Looted Cultural Objects, Elena Baylis
Looted Cultural Objects, Elena Baylis
Articles
In the United States, Europe, and elsewhere, museums are in possession of cultural objects that were unethically taken from their countries and communities of origin under the auspices of colonialism. For many years, the art world considered such holdings unexceptional. Now, a longstanding movement to decolonize museums is gaining momentum, and some museums are reconsidering their collections. Presently, whether to return such looted foreign cultural objects is typically a voluntary choice for individual museums to make, not a legal obligation. Modern treaties and statutes protecting cultural property apply only prospectively, to items stolen or illegally exported after their effective dates. …
Does Electoral Proximity Influence Commitment To International Human Rights Law?, Nolan Ragland
Does Electoral Proximity Influence Commitment To International Human Rights Law?, Nolan Ragland
Baker Scholar Projects
The core international human rights treaties from the United Nations have been signed and ratified by varying groups of states, and much of previous research has been dominated by a desire to explain ratification of international human rights law (IHRL) through the democratic lock-in effect and states’ economic and political ties to one another. In this paper, I seek to understand when states are ratifying IHRL, testing whether the presence of elections influences commitment to three of the nine core international human rights treaties: the International Convention on the Protection of the Rights of All Migrant Workers and Members of …
Language Barriers Among Immigrant Communities, Rosia Aning
Language Barriers Among Immigrant Communities, Rosia Aning
WWU Honors College Senior Projects
This research explores the challenges presented by language barriers among immigrant communities. The study focuses on the impact of limited English proficiency on different aspects of immigrant life, including education, employment, healthcare, cultural integration, and social interactions. Immigrants are individuals who have relocated to a foreign country that is not their country of origin, and they face significant challenges due to language barriers. The inability to communicate effectively with native speakers can lead to social exclusion, economic disadvantage, and restricted access to important resources and information. This project aims to shed light on these challenges and provide potential solutions to …
Post-Conflict Reconciliation In Ukraine, Elena Baylis
Post-Conflict Reconciliation In Ukraine, Elena Baylis
Articles
Reconciliation mechanisms should be a core component of transitional justice in Ukraine. The nature of this conflict as a war justified by claims about history, identity, and legitimacy suggests that there will be a need for post-war reconciliation initiatives. Such reconciliation measures would be intended to enable Ukraine’s Russian, Ukrainian, and other communities to live together constructively within the same state. The goals of social reconciliation also converge with Ukraine’s long-term, political aims vis-à-vis both Russia and the European Union. This paper addresses three types of reconciliation measures that are important for post-conflict Ukraine. Instrumental mechanisms to engage post-conflict social …
Irregular Migration In Morocco: A Case For Constructionism, Mourad Khalil
Irregular Migration In Morocco: A Case For Constructionism, Mourad Khalil
Independent Study Project (ISP) Collection
Separated by only 14 kilometers of water from Spain, Morocco has become a common destination for many sub-Saharan irregular migrants trying to reach Europe. With a large population of these migrants, Morocco has had to make important decisions on how to manage its irregular migrant population. However, the terrible conditions and regular violations of human rights that irregular migrants in Morocco are subject to lead one to ponder the role that international relations has and the extent to which human rights is a consideration in the policymaking of irregular migration. Applied to the three primary theories of international relations, liberalism, …
Sanitary Cordons In Covid-19: Experience And The Object Of Epidemiological Interventions, Alejandro Cerón
Sanitary Cordons In Covid-19: Experience And The Object Of Epidemiological Interventions, Alejandro Cerón
Anthropology: Faculty Scholarship
What is the object of epidemiological interventions during an epidemic? Is it the virus, the disease, the fear, the chaos, or the threat to security? And what is the objective of those interventions? Is it to eliminate the virus, to mitigate the effects of the disease, to calm the fear, to control the chaos, or to defeat the threat?

