Prosecutorial Misconduct: Typologies And Need For Policy Reform, Rylee Broyles, Tamara J. Lynn
Prosecutorial Misconduct: Typologies And Need For Policy Reform, Rylee Broyles, Tamara J. Lynn
Academic Leadership Journal in Student Research
A gross manifestation of injustice within the criminal justice system, warranting policy development to correct, is the issue of prosecutorial misconduct. There are numerous reasons why misconduct occurs and oftentimes overlooked within the courts. Action must be taken to both prevent and rectify such wrongdoings committed by those whom are presumed to be the most virtuous of our justice system. Future policy action is paramount to the constitutionality of criminal proceedings and the abatement of prosecutorial misconduct in every capacity. The implementation of austere policies would positively impact all criminal defendants whom cross the threshold of a courthouse.

Bureaucracy, Civil Society And Ideology In Latin America, Grazielli Faria Zimmer Santos, Paula Chies Schommer
Gobernar: The Journal of Latin American Public Policy and Governance
This essay analyzes how political and ideological changes affect public bureaucracy and its relationship with civil society regarding different strategies of openness to participation. We suggest a theoretical-conceptual framework to discuss aspects of the political situation in Latin America. First, we discuss the changes that occurred over time, in the state-civil society relationship, which strengthen the latter and amplify a discourse for more participatory democracy. The focus is the role of the public bureaucracy in mediating the relations among the several actors in society, and we examine the way different political and ideological strands influence how open to participation the …

New Documents Shed Light: Why Did Peacekeepers Withdraw During Rwanda’S 1994 Genocide?, Emily A. Willard
Genocide Studies and Prevention: An International Journal
Why did the international community decide to withdraw United Nations peacekeeping troops from Rwanda during the 1994 genocide? Analysis of newly released documents and results from an international conference with former U.N. and government officials sheds further light on our understanding of what took place leading up to and during the Rwandan genocide. This article focuses on two key moments: 1) the United States’ reluctance to support the peacekeeping mission from before its mandate began and prior to the killing of U.S. troops in Somalia in autumn 1993; and the United States’ central role pushing the United Nations Security Council …

Informal Rulemaking And Democratic Participation Fda – Food Labeling, Fcc – Net Neutrality, A Text Mining Study, Casey Shannon
Public Administration Master’s Projects
The Administrative Procedure Act (APA) is supposed to make the rulemaking process at the administrative level democratic. This study will look at two examples of federal regulatory agencies – Food and Drug Administration (FDA) and the Federal Communications Commission (FCC). The topics are food labeling, and net neutrality respectively. The APA highlights the process of notice and comment rulemaking. The APA is evaluated in the literature review for effectiveness and shortcomings. Interest groups play a key role in the policy making process; interest groups inform and mobilize citizens, and then coordinate commenting on agency rule propositions. This can sometimes lead …

Creativity And Budgeting: Improving The Budget Process With Creativity, Janet K. Stormes
Creativity and Change Leadership Graduate Student Master's Projects
In this master’s project I explore ways to improve a budget process by integrating the principles and tools of creativity and Creative Problem Solving. I do this by prototyping, testing, and revising a creativity-budget model. The creativity-budget prototype model was based on my professional experience in federal budgeting and a literature review on topics including governance, the budget process, stakeholders, collaboration, the impact of the budget process on the creativity of an organization, and the principles of creativity and creative problem solving. In July 2018, I tested the prototype model by conducting creativity-budget workshops in Myanmar. Based on my experience …

Just over 20 years ago, states and civil society came together to put an end to the harm inflicted by antipersonnel mines. The result was the ground-breaking Anti-Personnel Mine Ban Convention in 1997. Better known as the Ottawa Treaty, it prohibited the use, stockpiling, production, and transfer of anti-personnel mines. It also created time-bound legal obligations requiring the destruction of all stockpiles, the clearance of all mined areas, and assistance for landmine victims.

The peaceful use of unmanned aerial systems (UAS) increases significantly when their cost and complexity are reduced. Fully autonomous, ultralight unmanned aerial vehicles (UAV) are now commercially available. There are numerous UAS applications in humanitarian mine action (HMA), environmental research and survey, and urban infrastructure management and maintenance.

