I knew from a young age that I never wanted children. Whenever I expressed my disinterest in motherhood, I was often met with bewilderment, disapproval, and hostility. The church I was raised in taught me that my value and worth as a woman directly correlated with the power of my birthing hips. This fundamentalist upbringing has significantly shaped my relationship with my femininity, my body, and my artwork. This thesis will examine the limitations in access to abortion and other necessary reproductive healthcare in states that are hostile to abortion rights, as well as discuss the ongoing litigation within those states between pro-choice and pro-life advocates. After analyzing the legal landscape and the different abortion laws within these states, this thesis will focus on the practical consequences of Dobbs on women’s lives, with particular attention to its impact on women of color and poor women in states with the most restrictive laws. Disability-selective abortion stems from a eugenical philosophy not a hope of eradication. Disabilities cannot be eradicated because they are not diseases. Eugenics seeks to purify society from those who are considered “inferior” and to encourage the rate of births considered “superior.” Eugenics continues today through selective abortion of children with disabilities. These children deserve the right to life guaranteed by natural rights, human rights, and the laws of the United States. On June 24, 2022, the U.S. Supreme Court ruled to overturn Roe v. Wade (1973)—a groundbreaking case that legalized the right to have an abortion—which signified a deep rift in the nation between the opinions of its lawmakers and citizens in the wake of a widening partisan gap. Biopower, according to Foucault, can be defined as the governing of bodies wherein citizens are stripped of bodily autonomy and are closely regulated by the nation-state. From Pacifism To Pipe Bombs: A History Of The Extremist Anti-Abortion Movement In The United States, Stella Masucci

This paper traces the history of the extremist wing of the anti-abortion movement, both the violent and non-violent branches, from its origins in the 1970s. The movement began with local, leftwing Catholic groups conducting “sit-ins,” then turned into a massive crusade of fundamentalist conservatives under Randall Terry’s group Operation Rescue. I also examine the movement’s descent into violence in the 1980s and 1990s and the federal government’s response to this threat, namely the Freedom of Access to Clinic Entrances Act in 1994, and how it has shaped both the pacifist and violent branches of the movement in the years since. …

Numerous factual errors are made regarding the issue of abortion. These false claims are made in an attempt to scuttle efforts to restrict abortion. Some of the most frequent claims pertain to the effectiveness of pro-life laws themselves. One such claim is that thousands of women died from unsolicited abortions when the procedure was illegal, and that maternal deaths declined rapidly afterwards due to the legal availability of abortion. Another claim is that laws that either restrict or outlaw abortion are ineffective in reducing abortion rates. Abortion has remained one of the most contentious issues in American political discourse ever since the Supreme Court legalized the procedure in the 1973 decision Roe v. Wade. Numerous emotional, statistical, and even Biblical arguments have been formulated in debates over this topic. The issue of abortion in the political arena became escapable after the 1973 ruling of Roe v. Wade. Nearly 50 years later, the issue of abortion continues to influence voting in all levels of government elections - from President to state governor. Maintaining the accessibility to abortion has been a longstanding battle. While funding for Crisis Pregnancy Centers is increasing, states are cutting funding for abortion clinics (Ludden, 2015) and they are closing at a rate of 1.5 each week (Redden, 2015). Since Roe v. Wade (1973), hundreds of cases have been brought to challenge its legality and limit it as much as possible. This research paper explores the relationship between women in state legislatures and state level abortion restrictions. This relationship is explored, and then tested against the amount of democratic legislators, the conservatism, of the public, and the religiosity of the public using a linear regression. While the findings are complex, they show that women do have an impact on state level abortion restrictions in some instances.

My dissertation had two principal components. First was the development of an argument outlining the five critical differences between abortion and same-sex marriage policy, which highlight the current insufficiency of the existing morality politics framework. These differences were: the duration of the issue, whether it demonstrated an incrementalist of a punctuated equilibrium theory of policy change, the scope of conflict, the degree of institutional entrenchment within the two parties, and the social construction of stakeholders. I then advanced five hypotheses to explain why these differences between the two policy areas in both process and outcome existed, for the purpose of …

Does state legal context modify the association between abortion and distress among women in the United States? Adjusting for individual characteristics that could be associated with distress based on stress and stigma frameworks, I examine if state legal context modifies the association between abortion and distress using a nationally representative sample of American women ages 25-45. The use of state-level factors as a proxy for social context in this research has not been part of previous studies of the consequences of abortion. With its turbulent and volatile legal evolution, the right to an abortion in the United States still remains a highly contested issue and has developed into one of the most divisive topics within modern legal discourse. By deconstructing the political underpinnings and legal rationale of the right to an abortion through a systematic case law analysis, I will demonstrate that this right has been incrementally destabilized. This instability embedded in abortion jurisprudence has been primarily produced by a combination of textual ambiguity in the case law and judicial ambivalence regarding this complex area of law.
