Employers are required to verify the identity and employment eligibility of any person employed by the organization. The U.S. Citizenship and Immigration Service is responsible for the documentation of alien employment authorization, for Form I-9 itself, and for the E-Verify employment eligibility verification program.

This Technical Bulletin provides information about the Immigration Reform and Control Act of 1986. The act was intended to further control the influx of illegal aliens into the U. S. through increased border enforcement. The act also prohibits employment of illegal aliens and aliens, such as tourists, who legally enter the country, but are not authorized to be employed here.

On November 6, 1986, the President signed into law immigration reform legislation. The new law (P.L. 99-603, "Immigration Reform and Control Act of 1986" ) makes it unlawful for any person knowingly to hire, recruit or refer for a fee any alien not authorized to work. It also requires that employees comply with the employment verification system as outlined by the law.