Drones Supporting Mine Clearance In Northern Sri Lanka, Oliver Gerard-Pearse
The Journal of Conventional Weapons Destruction
The humanitarian mine action (HMA) community’s nascent adoption of commercial drone technology has no doubt made a positive impact within the sector. However, drones go underutilized in HMA and many opportunities as well as potential pitfalls remain. Nurturing and developing this technology to assist in an increasingly diverse and evolving industry will benefit the community greatly. However, drones have only recently drawn the public eye with considerable strides forward in developing technology that is now available and financially accessible to the general public. Popular commercial brands are appealing more to the budding photographers and video bloggers that are able to …

The Journal of Conventional Weapons Destruction
The Sri Lankan Civil War (July 1983–May 2009), between the government and the Tamil Tigers, was a conflict marked by the extensive use of explosive weapons. Predominantly affecting the majority-Tamil areas in the north and east (Tamil Eelam), the violence left deep scars upon the communities in these areas. The land is still heavily marked by the legacy of landmines, air-dropped bombs, and other explosive remnants of war (ERW).

Demining The Tajik-Uzbek Border: What Have We Learned From The Tajik Experience?, Henrique Garbino, Erkin Huseinov
The Journal of Conventional Weapons Destruction
Following the recent political rapprochement between the governments of Uzbekistan and Tajikistan in March 2018, a joint commission was created to investigate the minefields along the Tajik-Uzbek border and schedule their clearance. The Uzbek government first expressed the intention to remove the landmines along its borders in 2004 and later reported the start of unilateral demining operations in 2005 by the Uzbek military. Less than three years later, Uzbek demining teams had reportedly cleared 95 percent of the minefields along the Tajik border. However, this has not been verified by independent organizations, and civilians still fall victim to landmines in …

The Journal of Conventional Weapons Destruction
Aerially-deployed plastic landmines in post-conflict nations present unique detection and disposal challenges. Their small size, randomized distribution during deployment, and low-metal content make these mines more difficult to identify using traditional methods of electromagnetic mine detection. Perhaps the most notorious of these mines is the Sovietera PFM-1 “butterfly mine,” widely used during the decade-long Soviet-Afghan conflict between 1979 and 1989. Predominantly used by the Soviet forces to block otherwise inaccessible mountain passages, many PFM-1 minefields remain in place due to the high associated costs of access and demining. While the total number of deployed PFM-1 mines in Afghanistan is poorly …

Regional cooperation and regional partnerships are an important aspect of creating strong and sustainable humanitarian mine action programs across the globe. Challenges and opportunities endemic to a particular region are best addressed by the experience and expertise of local organizations. Facilitating ways to foster information sharing is an imperative for the success of regional security goals.

The Added Value Of Integrating Uavs Into The Hma Toolkit, Shathel Fahs, Greg Crowther
The Journal of Conventional Weapons Destruction
The rapid and ongoing development of lightweight, powerful, and relatively cheap unmanned aircraft vehicles (UAV)—still commonly referred to as drones—has demonstrated their use in increasingly diverse and imaginative ways across a large number of industries and sectors. They have also captured the public imagination with the prospect of revolutionizing many aspects of how we live and work. Humanitarian mine action (HMA) has not been immune to this process, and a number of organizations have conducted research, trials, and field tests into how they can support and improve the landmine and explosive remnants of war (ERW) survey and clearance process.

Commons: Can This Be The Name Of ‘Thirdness’? (Revised), Roger A. Lohmann
Faculty & Staff Scholarship
In 1995, a journal article asked if 'commons' might be the name of 'thirdness'. In this revision of that article the question is renewed and reintroduced. The concept of the commons and common goods still offer satisfactory ways to label and characterize voluntary action outside markets, states and households. Theory is said to be a problem of language. Language creativity, including the coining of various new terms is a characteristic part of the commons theory of voluntary action. The remaining challenge is how the concept of the commons can relate to the other side of the third sector - the …

The article is the first to take an inclusive look at the monumental problem of crime exposure during childhood, which is estimated to be one of the most damaging and costly public health and public safety problem in our society today. It takes-on the challenging task of ‘naming’ the problem by coining the term Comprehensive Childhood Crime Impact or in short the Triple-C Impact. Informed by scientific findings, the term embodies the full effect of direct and indirect crime exposure on children due to their unique developmental characteristics, and the spillover effect the problem has on our society as …
Chinese Government’S Inability To Use Film – One Of The Most Powerful Cultural Tools Of Soft Power Expansion – To Achieve Its Soft Power Expansion Goals: Lessons For China To Tackle Its Soft Power-Deficit Problem, Kyungin Kim
International Political Economy Theses
Many scholars of Chinese soft power commonly believe that despite the fact that China has been working hard to achieve successful soft power expansion, one of the biggest factors that leads to Chinese soft power deficit or failure of the Chinese government to effectively trump “China threat” is its inability to use its cultural industries as a tool to fulfill its soft power expansion goals. This is a major obstacle to China in achieving its goal of successful Chinese soft power expansion, as it is said that culture is the most traditional and powerful source of soft power expansion. This …
