In prison, surveillance is power and power is sexualized. Sex and surveillance, therefore, are profoundly linked. Whereas numerous penal scholars from Bentham to Foucault have theorized the force inherent in the visual monitoring of prisoners, the sexualization of power and the relationship between sex and surveillance is more academically obscure. This article criticizes the failure of federal courts to consider the strong and complex relationship between sex and surveillance in analyzing the constitutionality of prison searches, specifically, cross-gender searches. The analysis proceeds in four parts. Part One introduces the issues posed by sex and surveillance. Part Two describes the sexually …

Rethinking Critical Mass In The Federal Appellate Courts., Laura Moyer

This article draws from critical mass studies of gender in other political institutions to inform an application to the US Courts of Appeals. The results demonstrate the utility of considering court-level aspects of diversity. As mixed-sex panels become more common within a circuit, both male and female judges increasingly support plaintiffs in civil rights claims, though the magnitude of the effect is larger for women. The presence of a female chief judge is also positively associated with pro-plaintiff decisions by men and women in sex discrimination cases.

During the Great Depression, with conditions grim, entertainment scarce, and educational opportunities limited, many South Dakota farm women relied on reading to fill emotional, social, and informational needs. To read to any degree, these rural women had to overcome multiple obstacles. Extensive reading (whether books, farm journals, or newspapers) was limited to those who had access to publications and could make time to read. The South Dakota Free Library Commission was valuable in circulating reading materials to the state's rural population. In the 1930s the commission collaborated with the USDA's Extension Service in a popular reading project geared toward South …

The editorial content of piano method books published in the nineteenth century contributed to the gendering of the domestic piano by targeting a middle-class female audience. At the same time, these tutorials circumscribed the ability and ambition of female pianists, cautioning women against technical display or performing challenging pieces in company, thereby reinforcing the stereotype of the graceful, demure woman who played a little. However, this effort was complicated by both the tutorials themselves and contemporary fiction. The middle-class women reading these tutorials also read novels—a fact the method books occasionally acknowledge—which often presented a very different picture of women’s …

This examination of late Victorian journalism reveals that one type of clothing offered middle-class women protection from street harassment: cross-cultural dress. In appropriate ethnic attire, reporters and social investigators ventured into the immigrant communities that made up a part of England’s urban poor, exploring such trades as Jewish fur-puller or Italian organ-grinder. This incognito ethnic attire afforded women both the means and the authority to carry out their investigations into the Italian constituency of the Victorian working poor. This study also examines how costumes enabled female investigators to manipulate class- and gender-based assumptions about who had broad access to the …

Between 2001 and 2004, six high-status women were charged with crimes in connection with corporate criminal cases. The public is familiar with some of them, although not all of their cases have been covered equally in the press. With the exception of an occasional article now and then mentioning the exploding rates of female incarceration, women's crime tends to be invisible to the public eye. The statistical data the government collects and analyzes on women and crime will be discussed. Although the negative health effects of intimate partner violence (IPV) are well documented, little is known about the mechanisms or determinants of health outcomes for women who had left their abusive partners. Using data collected from a community sample of 309 Canadian women who left an abusive partner, we examined whether women's personal, social and economic resources mediate the relationships between the severity of past IPV and current health using structural equation modelling. A good fit was found between the model and data for hypothesized models of mental and physical health. In the mental health model, both the direct and …

This study examines the educational persistence of women of African descent (WOAD) in pursuit of a doctorate degree at universities in the southeastern United States. WOAD are women of African ancestry born outside the African continent. These women are heirs to an inner dogged determination and spirit to survive despite all odds (Pulliam, 2003, p. 337).This study used Ellis’s (1997) Three Stages for Graduate Student Development as the conceptual framework to examine the persistent strategies used by these women to persist to the completion of their studies.

Women are now the majority of students in institutions of higher education in the United States, and in many ways women as students and faculty have seen significant progress. But numbers do not tell the whole story. Subtle forms of discrimination continue to exist, and the higher up the pyramid you go, the fewer women are to be found, whether among tenured faculty, as presidents and provosts or as board members and board chairs. Many steps can be taken to improve the situation. Some institutions are recognizing that. We note some positive changes and discuss areas where improvement is needed. …

The arrests, detentions, prosecutions, and other legal actions taken against drug-dependent pregnant women distract attention from significant social problems, such as our lack of universal health care, the dearth of policies to support pregnant and parenting women, the absence of social supports for children, and the overall failure of the drug war. The attempts to “protect the fetus” undertaken through the criminal justice system (as well as in family and drug courts) actually undermine maternal and fetal health and discourage efforts to identify and implement effective strategies for addressing the needs of pregnant drug users and their families. In this essay, I present the voices of homeless women to illustrate the empowering impact of popular education on their lives. Popular education is a methodology of teaching and learning through dialogue that directly links curriculum content to people's lived experience and that inspires political action (Beder, 1996; Freire, 1985, 1990; Williams, 1996). On the basis of 5 years of ethnographic research in a shelter-based popular-education program, I describe how popular education approaches inspired a sense of community among a group of 50 homeless women of color. While women have continued to increase their representation in the paid workforce, their representation on corporate boards in Australia remains very low. In this paper, the views of men and women board members of publicly-listed companies in Australia concerning the adequacy of the composition of boards and the factors contributing to women’s low representation are explored and contrasted. It seems that these “successful” men and women have significantly different views on the benefits of homogeneity or diversity of board membership.
