As Latin America faces increasing climate-related health crises that disproportionately affect populations experiencing poverty and social exclusion, it becomes increasingly urgent to realize the most vulnerable's right to health. While the region's new constitutionalism (NLAC) has made progress in protecting this right, it has only recently begun to intersect with climate change law through rights-based climate litigation. This dissertation takes a transdisciplinary multi-methods research approach to answer the following question: How do health crises emerge within, and how are they addressed by courts through, domestic climate litigation in Latin America? Climate change is an existential threat facing humanity, civilization, and the natural world. It poses many multi-layered challenges that call for enhanced data-driven decision support methods to help inform society of ways to address the deep uncertainty and incomplete knowledge on climate change issues. Starting in the early 1980’s, the environmental justice (EJ) movement was critical in drawing much needed attention to how communities of color, low-income groups, Indigenous peoples, and other marginalized groups have experienced a disproportionate burden of environmental and ecological harms. The EJ movement sparked the birth of the EJ field of study. While originally focused on quantitative and distributional understandings of toxic waste in communities of color, the EJ field of study has since expanded to comprise community-based methodologies and new ways to understand justice, including participatory, recognition, and transformational approaches.
