Zoning Ordinances And "Free Speech", Alan C. Weinstein

Law Faculty Articles and Essays

Over the past two decades there has been a marked expansion in legal challenges to local land use regulations claiming violations of the free speech clause of the First Amendment to the United States Constitution. First Amendment claims can arise whenever government enacts or enforces zoning or other regulations that deal with uses such as billboards or adult entertainment businesses. This article discusses why this litigation is taking place, provides an overview of First Amendment law, and offers local officials some guidelines to help avoid potential legal challenges.

The Impact Of Neighborhoods, Schools, And Malls On The Spatial Distribution Of Property Damage, Teresa C. Lagrange

Using data obtained from three different sources, principles derived from routine activities theory are used to predict the distribution of minor property crimes in a medium-sized Canadian city during a 1-year period. Mischief and vandalism incidents recorded by the local police, transit department, and department of parks and recreation are aggregated by census enumeration area using mapping software, and analyzed in relation to three sets of predictors: (1) neighborhood demographic characteristics; (2) the proximity of shopping malls; and (3) the proximity of public and Catholic senior and junior high schools. Community-based organizations (CBOs) today seek improved capacity to address environmental problems in urban neighbourhoods. Many seek access to information technologies such as the Internet and Geographic Information Systems (GIS) to expand information about their neighbourhood's environmental quality to support their planning and service efforts. Experience with the Internet has been bolstered somewhat by programmes to create community networks. This experience and experience with GIS in planning at the municipal and state levels reveals a set of technical, organizational and personal prerequisites that bolster successful and effective adoption of information technologies. A “Dark Side” Of Communication Avoidance: Indirect Interpersonal Aggressiveness, Michael J, Beatty, Kristin M, Valencic, Jill E. Rudd, Jean A. Dobos

Although our understanding of direct forms of verbal aggressiveness has been greatly advanced over the past decade, indirect interpersonal aggressiveness has remained relatively understudied. In the present study, items designed to tap indirect forms of interpersonal aggressiveness were written, administered to participants, factor analyzed along with verbal aggressiveness items, and correlated with a criterion measure. Results produced an internally consistent set of item which: (1) loaded on a separate factor from verbal aggressiveness items, (2) contributed unique variance over that accounted for by verbal aggressiveness in the prediction of psychoticism, a theoretically appropriate criterion variable for validating aggression measures, and …

Low Self-Control And Opportunity: Testing The General Theory Of Crime As An Explanation For Gender Differences In Delinquency, Teresa C. Lagrange, Robert A. Silverman

This research tests Gottfredson and Hirschi's general theory of crime as an explanation for gender differences in the delinquency of approximately 2,000 Canadian secondary school students. Separate psychological factors, including a preference for risk seeking, impulsivity, temper, present oriented, and carelessness, are used as measures of self-control, and additional measures of the construct are taken from the frequency of self-reported smoking and drinking. Elements of delinquent opportunity are controlled for by including measures of parental/adult super-vision. These measures and their interactions are used to predict self-reported general delinquency, property offenses, violence, and drug offenses. Results provide partial support for the …

The Great Lakes Environmental Finance Center conducted a technical assistance workshop for Gary, Indiana officials on June 29, 1999. This workshop represented an important step in the city’s efforts to address its brownfields cleanup and redevelopment needs. The city has begun its participation in a regionally-awarded brownfields pilot grant from the U.S. Environmental Protection Agency (EPA). The workshop agenda focused discussion on overcoming the barriers to brownfields redevelopment and the financing basics of brownfields redevelopment. These topics were discussed in the context of the redevelopment of the Airport Development Zone and a major area of Gary’s waterfront.

Research into the relationship between housing and health has frequently been narrowly focused, fragmented, and of marginal practical relevance to either housing or health studies. Population health research, in its reference to the importance of the social and physical environment, rarely mentions housing. While it has been recognized for some time that there is a need for the development of a co-ordinated, integrated and cumulative body of housing and health research, there is still very little formal co-ordination between housing policy and population health policy. In May 1999, the Great Lakes Environmental Finance Center (GLEFC) conducted a strategy-building workshop in Duluth, Minnesota. The purpose of the workshop was to assist the City of Duluth in its efforts to develop actions leading to the successful redevelopment of the USX/Cement Plant site. Particular emphasis was placed on financing strategies pertinent to properties with a history of environmental contamination, often characterized as brownfields. This year's report concentrates on recent legal developments concerning regulation of the location of "adult entertainment businesses." Such regulations raise serious constitutional issues because the First Amendment's guarantee of freedom of expression extends to non-obscene sexually oriented media. The U.S. Supreme Court, however, has established that local government may single out adult businesses for special regulatory treatment in the form of locational restrictions if the local government can show a substantial public interest in regulating such businesses unrelated to the suppression of speech and if the regulations allow for "reasonable alternative avenues of communication," which essentially translates into a reasonable …

Nonprofit organizations play a pivotal role in recent efforts to devolve public responsibilities to lower levels of government and other sectors. The capacity of these organizations to serve as the public safety net, however, has come under question. This multiphase research project focused on the impact of welfare reform on community-based nonprofits in Cuyahoga County, Ohio. The study includes surveys, focus groups, and a case study. Results to date strongly suggest that, in spite of their importance to the welfare reform effort, the capacity of smaller nonprofits to adopt the business-oriented approach required to meet the expectations of government contracts …
