BYU Law Review

Scholarship on the commons focuses on a diverse set of problems, ranging from crashing fisheries to crowded court dockets. Because we find commons resources throughout our natural and cultural environments, understanding old lessons and learning new ones about the commons gives us leverage to address a wide range of problems. Because the list of resources identified as commons resources continues to grow, the importance of gleaning lessons about the commons will also continue to grow.

That being said, while the resources that make up the commons are certainly diverse, so too are the ways scholars depict it and the challenges …

Isolated Wetland Commons And The Constitution, Blake Hudson, Mike Hardig

Isolated wetlands provide great ecological and economic value to the United States. While some states provide protection for isolated wetlands, a great many do not. These wetlands are also left outside the ambit of federal wetland regulatory protections under the Clean Water Act, with its murky jurisdictional reach. Notwithstanding jurisdictional questions under current federal statutes, the U.S. Supreme Court has gone so far as to call into question the constitutionality of federal isolated wetland regulation. This Article makes a normative argument that, in the absence of state or local programs providing holistic isolated wetland protection, federal action is needed. The …

One recurring question in the academic literature on common-pool resources relates to the persistence of “tragic” commons regimes—systems that encourage, or at least tolerate, the inefficient, wasteful, hazardous, or unfair exploitation of a resource that is easily accessed for and diminished by individual use and consumption. Of course, not all commons are tragic: some common-pool resources invite individual access in efficient, fair, and durable ways. Yet many commonly held resources do lie under systems of governance that are not just tragic but persistently and stubbornly so. Show caves provide tourists with the opportunity to have close contact with natural underground spaces. However, visitation to these places also creates a need for management measures, mainly the definition of tourist carrying capacity. The present work describes the results of climate monitoring and atmospheric profiling performed in Santana Cave (Alto Ribeira State and Tourist Park – PETAR, Brazil) between 2008 and 2011. Based on the results, distinct preliminary zones with different levels of thermal variation were identified, which classify Santana Cave as a warm trap. Although governments have deployed an array of environmental protection laws, our planet continues to experience unprecedented environmental “crises,” including climate change, resource depletion, species extinction, ecosystem damage, and toxic air-water-land pollution. Despite universal acknowledgment and recognition of these serious environmental issues, and despite a growing list of laws designed to address these issues, the reality is that these adverse Earth-based environmental changes continue, and may even be worsening. Booming production of oil and gas from shale enabled by hydraulic fracturing technology has led to tension between hoped-for economic benefits and feared environmental and other costs, with great associated controversy. Studies of how policy can best react to these challenges and how it can balance risk and reward have focused on prescriptive regulatory responses and, to a somewhat lesser extent, voluntary industry best practices. While there is undoubtedly room for improved regulation, innovative tools are relatively understudied. In semi-arid river basins like the Yakima River Basin in central Washington State, United States of America, water demand can exceed available supply on an annual basis. More informed decisions about water supply and current allocation have the potential to improve water management. This research created a geospatial water rights database for the Yakima River Basin. The creation of a publicly available decision support system mapping water rights can provide water managers another tool to help achieve this goal. The watershed of the Jordan River stretches over four countries – Jordan, Syria, Israel, and Lebanon – and includes the region of Palestine. With the land and its resources hotly contested by all parties involved, the dwindling supply of drinking and irrigation water from viable sources has led to scrambling exploitation, leaving the river and its connected lakes in an ever-worsening state of deterioration. The Goose

Produced by Karen Miranda Abel with Jessica Marion Barr, Vernal Pool is an immersive, elemental water installation created as a participatory, contemplative inquiry into our transitory interrelationships with water and landscape. From November 2013 to April 2014, 114 individuals across Canada and abroad gathered snow samples as a form of extrinsic artistic practice about place and precipitation. With the arrival of spring, the reservoir of melted snow was convened for four days at Toronto’s historic Gladstone Hotel to create Vernal Pool.

As pointed out by many authors, sustainability is often vague and amorphous (See, for example, Dovers, 1989; Faber, et al, 2005; Glavič, et al. 2007). There is a clear need to make analytical and data-driven analyses of established and or proposed plans. MARKAL (MARKet ALlocation model) is an analytical tool that can be used characterize the impacts of sustainability plans at multiple spatial scales: global, national, regional, and local. Survey Of The Ectoparasites Of The Invasive Small Indian Mongoose (Herpestes Auropunctatus [Carnivora: Herpestidae]) On St. John, U.S. Virgin Islands, Kelsey L. Townsend, Karen E. Powers

Virginia Journal of Science

In March 2012, live trapping surveys were conducted for invasive small Indian mongoose (Herpestes auropunctatus) on St. John, U.S. Virgin Islands. Forty mongoose were sampled (31%, 9&) for ectoparasites, and cat fleas (Ctenocephalides felis) were discovered on 17 individuals. There was no difference in the number of ectoparasites per mongoose across age classifications (r = 0.109, P = 0.579). However, males had more cat fleas than females, even when mass was taken into account (males are generally heavier). Future behavioral studies may explain these sex differences. Aim: This study used both high resolution and medium resolution satellite imagery to test three semi-automated remote sensing methods, in an attempt to identify useful tools to support eye-witness testimony and reports on human rights violations. As huts are routinely burned down during attacks on a village, particularly in Sudan, the number of huts and villages burned can be used to corroborate on-the-ground reports.
