Imprisonment is a growth industry in Australia. Over the past 30-40 years all state and territory jurisdictions have registered massive rises in both the absolute numbers of those imprisoned and the per capita use of imprisonment as a tool of punishment and control. Yet over this period there has been surprisingly little criminological attention to the national picture of imprisonment in Australia and to understanding jurisdictional variation, change and continuity in broader theoretical terms. This article reports initial findings from the Australian Prisons Project, a multi-investigator Australian Research Council funded project intended to trace penal developments in Australia since about …

Criminal Laws: Materials And Commentary On Criminal Law And Process In Nsw, Alex Steel, David Brown, David Farrier, Sandra Egger, Luke Mcnamara, Michael Grewcock, Donna Spears
David C. Brown
The success of Criminal Laws lies both in its distinctive features and in its appeal to a range of readerships. As one review put it, it is simultaneously a “textbook, casebook, handbook and reference work”. As such it is ideal for criminal law and criminal justice courses as a teaching text, combining as it does primary sources with extensive critical commentary and a contextual perspective. It is likewise indispensable to practitioners for its detailed coverage of substantive law and its extensive references and inter-disciplinary approach make it a first point of call for researchers from all disciplines. This fifth edition …

Reflections And Perspectives On Reentry And Collateral Consequences, Michael Pinard
Michael Pinard
This essay addresses the continued and dramatic increase in the numbers of individuals released from correctional institutions and returning to communities across the United States. It provides a brief history of the collateral consequences of criminal convictions, and the ways in which these consequences impede productive reentry. It then highlights national and state efforts to address to persistent reentry obstacles and to better understand the range and scope of collateral consequences. It concludes by offering suggestions for reform.

Unanswered Questions Of A Minority People In International Law: A Comparative Study Between Southern Cameroons & South Sudan, Bernard Sama Mr
Bernard Sama
The month July of 2011 marked the birth of another nation in the World. The distressful journey of a minority people under the watchful eyes of the international community finally paid off with a new nation called the South Sudan . As I watched the South Sudanese celebrate independence on 9 July 2011, I was filled with joy as though they have finally landed. On a promising note, I read the UN Secretary General Ban Ki-moon saying “[t]ogether, we welcome the Republic of South Sudan to the community of nations. Together, we affirm our commitment to helping it meet its …

The powerful oxycodone, OxyContin, first manufactured in 1996 and designed for timerelease pain relief, found aready population in rural hamlets and mountain communities. Intended for patients in pain associated with terminal disease, it became a drug of abuse as it was over-prescribed andtrafficked. This Justice and Safety Research Bulletin describes the sudden growth in the use of this new drug and its antecedents. Effective Police Management Of The Media, Brian Kingshott
Effective Police Management Of The Media, Brian Kingshott
Brian F. Kingshott
The adoption of the community policing philosophy identifies the need for closer ties to the community by keeping them informed of their police department’s actions and strategies. The major conduit for this information is not the new departmental website but by the media; radio, television, and newsprint. That places a responsibility on the police (and other law enforcement agencies) to establish a police-media relationship based upon mutual respect and trust. This paper examines the roles of the media and the police in serious incident investigations and questions whether the police-media relationship could be improved by training. Keywords: police; media; management; …
Thinking Like Thinkers: Is The Art And Discipline Of An "Attitude Of Suspended Conclusion" Lost On Lawyers?, Donald J. Kochan
Thinking Like Thinkers: Is The Art And Discipline Of An "Attitude Of Suspended Conclusion" Lost On Lawyers?, Donald J. Kochan
Donald J. Kochan
In his 1910 book, How We Think, John Dewey proclaimed that “the most important factor in the training of good mental habits consists in acquainting the attitude of suspended conclusion. . .” This Article explores that insight and describes its meaning and significance in the enterprise of thinking generally and its importance in law school education specifically. It posits that the law would be best served if lawyers think like thinkers and adopt an attitude of suspended conclusion in their problem solving affairs. Only when conclusion is suspended is there space for the exploration of the subject at hand. The …

