The Effects Of Intent: Do We Know How Legal Standards Work?, Theodore Eisenberg, Sheri Lynn Johnson

No one knows how the intent standard works in racial discrimination cases, though many have speculated. To test the speculation, this study examines how the intent standard actually operates. Its findings cast doubt on whether we really know how any legal standard functions.

We examine certain analytic and numerical aspects of optimal control problems for the stationary Navier-Stokes equations. The controls considered may be of either the distributed or Neumann type; the functionals minimized are either the viscous dissipation or the L4-distance of candidate flows to some desired flow. We show the existence of optimal solutions and justify the use of Lagrange multiplier techniques to derive a system of partial differential equations from which optimal solutions may be deduced. We study the regularity of solutions of this system. Then, we consider the approximation, by finite element methods, of solutions of the …

Municipal Capital Maintenance And Fiscal Distress, Mary K. Bumgarner, Jorge Martinez-Vazques, David L. Sjoquist

This paper formalizes and empirically tests the hypothesis that the deficient maintenance of public infrastructure is caused by fiscal distress. We utilize a production-decision framework in which public officials combine maintenance and new capital to produce a desired level of capital services. The behavior implied in the fiscal distress hypothesis is treated as perverse deviations from the optimal production path. The empirical findings from cross-sectional expenditures data give support to the fiscal distress hypothesis.

The Minister for Fisheries commissioned Economic Research Associates to carry out a study of the economic impact of recreational fishing in Western Australia. Two surveys were conducted to determine how much recreational fishers spend during the year on goods and services in order to go fishing. One involved telephone interviews of 401 recreational fishers, who were selected from a stratified random sample of households in five major regions of the state. The other survey employed a self enumeration questionnaire sent to randomly selected licensed recreational fishers, as well as being made available on non-random self-selection basis through fishing clubs and …

The Relationship Between Plaintiff Sucess Rates Before Trial And At Trial, Theodore Eisenberg

Legal cases that reach trial are a biased subset of underlying disputes. This makes it difficult to study the legal system by observing tried cases. This paper examines the relationship between plaintiff success at pretrial motion and trial stages across many categories of cases. The large, significant positive relationship between plaintiff success rates at these two procedural stages suggests that characteristics of case categories influence outcomes at both stages. Observers of a category of tried cases or cases resolved by motion can make informed judgments about how that category of cases fares at the other procedural stage.

A digital model of the Newgrange passage tomb and surrounding ring of monoliths known as the Great Circle is used to investigate sunrise shadow casting phenomena at the monument. Diurnal variation in shadow directions and lengths are analysed for their potential use in the Bronze Age to indicate the passage of seasonal time. Computer-aided simulations are developed from a photogrammetric survey to accurately show how three of the largest monoliths, located closest to the tomb entrance and archaeologically coded GC1, GC-1 and GC-2, cast their shadows onto the vertical face of the entrance kerbstone, coded K1. Optimal control problems for the stationary Navier-Stokes equations are examined from analytical and numerical points of view. Most revolutions are noisy, tumultuous affairs. This is as true of significant shifts in legal doctrine as it is of shifts of political power through force of arms. Indeed, the pro-plaintiff revolution in American products liability in the early 1960s will forever be associated with heroic, martial images, epitomized in Prosser's description of the assault upon, and fall of, the fortress citadel of privity. The same sort of terminology aptly could be used to describe the last five or ten years of legislative reform activity in the various states. The Effect Of Age Misreporting In China On The Calculation Of Mortality Rates At Very High Ages, Ansley J. Coale, Shaomin Li

When mortality rates by age are calculated from recorded deaths and enumerated populations, rates at higher ages are typically in error because of misstated ages. Mortality rates for China in 1981 have been calculated from the number of deaths in 1981 in each household recorded in the 1982 census, and from the census population back-projected one year. Because age was determined from date of birth, and because persons of the Chinese culture have very precise knowledge of date of birth, the mortality rates even at high ages should be unusually accurate.