Rhetoric and International Human Rights: The Case of the Senegalese Talibés
Sponsor: Lynne Derbyshire (Communication Studies, Honors Program)
While in Senegal, I witnessed the hurdles faced by proponents of international human rights standards. Thousands of Muslim boys, called talibés, undertake their Koranic education in Senegal. Many are forced to beg in the streets by their educators, and abuse in the schools is common. Still, this education is considered a valuable part of the boys’ spiritual development. Despite the multitude of countries that have openly supported and ratified international human rights compacts, many …
Backlash To The European Court Of Human Rights: The Case Of Russia, Cole Kovarik, Courtney Hillebrecht
Backlash To The European Court Of Human Rights: The Case Of Russia, Cole Kovarik, Courtney Hillebrecht
UCARE Research Products
Since the end of World War II, the international community has forged human rights accountability systems that have since become increasingly important. The good work done by these international tribunals has come under threat more and more by a process of backlash called tribunal capture, or “the politics of states and individual political leaders seeking to undermine the tribunals by working within the judicialized and legalized landscape of international human rights law” (Hillebrecht). The European Court of Human Rights (ECtHR) is no exception; since its foundation, it has been largely utilized. However, lack of compliance with its rulings remains to …
The Political Development Of Capital Punishment In The Modern Moroccan State, Mia Barr
The Political Development Of Capital Punishment In The Modern Moroccan State, Mia Barr
Independent Study Project (ISP) Collection
The modern Moroccan state seen today is very young. Having only been independent from France since 1956, the country has spent the last sixty-four years crafting its post-colonial statehood. What has emerged is a hybrid political system with powers split, however unequally, between the King and his inner circle, known as the makhzen, and the Parliament. Not only is the monarchy constitutional—meaning that its legitimacy is literally written into the primary governing document of Morocco, which had its last referendum in 2011—but it is also self-sustaining and self-legitimizing, for the monarchy uses its constitutional powers to grant itself further powers …
The United Nations Declaration On The Rights Of Peasants And Other People Working In Rural Areas, Marc Edelman, Priscilla Claeys
The United Nations Declaration On The Rights Of Peasants And Other People Working In Rural Areas, Marc Edelman, Priscilla Claeys
Publications and Research
In December 2018, the United Nations adopted the Declaration on the Rights of Peasants and Other People Working in Rural Areas. UNDROP is the product of 17 years of struggle by La Via Campesina, other transnational agrarian movements and allies that included NGOs, states, UN mandate holders, and academics. It recognises the dignity of rural populations, their contributions to global food production, and their ‘special relationship’ to land, water and nature, as well as their vulnerabilities to eviction, hazardous working conditions and political repression. It reiterates rights protected in other instruments and sets new standards for individual and collective rights …

Glocalised Constitution-Making In The Twenty-First Century: Evidence From Asia, Maartje De Visser, Bui Ngoc Son
Research Collection Yong Pung How School Of Law
How have Asian nations conducted, or how are they conducting, constitution-making in the face of pressures associated with globalization, and how do they balance those forces with domestic interests and realities? This article aims to develop an analytical framework that can capture this global-local interplay. It introduces the concept of “glocalized constitution-making” to denote the co-existence and relationship between the two governance levels as manifested in the forces, actors and norms pertaining to the process of drafting a new constitution as well as its substance. Glocalization permeates the entirety of a constitution-making episode, from the impetus to initiate the process, …
La Vulneración De Los Derechos E Invisibilización Sobre Lxs Migrantes Senegaleses En Caba / The Violation Of Human Rights And The Invisibilization Of Senegalese Immigrants In The Autonomous City Of Buenos Aires, Madeline Doane
Independent Study Project (ISP) Collection
Support For Open Borders: A Case Study Of Spanish Society, Anna Ondracek
Support For Open Borders: A Case Study Of Spanish Society, Anna Ondracek
Honors Theses
In his book “The Ethics of Immigration”, political philosopher Joseph Carens argues for the rights of migrant populations on the grounds of democracy, freedom, and equality. He advocates for open international borders, focusing on democratic countries in North America and Europe. Carens compares the current international order of closed borders to feudalism and discusses various forms of privilege Westerners have, which, he says, makes those in the West complacent and unaware of the injustices from which Westerners benefit. Focusing on the case of Spain, this project evaluates public opinions on the debate over open borders. I survey the support for …

U.S. Congressional Committee Hearings On Korea During The 113th Congress 2013-2014: Overseeing Multifaceted Aspects Of Washington's Peninsular Interests, Bert Chapman
Libraries Faculty and Staff Scholarship and Research
Numerous U.S. government agencies are involved in developing and implementing U.S. policy toward Korean Peninsula events, trends, and developments. Those studying U.S. government policies toward this region need to pay particular attention to the role played by U.S. Congressional committees in this policymaking. Congressional committees are responsible for approving new legislation, revising existing legislation, funding U.S. government programs and conducting oversight of these programs. This work examines Congressional committee hearings and debate during the 113th Congress (2013–2014) and reveals that multiple Congressional committees with varying jurisdictions seek to shape U.S. government Korean Peninsula policy and that this policymaking covers more …

