The Significance Of Statistical Significance: Two Authors Restate An Incontrovertible Caution. Why A Book?, Richard O. Lempert
Law & Economics Working Papers Archive: 2003-2009
“The Significance of Statistical Significance” reviews THE CULT OF STATISTICAL SIGNIFICANCE How the Standard Error Costs Us Jobs, Justice and Lives by Stephen T. Ziliak and Dierdre N. McCloskey. The book’s core message is that statistical significance should not be equated with substantive significance and that empirical researchers should convey more information about the magnitude of relationships and effects than many now do. This review summarizes, approves of and elaborates on Ziliak and McCloskey’s message with special attention to concerns of the legal academy. It clarifies appropriate uses of significance tests within the research framework of controlling for plausible rival …
What Explains Insider Trading Restrictions? International Evidence On The Political Economy Of Insider Trading Regulation, Laura N. Beny
What Explains Insider Trading Restrictions? International Evidence On The Political Economy Of Insider Trading Regulation, Laura N. Beny
Law & Economics Working Papers Archive: 2003-2009
This article investigates the determinants of insider trading regulation across countries. The article presents a political economy analysis of such regulation that takes into account both private (distributional) and public (economic efficiency) considerations. The model cannot be tested directly because the relevant private preferences and social costs are unobservable. However, existing theories of capital market development suggest that various observable social factors can explain the diversity of insider trading policies across countries. In turn, these social factors should reveal the underlying preferences and social costs motivating such regulation.
The main finding, based on data from a cross section of countries …

Cognitive dissonance has become one of those scientific terms that everyone knows and uses so freely and loosely that its original meaning has been obscured. We speak of cognitive dissonance when we find our glasses in the kitchen instead of the bedroom, when oestrogen replacement turns out to be unhealthy rather than healthy, whenever we are less than pleasantly surprised. In Leon Festinger's original theory, cognitive dissonance arises when a person is forced to entertain two mutually inconsistent ideas, which creates an unpleasant tension that motivates the person to engage in various mental gymnastics to minimize the dissonance, usually by …

Empirical Research For Public Policy: With Examples From Family Law, Richard O. Lempert
Empirical Research For Public Policy: With Examples From Family Law, Richard O. Lempert
Articles
Perhaps more than in any other field, legal scholarship has aimed directly at influencing public policy. Hence, it is not surprising that empirical scholarship on law related issues often seems to have an agenda that extends beyond the common social science goals of adding to our knowledge base and understanding of human behavior to suggesting to policy makers and practitioners legal and administrative changes that will ameliorate problems they confront and, by the researcher’s lights, make this a better world in which to live.

Discovering William Cook: Ten Sources For Reconstructing The Life Of A Lawyer, Margaret A. Leary
Articles
Ms. Leary uses a case study to describe ten categories of resources for reconstructing a Manhattan lawyer's life. These resources answer questions about his law practice, scholarship, personal life, personality, values, and philanthropy. The case study uses today's resources to look far back into the details of the life of William W. Cook, who gave his fortune to the University of Michigan Law School.
