Legislator Judges: The Warren Court And Justices' Use Of State Or International Policies In Criminal Procedure Cases, John R. Hermann
Legislator Judges: The Warren Court And Justices' Use Of State Or International Policies In Criminal Procedure Cases, John R. Hermann
Political Science Faculty Research
The Warren Court went to great lengths to expand criminal defendants' rights, and in doing so it frequently relied on state majoritarian institutions' policies or international norms to accomplish its goals. The Court and justices were almost twice as likely to use state laws than international policies in their reasoning. The Court was also almost two-and-a-half times more likely to use state or international policies in its rationale when deciding in favor of the criminal defendant in relation to the state's interest.

Traditional, Democratic, Accountable? Navigating Citizen-Subjection In Rural South Africa, Robin L. Turner
Scholarship and Professional Work - LAS
Nearly two decades after South Africa’s democratization, questions of tradition and accountability continue to trouble the polity as more than 14 million black South Africans remain subject to state-recognized, so-called “traditional” leaders – kings, queens, chiefs and regents. This article deepens our understanding of contemporary governance by exploring the agency of these citizen-subjects through close examination of traditional leaders’ strategies and citizen-subjects’ mobilizations in four rural localities. These cases illustrate how citizen-subjects are working with, against and through traditional leaders and councils, hybrid organizations and independent groups to pursue community development and effective, accountable governance, and show how the present …

The Effects Of State Leader Psychology On Civil War Lethality, Brandon Kelley
Electronic Theses and Dissertations
Does a state leader's psychology influence lethality in civil wars? This thesis analyzes the aforementioned question during post-1945 civil wars. The psychology of the state leader in this thesis is assessed from leadership traits and operational code indices, specifically direction of strategy (I1) and interpretation of the nature of the political universe (P1). The data and cases used are pulled from datasets by …

Lived Experience From The Inside Out: The Social And Political Philosophy Of Edith Stein, Antonio Calcagno
Antonio Calcagno
While most works devoted to Edith Stein’s philosophical legacy focus on her later, more explicitly Christian works, including Finite and Eternal Being, this comprehensive account offers readers a look into the early social and political philosophy of Stein before her conversion to Catholicism. During this period, Stein produced a significant body of philosophical work drawing on advancements in phenomenology, psychology, philosophy of mind, and sociology. As Antonio Calcagno demonstrates, this leads to a rich account of society, community, and the state through Stein’s analysis of certain states of mind, psychology, and a defense of a law-centered state community. Lived Experience …

Incorporating A Class Analysis Within The National Question: Rethinking Ethnicity, Class And Nationalism In Cyprus, Umut Bozkurt, Nicos Trimikliniotis
Nicos Trimikliniotis
This article has two main aims. Firstly, it aims to challenge the widespread narrative in Cyprus studies that presents ethnic identities as historically inevitable and natural. Rather, identities need to be conceptualized as socially constructed. The second aim of this article is to problematize the argument that ethnic or national groups are homogenous actors. It underlines the need to deconstruct these supposedly unitary actors by making use of a class-based conceptualization of the state. By using such a conceptualization, the article will focus on the period between 1878 and 1974. It will start with a concrete analysis of the class …