Social Justice And Human Rights In Education Policy Discourse: Assessing Nelson Mandela's Legacy, Abrehet Gebremedhin, Devin Joshi
Research Collection School of Social Sciences
Twenty years after South Africa's democratisation, Nelson Mandela's passing has prompted scholars to examine his legacy in various domains. Here we take a look at his legacy in education discourse. Tracing Mandela's thoughts and pronouncements on education we find two major emphases: a view of education as a practical means to economic development, and education as a means to social justice, human rights, and democracy. Assessing the legacy of these twin emphases, we conducted qualitative and quantitative content analysis of turning point documents in education policy and annual reports from the respective South African ministries of education over the last …

La Búsqueda De Una Agenda En Común: Una Mirada Feminista A Las Organizaciones Lgbti En Nicaragua, Rachel Crane
Independent Study Project (ISP) Collection
In the global context, we are amidst a rapidly changing rights landscape for people who identify as lesbian, gay, bisexual and transgender (LGBT) as more and more governments begin to recognize same-gender partnerships. This gain in LGBT rights worldwide is in no small part to the political organizing and lobbying done by LGBT-rights organizations. Nicaragua’s history with gaining LGBT rights is relatively new, as the government did not repeal the anti-sodomy law here until 2008, thus stagnating the fight for acceptance in the country. As it stands, Nicaragua has a few legal protections for LGBT people, but they continue to …

Ko Ko Gyi [Myanmar, Activist], Ko Ko Gyi
Digital Narratives of Asia
Myanmar democracy activist Ko Ko Gyi spent a total of 17 years in prison for his political beliefs. First detained for his involvement in student protests in 1989, he was eventually released in 2012, along with 600 others, when the military-led government began implementing reforms. Mr Ko Ko Gyi now champions democracy and human rights issues as General Secretary of the 88 Generation Peace and Open Society. He was also a member of the government's Rakhine Investigation Commission to investigate the sectarian violence in Rakhine state. He speaks to DNA about the darkest days of his time in the infamous …

Nepal’s citizens engage in foreign employment at the highest per capita rate of any other country in Asia, and their remittances account for 25 percent of the country’s GDP. The Middle East is now the most popular destination for Nepalis--nearly 700,000 were working in the Middle East in 2011 on temporary labor contracts. For some Nepalis, working abroad provides much-needed household wealth. For others, their contributions to Nepal come at great personal cost. Migrant workers in the Gulf, for example, routinely report wage theft, lack of time off and unsafe and unhealthy working conditions. Some migrant workers report psychological and …
Freedom Of Conscience As Religious And Moral Freedom, Michael J. Perry
Freedom Of Conscience As Religious And Moral Freedom, Michael J. Perry
Faculty Articles
In another essay being published contemporaneously with this one, I have explained that as the concept "human right" is understood both in the Universal Declaration of Human Rights and in all the various international human rights treaties that have followed in the Universal Declaration's wake, a right is a human right if the rationale for establishing and protecting the right-for example, as a treaty-based right-is, in part, that conduct that violates the right violates the imperative, articulated in Article i of the Universal Declaration, to "act towards all human beings in a spirit of brotherhood." Each of the human rights …

Wadla Woreda is located in North Wollo Zone, Amhara Regional State, Ethiopia. The woreda is predominantly agrarian and the population produces mainly subsistence food crops with small amounts of cash crops. Access to basic social and economic services such as health, education, and employment for rural communities is limited due to poor development of rural infrastructure. Wadla is one of the food insecure woredas in the region. As a result some of the people are internally displaced and a portion of the population is included in safety-net programs. The Wadla Woreda is prone to famine due to severe droughts, soil …

Stateless In The United States: Current Reality And A Future Prediction, Polly J. Price
Stateless In The United States: Current Reality And A Future Prediction, Polly J. Price
Faculty Articles
Statelessness exists in the United States-a fact that should be of concern to advocates of strict immigration control as well as those who favor a more welcoming policy. The predominant reasons for statelessness include the presence of individuals who are unable to prove their nationality and the failure of their countries of origin to recognize them as citizens. Migrants with unclear nationality, already a problem for the United States, obstruct efforts to control immigration by the deportation of unauthorized aliens. These existing problems of national identity will increase exponentially if birthright citizenship in the United States is amended to exclude …
