The Last Refuge Hard And Soft Hansonism In Contemporary Australian Politics, Chandran Kukathas, William Maley

The arrival of Pauline Hanson’s One Nation on the Australian political scene hasbeen the subject of much discussion, but there has been little analysis of what itspolicies really mean. Consideration of those policies, or ‘Hard Hansonism,’ inrelation to immigration reveals attitudes that are simplistic, populist, nostalgic anddeeply hostile to Australia’s liberal-democratic tradition.

While domestic politics is divided between Congress and the White House, generally along partisan lines, President Bill Clinton’s al-out engagement policy toward China, announced shortly after he began his second term in office, is aimed at fostering a Sino-US partenship for the twenty-first century. Below, I shall explain that this policy came at the end of three separate policy reviews conducted since Clinton’s first term. Here, though, I would like to note that rationale of the new China policy is in keeping with the requirements of the new world order, to meet the challenge posed by the three attributes identified …

The Justiciability Of Paraguay's Claim Of Treaty Violation, Lori Fisler Damrosch

The U.S. Government's position asserting nonjusticiability of the treaty claims raised by Paraguay in the domestic and international lawsuits is disturbing. The Government's amicus filings at the court of appeals and the Supreme Court denied that Paraguay's claims belonged in federal court (or indeed in any court at all); at the International Court of Justice, the United States admitted a treaty violation but denied the competence of that tribunal to enter a judicial remedy. At one or another phase of these proceedings, the U.S. Government pressed a variety of arguments that (if accepted) would rule out virtually any judicial consideration …

Nine years ago, Kenneth Abbott published an article exhorting international lawyers to read and master regime theory, arguing that it had multiple uses for the study of international law.1 He went as far as to call for a 'joint discipline" that would bridge the gap between international relations theory (IR) and international law (IL). Several years later, one of us followed suit with an article mapping the history of the two fields and setting forth an agenda for joint research. 2 Since then, political scientists and international lawyers have been reading and drawing on one another's work with increasing frequency …

Incumbent national leaders invite foreign election monitors only when it is in their interest to do so. Rarely is significant financial assistance "conditional" on holding elections, although it does improve a regime's image abroad to do so. For governments being observed, the trick is to orchestrate the process enough to win, but not enough to arouse observers' suspicions.
