportunistic default by sovereign debtors, the importance of political pressures, and the presence of international development organizations. Moreover, countries are subject to neither liquidation nor standardized processes of debt reorganization. Instead, negotiations between a sovereign debtor and its creditors lead to a voluntary restructuring of the sovereign's debt. One of the greatest difficulties in restructuring claims against sovereign debtors is balancing the interests of the majority of the creditors with those of minority creditors. Recent work in modeling decision-making work processes has focused on including the national culture of individual decision-makers in order to emphasize the differences in decision criteria between decision-makers of different nationalities. In addition to nationality, a decision-maker is also a member of an organization and brings this organizational culture to his role in the work process, where it may also affect his task performance. In order to represent the organizational impact on the work process, five organizational cultural parameters were identified and included in an algorithm for modeling and simulation of cultural difference in human decision-making.
