Houve tempo em que a Constituição servia para poisar ou charuto ou tirar um argumento político, como ironicamente afirmaria o grande escritor oitocentista Eça de Queiroz. Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

Culture And Technological Innovation: Impact Of Institutional Trust And Appreciation Of Nature On Attitudes Towards Food Biotechnology In The U.S. And Germany, Hans Peters, John Lang, Magdalena Sawicka, William Hallman

Using ‘general trust in institutions’ and ‘concepts of nature’ as examples, the article analyzes the influence of cultural factors on sense-making of food biotechnology and the resulting public attitudes in the USA and Germany. According to the hypotheses investigated, different levels of trust and appreciation of nature explain part of the well-known differences in attitudes between both countries. The analysis of a cross-cultural survey of the general population shows that appreciation of nature is a predictor of attitudes in both countries. The higher appreciation of nature in Germany partly explains why attitudes towards food biotechnology are more negative in Germany …

Consumers in the United States and Europe have not fully embraced genetically modified (gm) foods. In the United States, public opinion remains undecided, whereas in Europe, people tend to regard such foods in a negative light. While opposition to gm products may be more vigorous in Europe, consumer enthusiasm for these foods is actually quite limited on both sides of the Atlantic. “Utilization And Cost Of Mental Health, Substance Abuse, And Medical Services Among At-Risk Drinkers, Michael T. French, Paul J. Nieter, Joann E. Kirchne, Brenda M. Booth

The objective of this research was to examine whether users of mental health or substance abuse (MH/SA) services incurred greater costs for non-MH/SA services than nonusers of MH/SA services. Two years of health care utilization data were collected on 443 at-risk drinkers from six southern U.S. states. We then examined predictors of using MH/SA services and costs associated with non-MH/SA services. The results showed that use of MH/SA services was associated with female gender, military service, health insurance, and not being employed full-time. Unadjusted analyses indicated that non-MH/SA service costs were significantly higher among MH/SA service users than nonusers. However, …

The educational attainments of Beijing’s permanent ethnic minority population out perform or are on par with the dominant, local Hans. Yet, the Han demographic disproportionately dominates the high-wage, education-intensive employment sectors. What accounts for this paradox? What does this signify regarding the management of ethnic difference in the capital city? And how do we improve this situation? Drawing upon recent research, this paper will offer sociological explanations to answer these questions. Moreover, it will further suggest strategies for enhancing the development of ethnic minorities in Beijing.

A Liberdade de Informação poderá ser simultaneamente defendida pelo dever de abstenção do Estado na esfera de exercício privado (não perigoso) de cada cidadão ou grupo “ordeiro” de cidadãos, e pelo dever de protecção dos cidadãos e das suas pessoas morais (incluindo obviamente associações e empresas) nos casos em que a ordem natural da rede social equitativa seja rompida, designadamente por fenómenos de massificação arregimentadora, trusts anti-concorrência, violação de direitos fundamentais, etc., e, no limite, crime. Mas o discernimento e ponderação terão que ser muito grandes.

Iatrogenesis is a term typically reserved to express the state of ill health or the adverse outcome resulting from a medical intervention, or lack thereof. Three types of iatrogenesis are described in the literature: clinical, social and cultural. This paper introduces a fourth type, technological iatrogenesis, or emerging errors stimulated by the infusion of technological innovations into complex healthcare systems. While health information technologies (HIT) have helped to make healthcare safer, this has also produced contemporary varieties of iatrogenic errors and events. It has become nearly axiomatic in this country to argue that everything would be better off if it were run like a business. In response, government has shifted its mission: if it used to operate like Super Glue, bonding Americans to one another, it is now working more like WD-40, minimizing friction in the pursuit of individual (and corporate) profit. Social Security is not only the largest government program, but the embodiment of the Super Glue approach to politics: the ultimate test case for privatization.
