Safe Haven For Salvadorans In The Context Of Contemporary International Law--A Case Study In Equivocation, Todd Howland, Amy Beer, Tim Everett, Evangeline Nichols Ordaz
San Diego Law Review
This Article analyzes the basis for safe-haven programs for refugees fleeing war and civil strife under contemporary principles of international law. The authors trace the development of safe-haven programs in the United States and offer an analysis and critique of the Temporary Protected Status program created by the Immigration and Nationality Act of 1990. Focusing on the struggle to gain safe haven for refugees from El Salvador, the authors review the United States government's historical use of safe haven programs as a political tool. Finally, the Article looks at how other countries have responded to refugee crises and suggests a …

The problem of jail overcrowding has forced corrections officials and jail administrators to examine ways in which to better manage available jail space. Pretrial release and detention policies have been a target of this examination as pretrial defendants typically account for 50% of a jail's population. Standards for pretrial release exist, but their administration varies by jurisdiction. The impact of jail overcrowding on pretrial release policies has been to decrease the time available to render a decision. Recent efforts to standardize pretrial release standards in Oregon have not addressed the issue of expediency. The current study examines pretrial misconduct (failure …

Attitudes & Opinions Of Circuit Court Judges On The Issue Of Substance Abuse During Pregnancy, Michelle Degeorge

The purpose of this study was to determine the attitudes and opinions of circuit court judges in Kentucky concerning the issue of pregnancy and substance abuse. A questionnaire was mailed to all 90 circuit court judges in Kentucky. The questionnaire, consisting of both a Likert scale and open-ended questions, dealt with concerns relating to the criminalization of pregnant substance abusers, fetal rights, state intervention in the case of pregnant substance abusers, and mothers rights. The ages of the judges, as well as their years of experience on the bench, were used to determine their attitudes on these issues. Results showed …
