Harmonisation In The Rules Governing The Recognition Of Foreign Judicial Ship Sales, Yingfeng Shao Jan 2023

Harmonisation In The Rules Governing The Recognition Of Foreign Judicial Ship Sales, Yingfeng Shao

World Maritime University Ph.D. Dissertations

Ships, the high-value asset used in both seagoing and inland navigation, and in which various legal and natural persons have interests, must be secured against legal risks arising from any cross-border legal divergence. Legal certainty of ownership of the ship is therefore desirable but it is under challenge with regard to the judicial sale of a ship: the effects of a judicial sale may be denied in a jurisdiction other than the place where it was sold under the principles of state jurisdiction.

Multiple efforts have been made to address legal uncertainty. Particularly important is a new treaty governing the …

Development Of An Overarching Transboundary Geospatial Framework: Selected Regimes In Perspective, Bryan Buxton-Barnor Jan 2020

Development Of An Overarching Transboundary Geospatial Framework: Selected Regimes In Perspective, Bryan Buxton-Barnor

World Maritime University Ph.D. Dissertations

In the maritime industry, a significant number ofemerging andcomplex challenges occurring, has engagedlimitedattention andtenuousgovernance structures that can hardly deal with such complexities. Hence, the need for practitioners to seekinnovativeplanning approachesfor addressing suchcomplexities, particularly thecumulative impacts on the marine environment. Suchswellingeffect, cannot be overemphasized inthe Gulf of Guinea marine region which lies between Cape Lopez in Gabon andCape Palmas in Liberia. This region, has a long history of conflicting marine uses and unresolved disputes.Prior to 2020, three adjacent nationsin thisregion have engaged in a hostofsovereigndisputes anddomestic conflictsas chronicled in Chapter One. Pressing challengesof this nature, necessitated an extensive interrogation of contemporary literature to help conceptualizeand developan …

Building A National Maritime Security Policy, Adriana Avila-Zúñiga Nordfjeld Nov 2018

Building A National Maritime Security Policy, Adriana Avila-Zúñiga Nordfjeld

World Maritime University Ph.D. Dissertations

The issue of port security raised concerns at the highest levels after the terrorist attacks on September 11, 2001 against the United States. Security threats against ports and vessels acquired a new perspective and in 2002 the International Maritime Organization (IMO) adopted amendments to the International Convention for the Safety of Life at Sea (SOLAS), 1974, introducing Chapter XI-2 - Special measures to enhance maritime security. This set of regulations enshrines the International Ship and Port Facilities Security Code (ISPS Code), which entered into force on 1 July 2004.

This Code establishes a set of measures to enhance the security …

Flag State Performance And The Implementation Of Port State Control In The European Union - A Mixed Methods Approach, Armando Graziano Nov 2018

Flag State Performance And The Implementation Of Port State Control In The European Union - A Mixed Methods Approach, Armando Graziano

World Maritime University Ph.D. Dissertations

The implementation and enforcement of international maritime safety standards by Member States has always represented a key objective for both the International Maritime Organisation (IMO) and the European Commission (EC). In spite of a strong global legal framework for safety at sea, harmonisation has always been a challenge. Two points are relevant here: firstly, the level of implementation and enforcement with international regulations varies significantly among countries; secondly, it is a challenge to determine and/or quantify this level of compliance.

Several attempts have been made by the maritime industry, academic studies and policy-makers to develop an appropriate set of criteria …

Design And Evaluation Of Ballast Water Management Systems Using Modified And Hybridised Axiomatic Design Principles, Lawrence Kuroshi Jan 2017

Design And Evaluation Of Ballast Water Management Systems Using Modified And Hybridised Axiomatic Design Principles, Lawrence Kuroshi

World Maritime University Ph.D. Dissertations

There are two major motivations to this research. The first is based on the concerns raised at the International Maritime Organisation (IMO) MEPC 67 and 68 meetings regarding the capacity of some type-approved Ballast Water Management (BWM) Systems to meet the performance standard (D-2) of the BWM Convention at-all-times and in all conditions. The second is based on the reluctance expressed by some ship- owners to install the system onboard their ships as a Lloyd's list survey suggested.

In this work, an attempt was made to address these issues and concerns using a set of criteria stipulated in Regulation D-5.2 …

A Holistic Risk-Oriented Framework For Port Infrastructure Adaption To Climate Change, Kana Nkasanga Patrick Mutumbo Jan 2017

A Holistic Risk-Oriented Framework For Port Infrastructure Adaption To Climate Change, Kana Nkasanga Patrick Mutumbo

World Maritime University Ph.D. Dissertations

This research is the first attempt in developing a broad-based qualitative tool for assessing climate risk in ports and building resilience. In order to demonstrate the applicability of the conceptual tool, the new Durban Dig-Out Port (DDOP) under development in the City of Durban (South Africa) is used for case study. Central to this research is the building of widespread industry recognition of the need to factor climate change into decision making at early stages of port development.

The recent significant shift toward supply chain management and customer orientation practices calls for the need to assess the effectiveness of port …

Development Of The Framework For A Lean, Energy Efficient, And Environmentally Friendly Port: Umm Qasr Port As A Case Study, Safaa A.J. Alfayyadh Jan 2017

Development Of The Framework For A Lean, Energy Efficient, And Environmentally Friendly Port: Umm Qasr Port As A Case Study, Safaa A.J. Alfayyadh

World Maritime University Ph.D. Dissertations

The research focus is to examine rigorously how the implementation of Lean within the Umm Qasr Port improves the operation processes and to explore the Lean impact on environment improvement and energy efficiency management. In this research, the ROPMEE model has been developed by the researcher to evaluate the service quality in the cargo delivery process in the Port of Umm Qasr as it covers all the functional and non-functional areas in the cargo delivery process compared to other quality dimensions. The findings confirm that the process quality dimension is the most influential factor in service quality in the Port …

Virtual Aids To Navigation, R. Glenn Wright Jan 2017

Virtual Aids To Navigation, R. Glenn Wright

World Maritime University Ph.D. Dissertations

There are many examples of master, bridge crew and pilot errors in navigation causing grounding under adverse circumstances that were known and published in official notices and records. Also dangerous are hazards to navigation resulting from dynamic changes within the marine environment, inadequate surveys and charts. This research attempts to reduce grounding and allision incidents and increase safety of navigation by expanding mariner situational awareness at and below the waterline using new technology and developing methods for the creation, implementation and display of Virtual Aids to Navigation (AtoN) and related navigation information. This approach has widespread significance beyond commonly encountered …