Legal Mechanization Of Corporate Social Responsibility Through Alien Tort Statute Litigation: A Response To Professor Branson With Some Supplemental Thoughts, Donald J. Kochan
Legal Mechanization Of Corporate Social Responsibility Through Alien Tort Statute Litigation: A Response To Professor Branson With Some Supplemental Thoughts, Donald J. Kochan
Donald J. Kochan
This Response argues that as ATS jurisprudence “matures” or becomes more sophisticated, the legitimate limits of the law regress. The further expansion within the corporate defendant pool – attempting to pin liability on parent, great grandparent corporations and up to the top – raises the stakes and complexity of ATS litigation. The corporate social responsibility discussion raises three principal issues about how a moral corporation lives its life: how a corporation chooses its self-interest versus the interests of others, when and how it should help others if control decisions may harm the shareholder owners, and how far the corporation must …

Halfway Back: An Alternative To Revocation For Technical Parole Violators, Michael White, Jeff Mellow, Kristin Englander, Marc Ruffinengo
Marc A. Ruffinengo
Over the past three decades, concomitant increases in prison population and the use of parole, coupled with a more punitive parole philosophy and fiscal crises at every level of government, have prompted a renewed interest in intermediate sanctions— especially for technical parole violators. A number of jurisdictions have developed intermediate sanctions that are both custodial and therapeutic—but do not involve a return to prison—for technical violators. Despite their growing popularity, little research has examined these technical violator programs, and as a result, basic questions regarding their impact remain unanswered. This article examines a therapeutic technical violator program in the state …
Acculturation, Social Context, And Drug Use: Findings From A Sample Of Hispanic Adolescents, Holly Miller
Acculturation, Social Context, And Drug Use: Findings From A Sample Of Hispanic Adolescents, Holly Miller
Holly Ventura Miller
Criminologists have largely neglected the influence of acculturation in the etiology of Hispanic drug use and delinquency. This is somewhat surprising since a long line of research from several disciplines has consistently linked higher levels of acculturation to greater incidence of negative social, health, and behavioral outcomes. A major shortcoming of this extant literature, however, is its failure to consider the acculturation-drug use link within a particular explanatory framework. This study attempts to address this oversight by examining the acculturation-drug use relationship within the context of gang membership, drug availability, and susceptibility to peer influence. Using data from a sample …

Más Vale Malo Conocido Que…: El Efecto Dotación Y Los Pronósticos Teóricos Del Teorema De Coase, Daniel Monroy
Daniel A Monroy C
Some studies of the "endowment effect" in behavioral economics have criticized the theoretical prediction of the Coase Theorem even in its most basic formulation. This document describes the evidence of the existence of this "anomaly" in individual decision-making in various contexts in order to determine the possible general implications of this effect in the economic analysis itself especially as an explanation for the sometimes, insuperable gap between the willingness to accept for giving a right and the correlative willingness to pay to get it, also the paper describes a contradiction with the assumption of reversibility of preferences at any dot …

Reconsidering Hispanic Gang Membership And Acculturation In A Multivariate Context, Holly Miller, J. Barnes, Richard Hartley
Reconsidering Hispanic Gang Membership And Acculturation In A Multivariate Context, Holly Miller, J. Barnes, Richard Hartley
Holly Ventura Miller
Previous qualitative research has suggested that Hispanic gang membership is linked to the process of acculturation. Specifically, studies have indicated that those who are less assimilated into mainstream American or “Anglo” society are at greater risk for joining gangs. Building on these observations, this study examines the relationship between acculturation and gang membership within a theoretically and empirically informed multivariate framework. Based on a sample of Hispanic adolescents residing in the American Southwest, results largely supported previous qualitative studies that have suggested that a number of factors, including acculturation, are necessary to an understanding of gang membership within this demographic. …

Elizabeth Cady Stanton And The Notion Of A Legal Class Of Gender, Tracy A. Thomas
Elizabeth Cady Stanton And The Notion Of A Legal Class Of Gender, Tracy A. Thomas
Tracy A. Thomas
In the mid-nineteenth century, Elizabeth Cady Stanton used narratives of women and their involvement with the law of domestic relations to collectivize women. This recognition of a gender class was the first step towards women’s transformation of the law. Stanton’s stories of working-class women, immigrants, Mormon polygamist wives, and privileged white women revealed common realities among women in an effort to form a collective conscious. The parable-like stories were designed to inspire a collective consciousness among women, one capable of arousing them to social and political action. For to Stanton’s consternation, women showed a lack of appreciation of their own …
