Everybody Does It: The Pragmatics And Perceptions Of International Chinese Graduate Students And Their American Peers Regarding Gossip, Miriam Eisenstein Ebsworth, Timothy John Ebsworth, Chencen Cai
Journal of Multilingual Education Research
Integrating natural observation, interviews, and quantitative analysis, we used a mixed design to compare the socio-linguistic judgments of international Chinese students at a private University on the East Coast of the United States (US) with those of their native English-speaking peers regarding a critical incident involving gossip. Ninety-two participants evaluated alternative sociolinguistic strategies offered in addressing the incident on semantic differential scales. Judgments by each group regarding four alternative responses were surveyed and compared. Twenty participants, ten from each group, participated in semi-structured interviews. Themes were developed through a recursive process: interpretations were validated by a bilingual bicultural expert. Several …

Currently, United States law offers no fashion design protection against design piracy. The fashion industry profits from pioneering creative content; yet, this content lies outside the domain of intellectual property law. Fashion designs are inevitably undervalued by consumers and the industry due to the lack of protection of original designs for the benefit of the industry's monetary value. Fashion design can be protected under copyright, trademark and patent law but these laws provide ambiguity and strict requirements for fashion labels. This Note will discuss the effects of fashion piracy both on innovation and the fashion industry’s bottom line.

The Tyranny Of Their Mirrors: Social Backgrounds And Variations In Conservative Judicial Philosophies, Andrew Millman

This Article seeks to examine and compare the judicial behaviors of the five conservative justices on the Supreme Court, especially John Roberts and Neil Gorsuch, through the lens of their social backgrounds and opinion-writing and -joining patterns. The research for this Article focused on the frequency with which all nine justices on the high court joined each other’s opinions and were joined by each other justice, as well as a control group of three earlier Supreme Court terms for comparison. In this Note, the authors Reeve Churchill and Wislande Francique will examine the changing interpretation of asylee rights by analyzing the Honduras Deal, the 9th District Court case East Bay Sanctuary v. Barr (2020), and Trump v. Hawaii. The Honduras Deal is evidence of the Trump Administration’s harsh restrictions towards asylum seekers. This note will contextualize the Honduras Deal through the examination of two court cases: East Bay Sanctuary v. Barr and Trump v. Hawaii. Although intimate violence partner rates have declined over the past decade, this health and social problem remains serious and significant. Latinas are especially impacted, as they face greater negative outcomes from intimate partner violence experiences. Research increasingly highlights the need to incorporate the unique narratives of racial and ethnic populations into education and intervention measures. Unfortunately, current strategies often neglect the social and cultural context of this population group. This report conceptualizes the effectiveness and benefits of utilizing the restorative justice model of Victim Offender Mediation (VOM) within the criminal and juvenile justice systems to serve the rights of victims, offenders, and society more justly. Victim Offender Mediation is discussed as a possible alternative justice model which reframes the victim-offender relationship to foster and respect the dignity and worth of each participant. This restorative justice model combats victims’ feelings of helplessness by giving them back their voice, while having the potential to specifically offer relief to those secondarily victimized by the legal system in cases of simple rape. The current literature surrounding the intersection of criminal justice and mental health is addressed. First, the history of overrepresentation of individuals with a mental health disorder in the criminal justice system is discussed, followed by a discussion of the current gaps in the literature. These gaps need to be addressed to inform better practices among public defenders and their decision making role with clients who have a mental health disorder. The lack of research is evident in ambiguous judicial guidance in ensuring that defendants with a mental health disorder are able to exercise autonomy relevant to their case. Social workers …

The overall decline of teen birth rates in the U.S. is problematized by persistent racial disparities in these rates. Latina teens are especially affected, as they have the highest teen birth rate of any racial or ethnic group. High teen birth rates among Latinas even persist in locales where the overall teen birth rate is below the national average, such as Suffolk County, NY. Socioeconomic, racial, and cultural factors contribute to the birth rate for Latina teens. Despite only 10% of youth identifying as lesbian, gay, bisexual, transgender, or queer (LGBTQ), 40% experience homelessness. The lack of services and resources available to the population in New York City have left up to 20,000 LGBTQ youth homeless. A plethora of reasons account for this, such as cultural and religious objections, a lack of resources from the government, and a lack of education about LGBTQ youth. Despite increased funding for and attention to LGBTQ homeless youth services, efforts have been largely inadequate. This article attempts to provide a comprehensive analysis of the needs for reintegration from sex trafficking and the gap of current social services provided to foreign national victims in the United States by focusing on Chinese female victims in Flushing NY. Through the research, the author understands the safe long-term housing ranks first among all the victims' needs for social services in the process of reintegration, which hasn’t been sufficiently addressed yet. Neighborhood building is essential to a diverse and strong New York. We are currently in a progressive political climate where legislation is being crafted so that the laws of New York reflect its residents. This includes foreign-born residents, who have successfully advocated for, and been a part of, this changing legislation. There is work to be done now by local-born residents to increase their ability to change their definition of community to be inclusive, facilitated by social workers and local government offices to ensure that the legislative changes are implemented in the spirit fought for by the coalition of advocates.

