Whose Lands? Which Public?: The Shape Of Public-Lands Law And Trump's National Monument Proclamations, Jedediah Britton-Purdy

President Trump issued a proclamation in December 2017 purporting to remove two million acres in southern Utah from national monument status, radically shrinking the Grand-Staircase Escalante National Monument and splitting the Bears Ears National Monument into two residual protected areas. Whether the President has the power to revise or revoke existing monuments under the Antiquities Act, which creates the national monument system, is a new question of law for a 112-year-old statute that has been used by Presidents from Theodore Roosevelt to Barack Obama to protect roughly fifteen million acres of federal land and hundreds of millions of marine acres. …

FLPMA Turns 40 (October 21)
The Bureau of Land Management (BLM) administers approximately 245 million acres of our public lands and yet, for most of our nation's history, these lands seemed largely destined to end up in private hands. Even when the Taylor Grazing Act of 1934 ushered in an important era of better managing public grazing districts and "promoting the highest use of the public lands," such use of our public lands still was plainly considered temporary, "pending its final disposal." It was not until 1976 with the passage of the Federal Land Policy and Management Act (FLPMA) that congress adopted a policy that …

The Malheur National Wildlife Refuge, a 187,757-acre haven for greater sandhill cranes and other native birds in eastern Oregon, is usually a pretty peaceful place. But its calm was shattered on Saturday, January 2 when Ammon Bundy and a group of armed men broke into and occupied a number of federal buildings on the refuge, vowing to fight should the government try to arrest them. Their insurrectionary goal appears to be, simply put, to destroy the national system of public lands – our forests, parks and refuges – that was developed in the late 19th century to conserve these …

Managed wetlands on public lands in Illinois, United States, provide foraging habitats for migrating and wintering waterfowl. However, few studies have estimated abundances of waterfowl foods in mid-migration regions of North America, yet such information is needed to inform management and conservation decision-making. During 2005– 2007, we used a multistage sampling design to estimate moist-soil plant seed production (kg/ha, dry mass) and energetic carrying capacity at sites managed by the Illinois Department of Natural Resources and modeled variation in seed biomass. The first Intermountain BMP Project workshop, sponsored by the Natural Resources Law Center and the Colorado Oil and Gas Conservation Commission, was held in Rifle, Colorado on October 14, 2009 at the Garfield County Fairground for over 170 participants.
Speakers from Federal, state and local governments, the community, industry and environmental consultants, and conservation groups focused presentations and discussion on a greater understanding of what Best Management Practices (BMPs) are appropriate to the western slope of Colorado and how they are integrated into developments.
