Morocco is a key transit country for many migrants trying to reach Europe, due to its shared land border with Spain, and Spain’s initiation into the European Union in 1986. Through informal interviews, current literature, Moroccan and Spanish news articles, and migrants’ stories, it can be seen that the changing bilateral relationship between Spain and Morocco creates violence at the border. Spain and Morocco’s unequal relationship is built upon economic dependency and colonialization. This study examines the role that Islamic law has played thus far in reforming the Moroccan Family Code, also known as the Moudawana. When King Mohammed VI reformed this law in 2004, Morocco received immediate international praise for its liberal strides towards gender equality. Through this study I investigated the hermeneutical tools and methods of ijtihad employed both by the drafters of the Moudawana and by activists leading up to the 2004 reforms. Interviews, surveys, and participant observation was used to study the mental health of Sub-Saharan migrants residing in Rabat, Morocco. These data collection methods were used to explore the various experiences migrants had pre-migration, during their migration journey, and post-migration. The migrants portrayed many negative, traumatic, and painful experiences. These experiences have caused a significant amount of pressure on the mental psyche of the migrants, manifesting itself in many physical and psychological problems. Morocco is a culturally diverse intersection between the African continent, the Arab world and Europe. This multiplicity is mirrored in the country’s pluralistic medical system and beliefs surrounding the concepts of illness and health. Explanations of health are endorsed by culturally specific knowledge and are then naturalized and taken as objective.