LGBTQQ identified youth are often targets in school settings for harassment, maltreatment, and bullying. This negative treatment often leads to decreased academic performance and limited potential for successful long-term outcomes. Through school and community-wide programming, EQuALITY seeks to increase acceptance of LGBTQQ identified students, foster self-empowerment, and support young adults as they navigate different social environments and interactions between LGBTQQ identified students and allies. Prison Rape is a common occurrence in America’s penal institutions. Sexual assault occurs most frequently on juveniles, the LGBT community, and people who are weak in stature. To combat this problem, The Prison Rape Elimination Act (PREA), passed in 2003 with bipartisan support and the backing of special interest groups, was envisioned as a human rights milestone. Prison rape is assumed by an apathetic public to be an expected part of the incarceration experience. Pierre Bourdieu and Jean-Claude Passeron’s The Inheritors critically examines the French education system in the 1960s. The Inheritors is a compilation of sociological studies on university students in the Arts which the authors use a premises for their education reform citing issues in the traditional system that allow bourgeois students to have an unfair advantage due to their cultured upbringing. The main systemic problem within French education is identified by Bourdieu and Passeron as the charismatic ideology that awards cultural, theoretical knowledge over merit and effort. The article looks at climate change though a social development framework, with emphasis on social justice and social welfare. It evaluates how market-based capitalism continues to contribute to the problem while ignoring the warnings from the scientific community. The article goes on to report that despite the devastation of climate change, concerns – mainly financial in nature - continue to hinder progress towards reform. The article then argues that given the evidence, climate change qualifies as a topic of interest for social workers. The article goes on to advocate for social work involvement highlighting some suggested areas for action.

Breastfeeding continues to be the most optimal source of nutrition for infants under 6 months of age, and has been associated with a wide variety of infant and maternal health benefits, including protection against certain illnesses and diseases. Most health organizations recommend exclusive breastfeeding for at least the first 6 months post-birth. Despite these recommendations, breastfeeding women, especially those in lower socioeconomic groups face many challenges in our society. Moreover, maternal employment stands as a significant barrier to successful breastfeeding durations. In 2001, the Colombian government initiated an experiment in poverty alleviation called Familias en Acción. This conditional cash transfer (CCT) program takes a novel approach to poverty reduction by addressing short- and long-term factors contributing to poverty. Though Colombia’s CCT program is just one of a wave of similar initiatives, its unique context and unexpected social effects, beyond the primary intentions of program designers, differentiate it from other such programs. Lack of universal family leave discriminates against low-income families with infants who require care in the Neonatal Intensive Care Unit. Birth complications tend to occur more frequently in families living with low socioeconomic status, placing a disproportionate burden on an already vulnerable population. Parents in this group tend to be employed in jobs that do not include the benefit of parental leave. Considering that attachment relationships form as the result of bonding transactions during a critical time in development, limiting contact curtails secure attachment. Founded in 1934, The New York City Housing Authority (NYCHA) is the nation’s oldest and largest public housing agency. Nearly half a million people live in NYCHA’s 334 housing developments located throughout the five boroughs. If a NYCHA resident wants to garden, he or she may submit a garden application to his or her development’s management office and begin to garden in a place approved by the development’s manager. This article examines the political and social forces surrounding the April 23, 2010 passage of Arizona’s stringent immigration enforcement measure, Senate Bill (S.B.) 1070, which empowered local law enforcement to demand proof of legal residency from any person suspected of being undocumented. A person’s failure to produce documentation would result in arrest, detention, investigation, and potentially deportation to his or her nation of origin. Americans are greatly divided over immigration reform. Public opinion literature provides multiple explanations for these attitudinal differences. One contention in the literature is that the amount of ethnic diversity in one’s neighborhood affects mass attitudes towards immigration reform. Within this literature, some scholars argue that ethnic diversity triggers more negative attitudes towards immigration. Others posit that ethnic diversity is associated with positive attitudes towards immigration. In this paper, I seek to contribute to this debate by exploring the role of ethnic diversity in one’s neighborhood in shaping public attitudes toward immigration reform.
